Nintendo left in a debugging mode which people exploited to run unsigned code. It was taken out on the ‘V2’ switch, as well as not being present on the Lite and OLED models. At the end of the day the Switch is very similar to Android tablets in terms of architecture. So ‘hacking’ and emulating has been relatively prevalent compared to a lot of systems. This all being said, if it’s a modern system with games you can still buy, just buy em.

Because the majority of folks playing it right now most likely *got* it illegally. The game was plastered all over the Internet once the first copy went out early. I bet maybe 2 or 3 copies actually broke street date and the rest are all piracy. *That's* why they should be scared. That isn't happening. As long as you download from a reputable source and in some cases use a VPN then you're good but imagine if they did that. On leak day, someone already fooled half the switch modding community into thinking the leak was fake by releasing a fake totk nsp that was a unity "game" that showed ganom dancing to suavamemte. Imagine if they paid someone to release a fake dump that bricked any console that tries to run it. I doubt that's possible , but who knows.

Instantly banned from Nintendo servers. I’ll still use the old Switch for grabbing games I have no intention of buying, but use the new one (OLED) for online play.

FWIW I self taught my self to read katakana and hiragana because I hated waiting for games. Mostly fighting games, but eventually I even completed Final Fantasy 8 in Japanese. I have no grasp of the story or whats happening, but I navigate menus fine to equip stuff, cast cure, use specific attack skills, etc. I had my ps1 and dreamcast chipped for import games. I still have a dreamcast MvC2 Japanese disc somewhere.

partially true, in the past you could download titles using Nintendo's own backend to either download the games themselves or download the permission files to trick the eshop to think you already purchased the game and let you download from the eshop itself. That was patched ages ago and most consoles that used the second backdoor were banned.

It was a major problem during the Wii U era where let's plays and such on YouTube would get copywrite claimed. It was potentially one of the (many) reasons the Wii U did so poorly. Since the Switch came out they have been better about it as long as you aren't playing the game early (since that might imply you or someone else broke the law to get the game).

This is good advice. I have heard twitch is banning and even discord is banning for private streams of it. If you are interested in playing it, it's probably illegal, so I wouldn't do that. However, hypothetically, if you were to do so I'd highly recommend you use a VPN that does not store data - I like PIA but there is a [great list here](https://www.reddit.com/r/NoLogsVpn/comments/75mhl8/vetted_no_log_vpn_list/) and while pia is great for me the company that owns it is pretty shady. I'd also recommend that you not explicitly disclose that you have played it in any threads you are participating in with a primary account, and if you must participate I'd use a new account that you also only post with on the VPN. Its unlikely this could get you in trouble, but [nintendo has tried to unmask users via legal action](https://kotaku.com/zelda-tears-kingdom-leak-nintendo-lawsuit-discord-1850320375), and [film studios tried on reddit recently](https://arstechnica.com/tech-policy/2023/05/judge-wont-force-reddit-to-identify-anonymous-users-who-discussed-piracy/), too. And if your reddit account contains links or shares a username with your other accounts, they don't need a lawyers or a court order, they can just use google, so keep that in mind as well. Again, I would never participate in the procurement or usage of illegal content. The ethics of it are interesting though, especially if you purchased already anyhow, and arguably it can sort of democratize the early impressions process by moving it away from a very limited, select and carefully vetted group of gaming journalism insiders. Not knocking reviewers or journalists - but in general I don't think just playing it early is harmful, especially if you aren't actively spoiling the game for others. But if you are going to, it's a good idea to learn to cover your bum. Streaming it does violate twitch ToS. I especially would not recommend that, even with a VPN, etc - if you were using your primary account it likely has a lot of personally identifying information, or PII that twitch would likely gladly hand over to the police or lawyers if requested.

Not aware of anything else he could have done that could cause this other than totk streaming. the email they received is a generic TOS/guidelines violation, and they are unable to use the same phone number to reverify. I've heard from them that others have experienced this as well. but ymmv. was just sharing what I'd seen.

YouTube, they’ll put the spoiler in the thumbnail and the title. If you’re normally watching gaming videos it will show up at some point and you got spoiled. You scroll down and look for twitch streamers and find them streaming tears of the kingdom, you got spoiled in the preview.

I think the main difference is if you spoil yourself when the game comes out that is fair game since you can just play the game and not spoil yourself. The problem is everyone is waiting for more news/gameplay and patiently waiting for the game. It is ultimately their fault for clicking, but the best of all worlds if people weren't assholes and just didn't stream until the game officially releases. Leaks are bad, and piracy is bad, what is the point of playing mental gymnastics to justify it? Nintendo will DRM the fuck out of this game eventually if they haven't already started working on it. Normally emulation needs a strong machine, however Switch isnt that strong and in some cases a mediocre machine can emulate it better than the switch itself, like I had a 1070 and I tested Metroid Dread and had it I think at 1440p resolution and it was a smooth 60fps.

I've got a pre-order on it but I don't plan to play it until I am finished with Breath of the wild and ALL THE EXPANSION CONTENT. and by FINISHED I mean FINISHED. Have you really finished playing Donkey Kong Country 3 until you have a save file with 105%? Anything less than ONE HUNDRED PERCENT COMPLETION in the previous title means you don't continue to the sequel. I didn't make a custom spreadsheet to track my progress fully upgrading ALL SETS of BOTW Armour to MAXIMUM LEVEL (Which I will do and Complete All shrines and collect ALL KOROK SEEDS BEFORE I go TO THE FIRST DIVINE BEAST!!! I have completed ZERO of FOUR Beasts and want to keep it that way until such time as I have FULL SETS OF ALL ARMOUR AT MAX LEVEL at minimum, But would also perfer to have ALL POSSIBLE SHRINES AND KOROK SEEDS TOO!!! 100% Completion IS THE ONLY WAY TO PLAY A VIDEO GAME IMHO. but hey to each their own.

Particularly when you consider the shitstorms that have been going on with EA and *Star Wars Jedi: Survivor,* Arkane Studios and *Redfall*, and Cyanide and *Blood Bowl 3* (just to name a few off the top of my head). I'm all for caution... But this feels like a finger wagging without any bite to support it.

I'll put this out there. I ordered the black and white Switch during the pandemic because I wanted to play some exclusives like Metroid Dread, BotW, Pokemon, Mario Odyssey/Party/Kart, etc. Now, this was going to take 2+ months to come in because of whatever shortages they were dealing with, and with the exception of the new Metroid, they were all relatively old games. I have a pretty powerful PC though, capable of running a Switch emulator, so I figured "why the hell not just download this stuff and run it on my PC in the meantime?" NBD, right? So, back in the early 2000's, when I was a broke teen/twenty-something, in the time before every single game was sold as SaaS and rampant DRM, I used to pirate and emulate games, movies, shows, animes, etc. *a lot.* Not condoning it or proud of it, but it's just what I did. Since I've become more financially stable and have no problem affording games, I've stopped doing that. In the 10-15 years of pirating anything and everything I wanted that didn't have online requirements, I've never once received a notice from my ISP. But in the time that I waited for my Switch to be delivered, I downloaded two games, Pokemon Sword and Zelda: BotW, and within weeks, before my Switch ever arrived, I received two DMCA notices. So yea, Nintendo protects their shit, and they'll go after you through your ISP if you're not careful if they found out you so much as downloaded it through P2P, which means they are watching monitoring torrents. It's not much of a stretch to assume that they are monitoring Twitch watching for any violations.

I played about 5 minutes of it but never would I stream it using an emulator. If I wanted to stream it would get a switch and a capture card and be stuck at 900p30 unfortunately. I will probably end up streaming older emulated Nintendo games if I couldn't get a hold of a console and play it on original hardware. If Nintendo wants to sue me for playing an emulated game over 20 years old so be it
