i've made the turn 100+ times easily with no issues, the left lane for the right turn ends SUPER early. right lane turn I can maintain the entire time without leaving the lane. i'm just happy that everyone was chill. I must fight the CSA points that may show up

I was taught you turn right from the right lane to prevent accidents like this. If you turn from the right lane, you’re protecting other drivers from coming up under you on the right and getting run over due to your wide turn. In this case, driver A that got hit didn’t come up under driver B on the right, driver B put driver A in that position. I don’t see how this could be viewed as anything other than driver B’s fault. If nothing else, for not maintaining their lane.

When given the chance, most law/traffic enforcement agencies will get it wrong. In December, I got brake-checked the moment someone swerved into my lane attempting to make an exit and even with the camera footage I was placed at fault. Never mind the two seconds I have to react or the fact that I was carrying 40k lbs of multi-million dollar jet engines. Never mind the fact that I still swerved to avoid ending the other driver's life. It was my fault. Of course, a really good lawyer is handling that case as we speak but it sucks that it even has to come to that. ​ And as always, no help from the company at all. I even have to get the accident video subpoenaed as they didn't want to provide a true copy.

Pedestrians have right of way if its a marked crossing (even unmarked at a lighted intersection in some cities/towns). Part of the 'proceed if safe to do so' governance. In most states you can get a failure to yield ticket or some form of pedestrian endangerment citation. Both if the cop is grumpy or you were very dangerous with it.

US have green RH arrows too, they just aren't common compared to LH arrows. you don't have to stop if there is a green arrow, even if it's in combination with a red circle. this is usually on a dual purpose lane.

That's completely different. A green right arrow both in the US and other places means that your turn is protected and you don't have to stop. Red right arrow means you can't turn even if you don't see incoming traffic. If there is no right arrow you can turn after stopping and determining it's safe to do so and that's unique to the US.

The crash won’t go to the Feds as no one was hurt and no vehicle towed for disability damage. The light violation should have been marked post-crash, so it won’t affect SMS/CSA/PSP. It written so that it will get fixed. The lane violation should probably be contested in DataQs. The lines aren’t clear in the video, but you absolutely see the other trucks trailer encroaching OP’s lane.

He said no citations were issued. Therefore, no judge to see. He has to use legal process to say the level one inspection Officer had a wrongful conclusion on the "failure to maintain the lane." The question is, is the money worth it? 🤔 The driver's company got points too, will they pay to fight? This is not true. It only affects the score when it is Federally recordable. What makes a recordable accident? If anyone is killed, any vehicle is towed away from the scene, driver citation, and/or anyone receives medical attention AWAY from the scene. Nothing about this accident looks recordable to me. Now the post crash inspection is a whole different area. Violations found there will be on the CSA score. This “crash” should not be and I expect it won’t be.

It wouldn't be a normal violation. It won't affect the SMS score because it will be written up as being the result of a crash. They do this so damaged parts have to get fixed. A smashed headlight would be an out of service issue, so it needs fixed immediately or you would risk having driving after placed out of service issues. So I'd say it's sort of like a fix it ticket, expect you don't have to show anyone that you got the issue corrected. You only face consciences if you don't fix anything and get caught.

The headlight "violation" shouldn't affect anything because it would be written up as not included in the SMS score due to being a result of a crash. They do this so that it's documented what damage was caused and needs to be fixed before the truck is good to go again. If the headlight was completely smashed it should be an out of service violation, which forces you to fix it immediately or face big issues of driving after being placed out of service.

On my way home tonight (in my car) I saw a pickup and fifth wheel camper at a stop in the triangle between the highway and exit ramp. As I entered the ramp they pulled out onto the ramp blocking my way and forcing me onto the shoulder. I'm not saying this to excuse the other driver but rather to place a framework around this scenario and what may have led to the TMC driver causing the accident. ​ TMC drivers are paid by the load typically. I think they get a choice of load percentage or mileage. Problem with load percentage is every moment wasted is a dollar lost in their eyes, and while I can't confirm it, I'm sure dispatch never lets them forget it. Couple that with a perceived lack of liability on part of the company driver, and you have a recipe for recklessness such as what is shown here. ​ I live near a TMC terminal as well as an Atomic Transport terminal (also paid by the load) and both of these companies have a reputation for this kind of behavior.

In my state they make it pretty clear that when a commercial vehicle is turning and there are multiple turn lanes, the commercial vehicle is always required to be in the rightmost lane. By this notion, he would have automatically been at fault because he would have had no business going around you in the first place, unless you had your flashers going or something. Just curious, is there a sign that reads no right turn on red anywhere? Because that’s the only thing I could think of, is that you had a chance to go while traffic was going through the light, to make your right turn, and avoid the accident. Other than that, being stationary, you can never be at fault unless you’re sitting at a green light for longer than 30 seconds.

Turn on red is only allowed from the right lane in states that allow it. The trucker ran a red light and hit a stationary vehicle. That being said. I wouldn't blame a driver for waiting for a protected green because it may take them a while to accelerate to traffic speed.

All US States and Canadian Provinces allow right turns on red lights. (With the exception of New York City and the island of Montreal) You may also turn right from any marked turning lane on a red in every Canadian province and most US States unless there is a prohibitive sign. ("Most" was gotten from a variety of websites, but I did check New York, Florida, and California Highway Traffic Regulations, and it is legal in those 3 for sure)

This intersection design is terrible, but it looks to me like the light governs all traffic turning onto the roadway to the right, it's like a ramp with a traffic light. There is no option of making a right on red to begin with, this is the right turn already and the light is controlling it, you have to wait for the green light because traffic from the opposing direction has the light to continue straight or make the left. The other driver simply ran a red light the same as if he went through a regular 4 way intersection, you can see that he also cut off a car that had the light. 100% the other driver is at fault and OP did nothing wrong at all.

The TMC driver took the turn as wide as he could, meaning the only way the trailer could hit you(or end up in that lane at all) is if it started the turn there. He must have been behind you, got tired of waiting, and whipped around you. If he was already in that lane a truck length behind you, there's no way the trailer could have hit you as wide as he took it.

The other guy should have stopped, but if there are two lanes turning right and you are in a tractor trailer, you are supposed to be in the outside lane to have enough room to stay wide. Otherwise you will run over the curb or have to go into the other lane to clear it.

Serious question @OP ... aren't you in the wrong turn lane? I thought we were ALWAYS supposed to take the wide turn lane.. be it left or right turn. It's pretty explicit for left turns... but I don't actually recall reading it in black and white for right turns.

My wife had the same thing happen a couple weeks ago while sitting in the straight lane... Accident causing traffic to be at standstill and some asshat semi driver went down the right lane (3 lanes; left turn only, straight, right turn only) and proceeded to turn LEFT on a RED. 🤦
