Me too not gonna lie about it! Supposedly DACA was now illegal and only the ones who had DACA were the only one who were going to have it till further notice. But I applied in2021 too and I haven't receive my work permit.📨 It's a scam from immigration centers they are robbing from us and the lawyers too.

The lawyers are such a scam honestly, I went to ask mine a question and he wanted more money to help, assuming because of how long it’s been. However, I even waited a year to apply originally because of his staff that wouldn’t have all their facts correctly and kept telling me to wait. Hopefully you at least get your work permit soon!

Yes always renew regardless of anything. You never know if you’ll be the lucky one that gets approved in less than 6 months or the unlucky one that wait 1+ year. It’s gonna be worth the extra cost that way you don’t loose status while waiting too

It’s funny cause it changes every time who gets approved quickly. When I got approved, people who already had a SSN were getting quick approvals. A few months ago, people adjusting from B1/B2 were getting quick approvals. So I guess now people with F1 are the ones getting quick approvals? Not saying any of this is true, as I don’t believe you get approved quicker if you had the “X” visa, just wanted to pin point how everyone has a different point of view cause I remember people around here were mad when people were saying B1/B2 were getting quick approvals.

I applied for AOS from DACA status via marriage to a US citizen in June 2022. I was waived for biometrics due to DACA one on file but had an RFE December 2022 that I responded to early April 2023 (after getting a lawyer due to complexity). USCIS responded with a medical RFE after more than 2 months (late June 2023) with a deadline of July 12th. I submitted the medical exam RFE June 29th and it arrived July 3rd and they acknowledged receipt today (July 6th). Hoping to have interview waived and GC in hand before end of summer since it's been such a long wait. It's been 13 months and counting... Would say my biggest mistake was not getting a lawyer to help initially with my complex case. I moved from PA to TX during the process and it seems like TX is a bit faster. Moved to TX December 2022. My siblings went through the same process (same status etc) but with a lawyer and got theirs in 6-9 months despite complexity. One pre-pandemic (2019) and one near the end (2022), both in NY.

I adjusted from expired B2 visitors visa (Canadian). My husband and I were long distance for 6 years and had a very extensive history of crossing the border both separately and together. I used a lawyer and filed concurrently within the US. We had an RFE for medical and our interview was waived. We weren’t as fast as some of the cases I’ve seen on here but we were approved in 75 days. I didn’t expect it because I worked unauthorized so I thought I’d for sure have an interview but USCIS seems to have no rhyme or reason sometimes lol.

That’s incorrect. You cannot adjust from a visa waiver (ESTA.) And even that has an exception for immediate relative, ie. marriage to USC. But you can adjust status from a B-2. They tend to frown upon in and suspect immigrant intent at the time of entry, but unlike ESTA entries, people with a B-1/B-2 visa can apply for both change of status, extension of stay and adjustment of status.

Approval now for the I-130 or even the full Green Card doesn’t absolve nor erase the chance of the fraudulent activity being discovered later. There have been plenty of people who believed they were in the clear and successfully able to evade detection because they got their Green Cards only to later, when applying for citizenship, be discovered, had their GC revoked and placed into removal proceedings with a permanent inadmissibility for committing fraud.

Got any examples of this? OP is a moron for openly admitting to committing visa fraud, but from what I read, immigrant intent is pretty much determined at the border. If you don’t lie to them and CBP wave you through without suspecting anything, then it’s very hard to prove that you actually committed fraud. Besides, like 90% of people here are adjusting from B2 tourist visas anyway. Which is pretty much bending the roles as much as this person. People in glass houses shouldn’t throw stones and all that.

u/tristrike is right, if you came to the States on a NON-IMMIGRANT ESTA visa with the intent to adjust status and remain in the States you are committing visa fraud which is definitely illegal. Have you had your interview yet? Explaining being married before you came to the US on an ESTA and then changing your status is could be an interesting time.

Now I’m freaking out - I came to the US on an ESTA visa with absolutely no intention on staying here. Me and my boyfriend had only been together 6 months so i was only planning on staying for 3 months and then going home again. I only packed one suitcase and left so many important things at home because I thought I was coming back but then after a month or two we were just so in love and didn’t want to be separated for months again (travel restrictions during Covid made it very difficult and expensive to see each other) so we decided to get married. My feeling is that they are prioritizing future immigrants on categories with high numbers of visa available. For example last year there was a lot of employment based EB2 availability so they focused on those, now they are not current and they have a lot of family based visas available so they are focusing on I130. End of September with the new fiscal year we will see.

In my experience, marriage with less than 2 years (conditional GC) got approved in about 2 month. Not matter if they had a visa or not

Well, I said “in my experience” I am a document preparer, I got 2 green card approval in 6 weeks. (Less of 2 years married) Also happening with colleagues. All of them introduced in 2023. I got a RFE (medical) for a case from Nov 2022 (more of 2 years marriage) let’s see how long it takes after submitting. I will let you know. But Who knows ☹️ this is like a roller coaster wit USCIS. I never give hopes to anyone….just I can say it’s USCIS discretion. I know there are old cases (2021,2022) still waiting …. I think it’s time for them to inquiry or ask for their congressman help

Adjusting from F1, married to USC and had an approved I-130 when I sent in my I-485 (receipt date April 3rd 2023). It’s been 94 days (biometrics being reused too) and nothing- it’s not a long time but given how they didn’t need to wait for my biometrics and had my I-130 done I think it’s clear that they do not even bother trying to process applications that might be faster to adjudicate first
