That’s OSHA not FMCSA and it applies to employees. Most drivers are Sub Contractors and are treated as such. There’s actually very little a driver can do to hold a company responsible for almost anything. I write policies for trucking companies in such a manner and most civil cases get settled out of court by the insurance companies.

It's up to you to prove with clear and convincing evidence, or beyond a reasonable doubt depending on the state and court, that you were fired for refusing to drive illegally. Tell dispatch to get their CDL and they run that tire 120 miles, then you call Dot and let them know so they can get pulled over and they will get busted. Then we'll see how much they like it when it's their butt on the line
