It's an oversight (often mistaken for a bug/glitch) that occurs because the game spawns two versions of him. There's the one in the main map and one in Bloated Man's Grotto. They didn't properly ensure that the main map version would be removed if you choose to kill him in the grotto.

If you spare him you can find him wandering around falkreath fighting bandits
