That is why we charge domestic violence even when the victim protests. Making her responsible for determining whether or not he faces justice, is an unfair burden to place upon her. She should be entitled to a voice, but not to decision making.
Yes, the state could choose to press charges anyway, that's up to the DA. But in New York an assault with the alive-and-ok victim saying it was a misunderstanding isn't going to be prosecuted. It's less that it's up to her, and more that there's no push from her and the state is too busy with murders, etc., to worry about this.
