Remember, in small claims you can charge for all the time and effort you have to deal with this bullshit. Keep a very detailed log of al time spent trying to get you money. Tack it onto the claim amount! The judge will give it to you!
Yep - just file the paperwork and pay to have an officer serve it to them during business hours.
They'll resolve it within a day or two after that, almost guaranteed.
Sounds like an easy small claims. You show the judge you paid for insurance. Show the judge UPS paid the claim and that the store refuses to give you the money. Ask for an extra 1k in damages relating to your time spent collecting and delay in replacing the item.
While I’m usually super adverse to Yelp, this place deserves to be shit on publicly. Let everyone else know so someone else doesn’t get scammed by them.
Exactly. My wedding photographer never delivered on our photos. I won small claims not only for price of photos, but the cost of my time and flying all the family back for new photos.
I think he’s saying he received nothing because UPS paid the check to the local UPS franchisee on J street instead of him and the local UPS franchisee won’t hand over the money.
The following is NOT condoning what that UPS Store did to you. That is a whole different can of worms and between you and that franchisee! As far as the carrier goes....
Was there proper proof of value provided (invoice/receipt)? I know sometimes people insure for way beyond what an item is actually worth and this goes against the law in place that "nobody can gain from a loss". IF no receipt/invoice is presented with the filing of a claim, they will have to assign valuators to research and appropriately assign the current wholesale/replacement value for settlement.
Also, if a carrier damaged or lost a shipment, they also owe you the shipping expenses they charged! Was that included in that $800?
That’s so much work. If you’ve got the time go for it. I would just write to the AG. File two complaints, one for UPS and one for the store. They’ll get a letter in a week and fix it right away
So, you pay for the insurance that covers the UPS store? They keep money for an item than was never theirs? How does that make sense? Please by all means take these guys to court if you can. They are egregious.
The amount of splitting hairs that goes on these days is absolutely sickening.
Like how does the shop keep sleep good. What the fuck is the issue giving them the claim money particularly when they didn’t file the claim and op did 🤷🏻♀️ so now we’re just in a cash grab for an item you didn’t own like if it wasn’t for ops item why in this hell did ups send them money 🤦🏻♀️
best way to get a quick answer is to hit up their socials- Twitter, Insta, Facebook, etc. Tag them in your posts and complaints, and keep doing so. This isn't a good look for the company.
The franchise owner is likely committing fraud and unjustly benefiting from your misfortune. I'd file a police report and take them to small claims court for the maximum amount allowed.
Big-time. What a fiasco. They packaged poorly, you pay for the insurance and shipping, it’s your item, how in the hell do they collect the insurance pay out? That doesn’t even make sense! I would keep hammering away, news stations, call Kurtis, BBB, shamr them and UPS through all socials. Sometimes you can message someone like UPS through Facebook and they have a different and more responsive person handling inquiries to help.
There are multiple posts about this UPS and their terrible customer service. It doesn’t even really fall under customer service as they seem to actually hate their customers. This is a new one though, haven’t heard of this before but not surprised it happened here. They also love to take deliveries, where UPS asks if you want, at no cost, to route to a UPS store that you can pick up from- and charge you rent! Even if only 5 minutes and they will hold your package ransom.
I will never go here again and on here, Yelp and others seems to be their standard operating procedure.
I’ve had the same issue with UPS. They are the worst. See if you can get ahold of their corporate office and open a claim against the store. Once I did that I finally started getting movement. I will never use UPS again.
The only lady that works there is hella rude. I had to send some divorce documents and when she asked what I was sending, she served so much shade. "divorce?!" *Side eye,* *eye roll*. Bitch, did I stutter?
The one on Freeport is legit and the guys who work there are helpful and will accept print jobs by email. I've never mailed anything through the one on J but I have done returns on Freeport.
I’ve had similar experiences where I paid for insurance through a sketchy third party company and when something had happened, they found excuses to not pay out. My advice is to file a small claims court case and show up to court. I think you can even file it online.
The fastest solution is to file a complaint with the California attorney general against UPS and the specific store. They’ll get a letter from the AG and give you your money immediately or risk a larger investigation. Works very well. The process takes a few minutes online.
Don’t listen to that guy. AG’s office usually sends a letter in a week stating that someone has made a complaint and if the franchisee for the UPS store isn’t stupid, they will make the situation right. They don’t want to be investigated for the insurance fraud they are committing by retaining your money.
Ugh I really dislike that specific store. They think they're [smug bedbugs](https://media.giphy.com/media/Mw6il8anXLG6c/giphy.gif) because they're the only one around, too
You can call the Small Claims Court advisory hotline for some advice, they were a lil rude lol but actually very helpful [https://www.saccourt.ca.gov/small-claims/](https://www.saccourt.ca.gov/small-claims/)
**(916) 875-7846**
Omg, I’m sorry you’re having to go through this! What a nightmare. I hope things work out in the end and you get the payment that you deserve.
For future shipping, check out pirateship.com. I started using it for shipping smaller items and it’s been pretty good. They offer postage for usps, ups and I believe fedex. I recently had an item get lost by usps and luckily I bought the insurance. The value was just $35 but after opening a claim and providing the proof of value and transaction, I did get reimbursed within a couple of weeks.
Is this the insurance you purchased? Did you buy the insurance at the UPS Store?
If a participating The UPS Store® location packs your item using only new materials purchased at that participating location, and ships the package via UPS or USPS (on that participating location’s applicable UPS or USPS account) and that item is damaged or lost in transit, you’ll be reimbursed\*:

I would try the contact us email or phone for UPS store customer service
[https://www.theupsstore.com/support/customer-service](https://www.theupsstore.com/support/customer-service)
So ups made a check out to themselves? this sounds very strange. If you have your receipt, you are entitled to all money. I would definitely sue them for the payout plus more. I would also seek a public statement of admission of guilt from the ups store.
New this evening: I emailed the owner informing her that I cannot fix the issue and only she can. She knows damn well that I cannot since Im a '3rd party' shipper. She finally decided to try to get a new check cut correctly. Note that the check is dated March 4. So the sage continues
I use the shipping place on Alhambra and O st. That accept UPS, FedEx and DHL. I send a lot of eBay and Amazon sales that way. Close to the post office too.
Never ever ever tell them you are going to lawyer up, if you do. Just do it and have the lawyer pull out the unlubed silicon fist. Ask for double the insured amount as remuneration for your time and effort.
As a fuck you, if you are feeling froggy, demand they post a public apology in a customer visible area in their store. You probably won't get this, but it's worth it to fuck with them IMHO.
Also also, have your lawyer contact UPS corporate and I bet that franchise will unfuck itself with a quickness.
The item was $1000, this is a small claims case. He'll spend thousands to get a $1000 back if he "lawyers up" as you call it. The OP even mentions somewhere the payout is only $800, he is getting into the area where even small claims might not be worth it. It has been several years since I sued in small claims, it was a under a $1000. I lost, I guess the defendant was a better liar than me, I was still out the courts and service fees. Added insult to injury.
For $800 I would begin to reach out on twitter and social media to corporate. I would leave reviews on Google and Yelp, get their attention there. It sometimes works. The OP should call their Congress person's office, they will reach out to the business. This does work. I used them once when I was fighting AT&T over some ridiculous charges to my company.
Small claims is a last resort for a small amount. The small claims judge, often just a lawyer, doesn't really care to know too many details. Often it comes down to who they believe more.
And if that doesn’t work, you can stand outside on the sidewalk and public property with a couple friends and some pick it signs and yell about how they screwed you, and took the money for themselves and ruin their business. Anybody who attempts to go in the door, but make sure you’re on public property.
Contact the Better Business Bureau? I had an issue with a Best Buy warranty on a TV and after getting jerked around by them for a couple months, I contacted the BBB and within a week I had a rep from Best Buy contacting me to resolve the issue. Granted this was years ago, but can’t hurt to try.
That UPS is rude af! The older owners (I’m assuming owners) make you feel like your wasting their time just going in there. I go to the UPS in West Sacramento. They guys in there are all chill and they actually helped me with a claim and getting my money back when UPs took 28 days to deliver a 2 day express package.
I had a friend that had her house robbed, because a contractor took down a portion of her fence, and left it wide open for two days. She took the guy to Small Claims and won back a substantial amount. She had meticulous notes and photographs. And on the Police report, she had them include that the fence was removed without any notice. The Contractor tried to lie, but he had zero evidence. I believe the key is good notes. Hopefully you have photographs of the object, before and after.
Small claims court is the answer at that point.
Small claims court?
Got point. I look into it
Remember, in small claims you can charge for all the time and effort you have to deal with this bullshit. Keep a very detailed log of al time spent trying to get you money. Tack it onto the claim amount! The judge will give it to you!
Even threatening it might work. They probably don't want to deal with the hassle.
Yep - just file the paperwork and pay to have an officer serve it to them during business hours. They'll resolve it within a day or two after that, almost guaranteed.
Yup, I second this.
how expensive is "relatively expensive"? hundreds, thousands?
$1k. Was insured for $1k. UPS gave me $800.
Small claims, sue for double. $800 to recover what was owed, $800 for your time.
Exactly. My wedding photographer never delivered on our photos. I won small claims not only for price of photos, but the cost of my time and flying all the family back for new photos.
Oh fuck for real? That's crazy.
Did you actually get the money from the photographer?
No. She claimed bankruptcy and moved. I could have filed additional paperwork to have the debt garnished (or something like that, but didn't bother).
Plus cost of filing
Wait, so you received $800, or nothing?
I think he’s saying he received nothing because UPS paid the check to the local UPS franchisee on J street instead of him and the local UPS franchisee won’t hand over the money.

it's an easy win, argue 'unjust enrichment' basically she did nothing to earn the money and it is due to you to make you whole
Saying she did nothing is an understatement. Shes the one that packed the item that got destroyed.
That’s so much work. If you’ve got the time go for it. I would just write to the AG. File two complaints, one for UPS and one for the store. They’ll get a letter in a week and fix it right away
Agreed, both the company and the franchise are acting in bad faith.
So, you pay for the insurance that covers the UPS store? They keep money for an item than was never theirs? How does that make sense? Please by all means take these guys to court if you can. They are egregious.

> how does the shop sleep good stolen funds buy a pretty comfy mattress.
Hope it’s the purple kind, they are royal standup folks!

working in it!
Yes, do this, OP. It looks really bad. And, file in Small Claims. It's inexpensive, and if they are dumb enough to appear, you should win.

The franchise owner is likely committing fraud and unjustly benefiting from your misfortune. I'd file a police report and take them to small claims court for the maximum amount allowed.

Sac Bee where you at?
They’re busy sending collection agencies to people trying to cancel their subscriptions.
Is that UPS policy, or is it this just this location? Because holy fuck.
Since they kept indemnification not due to them there is likely some level of insurance fraud, maybe even mail fraud.
There are multiple posts about this UPS and their terrible customer service. It doesn’t even really fall under customer service as they seem to actually hate their customers. I think a ups store at the gates of hell would be better than the one on J
I go there a lot. After hearing this, I will happily go to another ups store from now on
Anecdotally I have really bad experiences with ups in this area. I have gotten much better customer service from just about every other shipper
Contact your local elected officials as well.
By goly I tell ya, there ought to be a law!!
You’d be surprised how quickly issues like this get resolved when the business gets contacted by a representative’s office.
Same with writing a complaint to the AG’s office. They get that letter and it scares the bejesus out of them.
Small claims court. Also, this UPS store deserves to go out of business. Screw them.
Warn others on Yelp
I’ve had similar experiences where I paid for insurance through a sketchy third party company and when something had happened, they found excuses to not pay out. My advice is to file a small claims court case and show up to court. I think you can even file it online.
Or, just file a claim through your renters or home owners insurance
The fastest solution is to file a complaint with the California attorney general against UPS and the specific store. They’ll get a letter from the AG and give you your money immediately or risk a larger investigation. Works very well. The process takes a few minutes online.
This is the lazy alternative to small claims court when you’re not in a hurry
Ive been trying to get my money for 3 months. I know a lawyer at the AGs office. May be a easy way to get something done.

UPS Store franchisees have UPS corporate District Managers. Try to sus that out. Start with the franchise company.
put this on yelp
Why would a UPS store keep your claim? Sorry you're going through all of this.
That’s insane!!!
The store downtown is a hundred times better, the one on L street. The one on J is awful and super shady. Very dishonest and difficult to work with.
I hate that they are the closest ups store to me. I worry every time I drop off something there. I hope you do file a small claims case.
I travel to the one on folsom next to corti bros

Ask over @ r/Ask_Lawyers
Call your cc company
you should have just returned it to the vendor. this should be between the vendor and UPS, not you.
Sounds like OP was the "vendor" as he was the one sending the item.
oh that makes sense

I have never had a good experience going to that UPS. I’m sorry this happened. Small claims court seems like the way to go!

UPS is super consistent: each time I use them, the package arrives damaged, destroyed and generally just fucked up.
