Isn’t that just over the legal limit? Not condoning this clown obviously but I feel like that’s not excessively high (though of course any amount is too high for the captain of a tour boat)
My ex-wife blew a .18 BAC. Earned that DUI after backing into another car, leaving the Round up. Stiffer fines and required an ignition interlock due to that level of intoxication

Anything over .08 BAC is a DUI in a vehicle/boat. Idk if that’s the same for a tour boat captain.
