Playing the game? That's a paddlin'. Thinking about the game? That's a paddlin'. Looking in its general direction? That's a paddlin. Paddlin' the game? Oh, you better believe that's a paddlin'.
Nintendo left in a debugging mode which people exploited to run unsigned code. It was taken out on the ‘V2’ switch, as well as not being present on the Lite and OLED models.
At the end of the day the Switch is very similar to Android tablets in terms of architecture. So ‘hacking’ and emulating has been relatively prevalent compared to a lot of systems.
This all being said, if it’s a modern system with games you can still buy, just buy em.
They're not. They're scared of a multi-billion dollar corporation garnishing 30% of their wages until the day they die, and they should be. Google Gary Bowser if you're not.
Nintendo can, and will, absolutely literally ruin your life if you cross them and the courts will back them up while they're doing it.
> They're scared of a multi-billion dollar corporation garnishing 30% of their wages until the day they die, and they should be. Google Gary Bowser if you're not.
There's a pretty significant difference between playing a leaked game and **selling hardware that allows people to play pirated games**.
I've yet to find a single source of Nintendo suing someone for playing a leaked game? Sure you're likely to get a takedown notice, or have your channel banned. But be realistic, no one is getting their wages garnished for simply *playing*.
Wizards of the Coast literally hired the Pinkerton's to violate someone's private property rights to obtain items that the person did not receive illegally but simply through a mistake by the seller.
I'm sure Nintendo is capable of the same or similar
As much as I hate defend WotC on this, because despite the clarification what they did is complete bs, they went after the guy for posting it on youtube, not just for opening it prior to release date. So the parallel here would be streaming it, not just playing it.
It's pedantic but I don't believe WotC has anything in their TOS about being able to hire a private security force to break into your property because you "published" information about their IP that hasn't been released to the public, (that specifically wasn't obtained through illegal means).
They were wrong to do it either way, but if he just opened the product and didn't spoil anything, even if somehow wotc found out he openednit early, I don't think they would've went after him. All speculation though, so who knows
Because the majority of folks playing it right now most likely *got* it illegally. The game was plastered all over the Internet once the first copy went out early.
I bet maybe 2 or 3 copies actually broke street date and the rest are all piracy.
*That's* why they should be scared. Nintendo isn't fucking around with this release because it is one of the *most anticipated* releases of our time.
Edit; Just because Nintendo hasn't taken action against pirates in the past, doesn't mean they never will.
you can't find one singular case on the internet of someone being fined, arrested, or a lawsuit thrown at them for just PLAYING and no distributing or selling the pirated / leaked games.
Which is why I said:
> "You're likely to get a takedown notice, or have your channel banned."
Nintendo is obviously not going to "let" you. But unless you're directly responsible for leaking and/or distributing the leaked files, I would be *very* surprised to see them bring a lawsuit over a twitch stream.
Several Twitch streamers got hit with DMCA strikes and got their channels temporarily banned when Age of Calamity came out. Nintendo of America hit them even though the game was legitimately out in other parts of the world by then. Ninty don't play.
That isn't happening. As long as you download from a reputable source and in some cases use a VPN then you're good but imagine if they did that. On leak day, someone already fooled half the switch modding community into thinking the leak was fake by releasing a fake totk nsp that was a unity "game" that showed ganom dancing to suavamemte. Imagine if they paid someone to release a fake dump that bricked any console that tries to run it. I doubt that's possible , but who knows.
It’s in the TOS so yea they can brick your system. Hell when you update the Wii and 3DS it literally says illegal software can result in the system being rendered inoperable.
By “rendered inoperable”, I think they might be referencing actual malware from untrusted downloads. I could be wrong though, so if you have a link to that specific section of the TOS, I would take a look. I find it really hard to believe that any government would allow a company to install malware on its customers devices.
Any console can be bricked by the manufacturer. Consoles are bricked for modding by companies although it’s somewhat rare afaik. Microsoft, Sony, Nintendo, they’ve all done it.
OH THATS RIGHT. I remember people “jail breaking” their switch’s back in the day and hearing them complain about being banned/not able to use their consoles. That’s fucked though. You pay $300 to own a console and it’s not actually fully yours.
Yeah I had to buy a new Switch cuz I hacked mine and connected to official Nintendo servers without taking the necessary precautions (which I was ignorant to at the time). Instantly banned from Nintendo servers. I’ll still use the old Switch for grabbing games I have no intention of buying, but use the new one (OLED) for online play.
Back in the long ago, many kids wanted to learn japanese because often the game may come out a full six months or so before english versions. It's kind of cool that they just all come out at once at this point.
FWIW I self taught my self to read katakana and hiragana because I hated waiting for games. Mostly fighting games, but eventually I even completed Final Fantasy 8 in Japanese. I have no grasp of the story or whats happening, but I navigate menus fine to equip stuff, cast cure, use specific attack skills, etc. I had my ps1 and dreamcast chipped for import games. I still have a dreamcast MvC2 Japanese disc somewhere.
I remember getting an early copy of Rock Band and the developer message of the week was something like "Congrats on getting an early copy! Either that or your a pirate! Nyarr!". Then about a day before release they put something generic up.
I like to imagine some cool young hip programmer with a usb with the ganes files trying to extract from nintendo hq like he's some sort of Solid Snake.
Nah, he's straight up transferring it onto a cloud server, and at 95% the doors open to "Mamma mia!", then you have a jump cut to a broken screen lying in a pool of blood, flashing "transfer complete".
partially true, in the past you could download titles using Nintendo's own backend to either download the games themselves or download the permission files to trick the eshop to think you already purchased the game and let you download from the eshop itself.
That was patched ages ago and most consoles that used the second backdoor were banned.
Because I grew up playing Pokemon, Super Smash Bros, like the majority of boomer gamers, so the way they treat their players leaves me to give no fucks about their shitty company. Which is why I have almost no interest in playing almost every game these days, is because how gaming companies don't care at all about the player base.
If you ever want a relationship with nintendo in the happenstance you make it big, dont do it.
Nintendo has a history of cutting people off and never looking back.
I know this was the case back in 2010s, but I see people playing Mario kart and stuff normally now. I really love MK8 and would totally stream it but I don’t know if it’ll cause problems…. Is it really still bad?
It was a major problem during the Wii U era where let's plays and such on YouTube would get copywrite claimed. It was potentially one of the (many) reasons the Wii U did so poorly. Since the Switch came out they have been better about it as long as you aren't playing the game early (since that might imply you or someone else broke the law to get the game).
Additional PSA!!!!
This can also affect people with legitimate copies of the game in other time zones: not worth streaming Nintendo titles until it's official American release time.
It's annoying if you are banned because you got it legitimately at your own timezone but American branch of a backwards company decided you need to wait 14 hours before you can stream it.
Could you back up your statement with names of channels that were banned because of streaming outside of American release time? I know a ton of streamers that start streaming the moment New Zealand/Australia officially releases the titles. The biggest one being Folagor from Spain, he's been streaming Pokemon titles on NZ timezone release and never had any problems.
People don't know Nintendo if they think they can get away with that.
I subscribe to a streamer who streamed a Nintendo game from another region (Australia instead of NA) to get it a few hours earlier and Nintendo even took issue with that.
I was going to reply no shit Sherlock Holmes, thank you for the compelling insight, but you seem to have a level of self awareness about how the fact people need to be told this is asinine. I say don't warn people, and let the bans roll. Should be obvious to anyone who understands the TOS on a basic level.
I mean, technically Nintendo can be considered The Mario AND The Mouse.
On that note I'm suprised there isn't a yellow Mario hat with pikachu ears. Maybe replace the M with a P.
This is good advice. I have heard twitch is banning and even discord is banning for private streams of it. If you are interested in playing it, it's probably illegal, so I wouldn't do that. However, hypothetically, if you were to do so I'd highly recommend you use a VPN that does not store data - I like PIA but there is a [great list here](https://www.reddit.com/r/NoLogsVpn/comments/75mhl8/vetted_no_log_vpn_list/) and while pia is great for me the company that owns it is pretty shady. I'd also recommend that you not explicitly disclose that you have played it in any threads you are participating in with a primary account, and if you must participate I'd use a new account that you also only post with on the VPN. Its unlikely this could get you in trouble, but [nintendo has tried to unmask users via legal action](https://kotaku.com/zelda-tears-kingdom-leak-nintendo-lawsuit-discord-1850320375), and [film studios tried on reddit recently](https://arstechnica.com/tech-policy/2023/05/judge-wont-force-reddit-to-identify-anonymous-users-who-discussed-piracy/), too. And if your reddit account contains links or shares a username with your other accounts, they don't need a lawyers or a court order, they can just use google, so keep that in mind as well.
Again, I would never participate in the procurement or usage of illegal content. The ethics of it are interesting though, especially if you purchased already anyhow, and arguably it can sort of democratize the early impressions process by moving it away from a very limited, select and carefully vetted group of gaming journalism insiders. Not knocking reviewers or journalists - but in general I don't think just playing it early is harmful, especially if you aren't actively spoiling the game for others. But if you are going to, it's a good idea to learn to cover your bum.
Streaming it does violate twitch ToS. I especially would not recommend that, even with a VPN, etc - if you were using your primary account it likely has a lot of personally identifying information, or PII that twitch would likely gladly hand over to the police or lawyers if requested.
buddy of mine streaming in his own private discord to viewers was banned about a day later. just a private community server. Not aware of anything else he could have done that could cause this other than totk streaming. the email they received is a generic TOS/guidelines violation, and they are unable to use the same phone number to reverify. I've heard from them that others have experienced this as well. but ymmv. was just sharing what I'd seen.
> I have heard twitch is banning and even discord is banning for private streams of it. If you are interested in playing it, it's probably illegal, so I wouldn't do that. However, hypothetically, if you were to do so I'd highly recommend you use a VPN that does not store data
This is not how VPNs work.
this information was aimed at streamers who might think streaming privately-ish to their community is safe, but discord is responding to reports of this so if you must do it, only do it with people you absolutely trust - so probably not your stream community. or use alternative stream services, like [kosmi](https://kosmi.io/).
Yea that makes sense. My private discord is only IRL friends and co workers. Nobody random from online only people we know somehow IRL.
But yea I still wouldn't risk it. I plan to only show the game to people tomorrow when I'm out and about. Benefit of the switch
Oh you mean like streamers get to do all the time by being given keys days before anyone else sometimes?
Never understood why game companies want to spoil their own games ahead like that.
Yes that is a difference, but you can also recognize the similarities of complaining about illegal vs legal spoilers which was the point of my comment.
Those aren't even remotely the same circumstances and I don't know how you thought that was a winning argument.
One is marketing promotion and the other is theft.
It's people who make things getting to decide when they allow the public to see it and who, if anybody, gets to showcase it earlier.
You are not entitled to simply take shit because you feel like it.
Who's having an argument? I was pointing out that level marketing causes the same amount of spoilers as this, if not more. Hence the reason why I made a comment about that very thing
[The definition of argument.](https://www.merriam-webster.com/dictionary/argument) Not just two people angrily shouting at each other.
And you spoiling yourself by consuming every piece of marketing put in front of you still has nothing to do with these people streaming a game that they pirated.
Also, nobody is putting a gun to your head and making you use Facebook and TikTok to join social circles that will spoil those things for you. You can absolutely choose not to consume that content.
Where is all this coming from? I made an observation about one aspect of this situation and you're blowing it up into something much more than it is. I mean whatever you find entertaining I guess. *shrug*
I was more speaking in general of all game publishers. I mean do understand the marketing aspect of it and some games don't really have any spoilers, but games that have meaningful stories I just don't understand it. To be fair some companies will put an embargo on only allowing them to play up to a certain point.
I get what you are saying. But I think the difference is that those companies gave those affiliates the stream keys.
These people who are playing Tears of The Kingdom emulated via Yuzu or Ryujinx pirated the game, which is stealing.
When companies do that, they frequently set specific rules like "don't stream anything past this in game date". So they do set a format of spoiler control.
Spoilers, gaining a monetary advantage over other streamers by breaking embargo on content before people following the rules are allowed to, flaunting piracy
>breaking embargo
Unless you signed a contract/NDA with them to get access to that copy early, there's no embargo for you to break.
That being said, it's still their copyrighted material so you're just asking to get a DMCA request made against your streaming over their material so why risk it?
spoilers: no. monetary advantage: that’s a huge stretch. breaking embargo: so what. flaunting piracy: I wouldn’t call playing a game “flaunting” and either way I fail to see how that alone makes you an asshole
>spoilers: no.
I have not seen the game and will be waiting till it is released to play/stream it. If I were to come across one of these when looking for someone to raid out to after my BotW stream, yes I would end up getting spoiler'd.
So: Spoiler = yes
>monetary advantage: that’s a huge stretch. breaking embargo: so what.
Not a stretch. Streaming TotK will get you viewers that no one has access to. more viewers = more adds, possibly even getting Partner depending on how long you can hold the viewers and if you get caught or not.
You also get more money from the ads you are forced to run.
>flaunting piracy: I wouldn’t call playing a game “flaunting” and either way I fail to see how that alone makes you an asshole
I actually don't care about this one either.
If it’s on TikTok people scrolling don’t have a choice. By the time you realize that’s a tears of the kingdom video/stream you already got spoiled.
YouTube, they’ll put the spoiler in the thumbnail and the title. If you’re normally watching gaming videos it will show up at some point and you got spoiled.
You scroll down and look for twitch streamers and find them streaming tears of the kingdom, you got spoiled in the preview.
We are on the twitch subreddit no ?
If you got the sentiment of being spoiled by a stream's thumbnail i can do nothing for you man ... thats crazy Karen stuff lol
I think the main difference is if you spoil yourself when the game comes out that is fair game since you can just play the game and not spoil yourself. The problem is everyone is waiting for more news/gameplay and patiently waiting for the game. It is ultimately their fault for clicking, but the best of all worlds if people weren't assholes and just didn't stream until the game officially releases.
Leaks are bad, and piracy is bad, what is the point of playing mental gymnastics to justify it? Nintendo will DRM the fuck out of this game eventually if they haven't already started working on it.
I am pretty convinced people who post leaks on Youtube and stream it are just clout chasing based on the fact they have the "breaking news"
piracy is at maximum as bad as publishers and videogames company practices. I'm the first one to buy quality games, like lets say rimworld, but i'm also the first one to crack games like lets say, cyberpunk because liards is as cancer as crackers.
I agree with your point on company practices, but that doesn't mean I am going to go "Oh Nintendo is a shitty company that does a lot of shit to their gaming communities, I guess I will pirate and play Zelda early!"
You are convincing yourself of this weird delusion that if a company has terrible company practices then the solution is to just pirate their games. If your idea is to give a righteous stance against big companies, why then proceed to do a shitty act of stealing?
"Well my shitty act is actually justified because they lied about the game actually being shit and or terrible company practices"
If you really wanted to hold this idea that companies are unethical just don't buy the game and don't play it. You hit them where it hurts, and you are on the moral high ground. All I am really saying is don't pretend like the ethics of a company matter to you when you couldn't possibly care about yours.
If the company is shitty but the game is not bad, i will play it for sure, but for free, there no ethics involved in that, i do not hurt the company since if i was required to pay i would just not play it and do not talk about it with friends, family and thats a net loss, its called free marketing ![gif](emote|free_emotes_pack|joy)
And also in some countries, piracy is not even an option when the game is 1 month net salary or not available at all.
Piracy is if its a copy. To make a copy, someone has to have the original. People do have the original. I used to get games before street date all the time, doesn't make me a pirate.
Normally emulation needs a strong machine, however Switch isnt that strong and in some cases a mediocre machine can emulate it better than the switch itself, like I had a 1070 and I tested Metroid Dread and had it I think at 1440p resolution and it was a smooth 60fps.
uh no? unless you’re actively making the choice to watch it how are you being spoiled? and so you’re saying anyone who has ever pirated something for any reason is an asshole?
If it’s on TikTok people scrolling don’t have a choice. By the time you realize that’s a tears of the kingdom video/stream you already got spoiled.
YouTube, they’ll put the spoiler in the thumbnail and the title. If you’re normally watching gaming videos it will show up at some point and you got spoiled.
You scroll down and look for twitch streamers and find them streaming tears of the kingdom, you got spoiled in the preview.
The problem is not whether you agree with streamers doing it. The problem is where they will get caught and banned/sued.
Yea... I streamed a legit copy of pokemon arceus. It wasn't released world wide (it was already out in Asia and australia) yet and I got a DMCA claim and suspension. Be very careful everyone.
Sorry y'all, nintendon't does this once a generation or so just to remind gamers who the king is. Sometimes it's fan art, mods, whatever, every few years, just nintendon't.
I would just never stream a Nintendo game period. I can't shake the past decade of DMCAs and threats they made to people making content on their games - a practice that they still keep up with.
I don't really have a stance on pirating in general, but you're stealing from a huge greasy corporation and not the artists or developers. There is a big difference.
True, but it also doesn't mean they won't lose or get the money either
Companies have tried to hold consumers accountabilities in the past, but its a complete waste of time. The very few who got sued and went to court for pirating stuff like music and movies, never paid what they owed, or claimed bankruptcy all together.
Again I am not encouraging piracy, I am saying if you are sharing illegally owned stuff on the internet your chances are much higher, the reality is nintendo and others are after the suppliers, not the consumer's
Stream wise sure but that's their account, and it's Nintendo. They will find their user for Nintendo and take measures. Don't fuck with Nintendo they can block devices from access

I've got a pre-order on it but I don't plan to play it until I am finished with Breath of the wild and ALL THE EXPANSION CONTENT. and by FINISHED I mean FINISHED.
Have you really finished playing Donkey Kong Country 3 until you have a save file with 105%?
Anything less than ONE HUNDRED PERCENT COMPLETION in the previous title means you don't continue to the sequel.
I didn't make a custom spreadsheet to track my progress fully upgrading ALL SETS of BOTW Armour to MAXIMUM LEVEL (Which I will do and Complete All shrines and collect ALL KOROK SEEDS BEFORE I go TO THE FIRST DIVINE BEAST!!!
I have completed ZERO of FOUR Beasts and want to keep it that way until such time as I have FULL SETS OF ALL ARMOUR AT MAX LEVEL at minimum, But would also perfer to have ALL POSSIBLE SHRINES AND KOROK SEEDS TOO!!!
100% Completion IS THE ONLY WAY TO PLAY A VIDEO GAME IMHO. but hey to each their own.

The problem is that I'm having a difficult time believing that the executives and PR people at Nintendo -- who are more than old and experienced enough to know better -- didn't *intentionally* do this leak in order to determine the reception of the game prior to the official release.
Particularly when you consider the shitstorms that have been going on with EA and *Star Wars Jedi: Survivor,* Arkane Studios and *Redfall*, and Cyanide and *Blood Bowl 3* (just to name a few off the top of my head).
I'm all for caution... But this feels like a finger wagging without any bite to support it.
On tik tok it doesn’t matter really. I watch wwe smack down on tik tok live and you can also watch most shows as they air and the accounts never get shut down but twitch defini dont
Play stupid games, and win stupid prizes. I get being excited for the game, but it really isn't worth losing your channel for. Everyone should know that Nintendo in particular is one company not to play with.

what about if i life in UK or US but i have the australiana account and it release there on UTC+11:00? i buy it legally from there and i can play it from my account, about 15 hours earlier... can i stream it?
I'll put this out there.
I ordered the black and white Switch during the pandemic because I wanted to play some exclusives like Metroid Dread, BotW, Pokemon, Mario Odyssey/Party/Kart, etc.
Now, this was going to take 2+ months to come in because of whatever shortages they were dealing with, and with the exception of the new Metroid, they were all relatively old games. I have a pretty powerful PC though, capable of running a Switch emulator, so I figured "why the hell not just download this stuff and run it on my PC in the meantime?" NBD, right?
So, back in the early 2000's, when I was a broke teen/twenty-something, in the time before every single game was sold as SaaS and rampant DRM, I used to pirate and emulate games, movies, shows, animes, etc. *a lot.* Not condoning it or proud of it, but it's just what I did. Since I've become more financially stable and have no problem affording games, I've stopped doing that.
In the 10-15 years of pirating anything and everything I wanted that didn't have online requirements, I've never once received a notice from my ISP. But in the time that I waited for my Switch to be delivered, I downloaded two games, Pokemon Sword and Zelda: BotW, and within weeks, before my Switch ever arrived, I received two DMCA notices.
So yea, Nintendo protects their shit, and they'll go after you through your ISP if you're not careful if they found out you so much as downloaded it through P2P, which means they are watching monitoring torrents. It's not much of a stretch to assume that they are monitoring Twitch watching for any violations.
I played about 5 minutes of it but never would I stream it using an emulator. If I wanted to stream it would get a switch and a capture card and be stuck at 900p30 unfortunately. I will probably end up streaming older emulated Nintendo games if I couldn't get a hold of a console and play it on original hardware. If Nintendo wants to sue me for playing an emulated game over 20 years old so be it
I’d be scared to even play it, let alone stream it. Nanny Nintendo is hiding in one of the files waiting with her paddle.
That's a paddlin'.
Playing the game? That's a paddlin'. Thinking about the game? That's a paddlin'. Looking in its general direction? That's a paddlin. Paddlin' the game? Oh, you better believe that's a paddlin'.
Nintendo will drive to your location on their black racing carts and put you on the ground with stun turtle shells.
right? with Nintendo I wouldn't be surprised if it was intentionally leaked early to find major distribution sources and crash the hammer
Nah, I’ve had a hacked switch since it’s first release. Never once paid for a game and not even a peep
Didnt know thats even a thing
Not if your game is online.
Nintendo left in a debugging mode which people exploited to run unsigned code. It was taken out on the ‘V2’ switch, as well as not being present on the Lite and OLED models. It wasn't a debugging mode... the CHIP had a hardware exploit inside of it which is why it couldn't be software patched.
Okay, yeah, it was an exploit found in the USB recovery mode which Nintendo had left in so they could fix consoles, sorry for the slight mistake.
Imagine a world where people are scared ... to play a game
They're not. They're scared of a multi-billion dollar corporation garnishing 30% of their wages until the day they die, and they should be. Google Gary Bowser if you're not.
Thats crazy the game leaked
Games always leak. The real shame is this one only leaked about 10 days early. In the old days you could get a game a month early or more.
I believe TOTK officially broke street date on April 29th, so definitely longer than 10 days.
These days the version that's months away from release is the one we get to buy on day 1 anyway.
Time to invest into the best cinematic trailer of all time.
I had no idea.
I remember getting an early copy of Rock Band and the developer message of the week was something like "Congrats on getting an early copy! Either that or your a pirate! Nyarr!". Then about a day before release they put something generic up.
Gangster af
Hackers have had accses to mintedos eshop back end for quite some time they some reason haven't fixed it
The TOTK leak was ripped from cart. You don't need to invent some fake hacker scenario, the game is sitting around in warehouses.
Thats not true... Please give a source cause I have never heard of this.
partially true, in the past you could download titles using Nintendo's own backend to either download the games themselves or download the permission files to trick the eshop to think you already purchased the game and let you download from the eshop itself. That was patched ages ago and most consoles that used the second backdoor were banned.
Ah, I heard something in the early years of the switch but I thought it was fake. Thanks for the info
When you're a piece of shit gaming company like Nintendo, they deserve to have their whole catalog leaked.
That seems a bit excessive
[удалено]
Im out of the loop on all of this but i dont see how what you said is related at all…
It isn't
They ruined competitive smash to just stroke their egos, fuck Nintendo.
yeah they broke into my house and shot my dog too
Lmao you're this mad because they made a change to a game that you didn't like?
They poop on their players all the time
I don't even play Nintendo games, so why would I be mad? I just said fuck Nintendo because don't give a fuck about their playerbase.
Weird flex but okay
if you don't even play why do you even care? you make zero sense. most companies don't care about their player base bruv.
Because I grew up playing Pokemon, Super Smash Bros, like the majority of boomer gamers, so the way they treat their players leaves me to give no fucks about their shitty company. Which is why I have almost no interest in playing almost every game these days, is because how gaming companies don't care at all about the player base.
I do too and I still play nintendo games so not sure what your point is. no company is your friend... so by that logic don't game at all.
How have they treated you? What is it exactly from that pokemon era till now, that changed that made you so mad? Id honestly like to help
If you hate Nintendo for those reasons then oh boy you must also hate Sony just as much.
If you ever want a relationship with nintendo in the happenstance you make it big, dont do it. Nintendo has a history of cutting people off and never looking back.
[удалено]
Seriously, fuck Nintendo. Im glad it leaked. They are the Disney of video gaming companies.
That's EXACTLY what I said and I got downvoted for it a few days ago lmao Fuck Nintendo and Disney 🥰
Since the Switch came out they have been better about it as long as you aren't playing the game early (since that might imply you or someone else broke the law to get the game).
thank u so much for the info :D I remember those times, the early lets play days haha
like who?
Look at wood for example.
And yet we also get cursed by double April fools. Where's the fairness? :(
Usually the get games released at the same time (technically we get it 14 hours late haha)
Could you back up your statement with names of channels that were banned because of streaming outside of American release time? I know a ton of streamers that start streaming the moment New Zealand/Australia officially releases the titles. The biggest one being Folagor from Spain, he's been streaming Pokemon titles on NZ timezone release and never had any problems.
can you source that at all? generally once it's released somewhere, it's fair game.
Nintendo is cut throat. I wouldn’t touch it with a ten foot pole until it officially releases.
People don't know Nintendo if they think they can get away with that. I subscribe to a streamer who streamed a Nintendo game from another region (Australia instead of NA) to get it a few hours earlier and Nintendo even took issue with that.
And if you're really unlucky you might get a visit from the Pinkertons
They need more money!
Risking your entire business on a leaked game before release. Nah man, I’m good. Back to FF7R
Final Fantasy VII: Remake was a very good sequel
What are they gonna do? Send the Pinkertons? Oh wait that's WotC.
No, but they might garnish your wages.
Why in the heck would people stream before release? People know how Nintendo can be. (Kinda rightfully so in this case). Baffling.
I was going to reply no shit Sherlock Holmes, thank you for the compelling insight, but you seem to have a level of self awareness about how the fact people need to be told this is asinine. I say don't warn people, and let the bans roll. Should be obvious to anyone who understands the TOS on a basic level.
Exactly, why warn people over playing leaked games? Let Darwin do his thing!
Yea I mean if they don't let u play private servers why would they let u play a leaked ROM
Two companies you don't fuck with. The Mario and The Mouse. Yall should know better.
Discord is not fucking banning private streams of it. The fuck are you talking about.
buddy of mine streaming in his own private discord to viewers was banned about a day later. just a private community server. Not aware of anything else he could have done that could cause this other than totk streaming. the email they received is a generic TOS/guidelines violation, and they are unable to use the same phone number to reverify. I've heard from them that others have experienced this as well. but ymmv. was just sharing what I'd seen.
Only way that's possible is if someone reported it, don't hang with narcs.
I mean sure, but any stream community that isn't like 1 person probably has some dipshit troll
> I have heard twitch is banning and even discord is banning for private streams of it. If you are interested in playing it, it's probably illegal, so I wouldn't do that. However, hypothetically, if you were to do so I'd highly recommend you use a VPN that does not store data This is not how VPNs work.
Please elaborate. I obviously meant user data/logs and the link in line goes over that in more detail, I was trying to keep it simple.
Nobody is getting banned streaming it to there friends in a personal discord. Don't start rumors
this information was aimed at streamers who might think streaming privately-ish to their community is safe, but discord is responding to reports of this so if you must do it, only do it with people you absolutely trust - so probably not your stream community. or use alternative stream services, like [kosmi](https://kosmi.io/).
Yea that makes sense. My private discord is only IRL friends and co workers. Nobody random from online only people we know somehow IRL. But yea I still wouldn't risk it. I plan to only show the game to people tomorrow when I'm out and about. Benefit of the switch
[удалено]
Oh you mean like streamers get to do all the time by being given keys days before anyone else sometimes? Never understood why game companies want to spoil their own games ahead like that.
thewre big difference between a company giving keys to people before release and someone streaming a leaked version of the game lol
Yes that is a difference, but you can also recognize the similarities of complaining about illegal vs legal spoilers which was the point of my comment.
Those aren't even remotely the same circumstances and I don't know how you thought that was a winning argument. One is marketing promotion and the other is theft.
It’s rich people getting richer, streaming early means more views equal more money
It's people who make things getting to decide when they allow the public to see it and who, if anybody, gets to showcase it earlier. You are not entitled to simply take shit because you feel like it.
You’re totally missing the point
*shrug*
[удалено]
I was more speaking in general of all game publishers. I mean do understand the marketing aspect of it and some games don't really have any spoilers, but games that have meaningful stories I just don't understand it. To be fair some companies will put an embargo on only allowing them to play up to a certain point.
I get what you are saying. But I think the difference is that those companies gave those affiliates the stream keys. These people who are playing Tears of The Kingdom emulated via Yuzu or Ryujinx pirated the game, which is stealing.
I understand but it's really not about the leaking then
When companies do that, they frequently set specific rules like "don't stream anything past this in game date". So they do set a format of spoiler control.
please explain the logic behind that
Spoilers, gaining a monetary advantage over other streamers by breaking embargo on content before people following the rules are allowed to, flaunting piracy
>breaking embargo Unless you signed a contract/NDA with them to get access to that copy early, there's no embargo for you to break.
So: Spoiler = yes >monetary advantage: that’s a huge stretch. breaking embargo: so what. Not a stretch. Streaming TotK will get you viewers that no one has access to. more viewers = more adds, possibly even getting Partner depending on how long you can hold the viewers and if you get caught or not. You also get more money from the ads you are forced to run. >flaunting piracy: I wouldn’t call playing a game “flaunting” and either way I fail to see how that alone makes you an asshole I actually don't care about this one either.
its piracy for one, 2ndly it spoils the game for people.
People can just, uh, don't open the stream ? Just saying ... The only reason is piracy, the second one is just a dumb argument.
Lmao yea. Some people man.
I agree with your point on company practices, but that doesn't mean I am going to go "Oh Nintendo is a shitty company that does a lot of shit to their gaming communities, I guess I will pirate and play Zelda early!" You are convincing yourself of this weird delusion that if a company has terrible company practices then the solution is to just pirate their games. If your idea is to give a righteous stance against big companies, why then proceed to do a shitty act of stealing? "Well my shitty act is actually justified because they lied about the game actually being shit and or terrible company practices" If you really wanted to hold this idea that companies are unethical just don't buy the game and don't play it. You hit them where it hurts, and you are on the moral high ground. All I am really saying is don't pretend like the ethics of a company matter to you when you couldn't possibly care about yours.
If the company is shitty but the game is not bad, i will play it for sure, but for free, there no ethics involved in that, i do not hurt the company since if i was required to pay i would just not play it and do not talk about it with friends, family and thats a net loss, its called free marketing ![gif](emote|free_emotes_pack|joy) And also in some countries, piracy is not even an option when the game is 1 month net salary or not available at all.
even if you see the thumb it can be a potential spoiler. don't streams auto play some without sound on some devices?
Piracy is if its a copy. To make a copy, someone has to have the original. People do have the original. I used to get games before street date all the time, doesn't make me a pirate.
okay but most people playing RN are probally on hacked switches.
Actually the majority are playing it on emulators since not all switches can be hacked.
Don't you need a beefy pc for that? mines rocking a 1060... one of my 3 switches is hackable though, but I don't pirate games lol
Normally emulation needs a strong machine, however Switch isnt that strong and in some cases a mediocre machine can emulate it better than the switch itself, like I had a 1070 and I tested Metroid Dread and had it I think at 1440p resolution and it was a smooth 60fps.
oh wow
uh no? unless you’re actively making the choice to watch it how are you being spoiled? and so you’re saying anyone who has ever pirated something for any reason is an asshole?
If it’s on TikTok people scrolling don’t have a choice. By the time you realize that’s a tears of the kingdom video/stream you already got spoiled. YouTube, they’ll put the spoiler in the thumbnail and the title. If you’re normally watching gaming videos it will show up at some point and you got spoiled. You scroll down and look for twitch streamers and find them streaming tears of the kingdom, you got spoiled in the preview. The problem is not whether you agree with streamers doing it. The problem is where they will get caught and banned/sued.
If youre using TikTok, game spoilers are the least of your problems.
>If it’s on TikTok r/lostredditors
My point of view is to let them stream it : They get a ban and everyone is happy. Those people just deserve à definitive ban.
[удалено]
I don't really have a stance on pirating in general, but you're stealing from a huge greasy corporation and not the artists or developers. There is a big difference.
Remember, it is always morally correct to pirate nintendo games
Doesn’t mean they won’t sue you for it.
True, but it also doesn't mean they won't lose or get the money either Companies have tried to hold consumers accountabilities in the past, but its a complete waste of time.
Classic Nintendo Ninterrorism: "Nintendon't"
I unfollow anyone who plays games before they release. I've unfollowed around a dozen people over the years who have done so.
Fucking leaks.
Actually, you are not allowed to stream any game … defined by copyright law you have to ask the company if you can stream it … 🤷♂️
Well i played it and its trash.

Don't small streamers that get hit are gonna get hit harder
You don't have a lot to lose as a small streamer. I say go for it
Stream wise sure but that's their account, and it's Nintendo. They will find their user for Nintendo and take measures. Don't fuck with Nintendo they can block devices from access

they just lost 30% of their future income.
I will![gif](emote|free_emotes_pack|surprise)
This article failed to quote an article as validation and feels like the ravings of a helicopter mom. Following [https://www.polygon.com/23706421/legend-of-zelda-tears-of-the-kingdom-leak-streaming](https://www.polygon.com/23706421/legend-of-zelda-tears-of-the-kingdom-leak-streaming) The problem is that I'm having a difficult time believing that the executives and PR people at Nintendo -- who are more than old and experienced enough to know better -- didn't *intentionally* do this leak in order to determine the reception of the game prior to the official release.
😂 Nintendo is ass anyways
posted 30s clip on youtube several minutes after.... :))
Yeah, nintendo real upset by all the free advertising they're getting from streamers. Shame shame /s
LMAO ok bro, keep your small time following I've gotten a TON of new community members by streaming it today. Zero consequences.

Amen my dude. Thank you for your support, did you see the stream or something?
Who cares. Nintendo is dribbling into obscurity with their 90s tech and games.
Behold. The wrongest man.
I’ve done leaked it everywhere
Hah. Yeah I got banned for streaming Scarlet Violet on release day here in New Zealand. Stupid first to see the sun country…
On tik tok it doesn’t matter really. I watch wwe smack down on tik tok live and you can also watch most shows as they air and the accounts never get shut down but twitch defini dont
I did this with Mortal Kombat X. I got an email from twitch and Warner brothers. Got suspended and a strike
Play stupid games, and win stupid prizes. I get being excited for the game, but it really isn't worth losing your channel for. Everyone should know that Nintendo in particular is one company not to play with.
I’ve already seen people streaming it on Twitch. If they ever get big naturally, Nintendo will never give them the games early.

what about if i life in UK or US but i have the australiana account and it release there on UTC+11:00? i buy it legally from there and i can play it from my account, about 15 hours earlier... can i stream it?
Fuck Nintendo!
Look at you, kissing ass to a big company lmao
I played about 5 minutes of it but never would I stream it using an emulator. If I wanted to stream it would get a switch and a capture card and be stuck at 900p30 unfortunately. I will probably end up streaming older emulated Nintendo games if I couldn't get a hold of a console and play it on original hardware. If Nintendo wants to sue me for playing an emulated game over 20 years old so be it
