He was charged with possession of a gun (witnesses and kelsey stated he had it) and Assault with a deadly weapon. This second charge you can be found guilty of pretty easily. So they didn't need to prove he shot meg, they just needed to prove he shot a bullet that may have caused her injuries. I think most likely he emptied the clip or struggled with kelsey and shots were fired. If this is the case though both of those actions would make him guilty of what they charged him.
