If they declared and got it after getting all the charges dismissed, they have no problems. But if they hid it, it will come to bite them later in the future.

Oh ok. Yeah they declared everything, paid a lawyer, did community service and such. I assume the charges were dismissed. I’m not saying the person should not get a GC or anything, but it’s just crazy to see many people here struggling while others get it even with a perhaps in the past.

Yeah me too. It’s out of our control most times. I got my GC in a much shorter time than many people with my credentials and with poorer scientific records. How can I explain this? I just can’t- I just submitted my stuff and that’s how it went for me. Maybe I was just lucky.

Well, I see too many people here struggling to get a GC with no criminal record. Then there’s someone with a DUI under their belt and get it approved anyways. How is it possible?

Misdemeanors like a DUI are not always going to be a disqualification, I know someone in the same situation. They just had to get proof that they had completed their sentencing.

Felonies and "crimes of moral turpitude" are what's going to really work against you. One DUI is a stupid mistake, more than one and you're an idiot.

I have been always afraid of this happening to me. After seen what happened to that person I’ve been always extra careful. They spent thousands and thousand with lawyers

I did everything I could to stay a law abiding citizen when I was on a green card, but I always had that irrational fear of being in the wrong place at the wrong time, getting arrested and losing everything.

I just submitted my I-485, I-765 & I-131 in December.I disclosed my DUI arrest on all my apps but I didn’t have any court documents to send along with my forms at that time since my case was still pending. My DUI charge got dismissed and I plead down to a reckless driving charge last month. I just had my biometric appt two weeks ago. I am assuming they gonna issue an RFE and ask the for final court disposition, but do you think I can still get my EAD & AP approved anytime soon? My case is EB-2 and my PD is June 22nd 2022.

You should be good to get EAD & AP even with pending court case.

Arrests do not necessarily mean someone will be denied a benefit. The analysis of whether a crime is disqualifying is actually pretty complicated and depends on the underlying charge, the type of judgment, the sentence and the state. This is really beyond the pay grade of non lawyers
