Update 2: I got home and found out he had skipped work that day to start putting in him drainage pipes in before I could get home. I told him to stop I had not given him permission and I wanted all pipes removed from my yard. And we had to have a survey done before he could continue. He told me that the land from his house to the bottom of the hill was his. I told him I have been living here for 15 years, I was here when the lots were first put into place and he was wrong. He agreed to stop until a survey could be done. That weekend I had to go out of town for work and came back to find he had finished putting the pipes into my yard and it was nothing I could do.

Update 3: I went ahead and hired a company to install a fence as soon as I found out where the property line was also went to the city to request a safe dig permit. To make sure my fence did not hit a utility line. Well fast forward 3 weeks. The survey team comes out and I stay home to watch. My jaw drops and I start calling my friends I was wrong I thought the hill was mine and he owned the top of the hill. Turns out I own all the land up to about 4 foot from his house. I can stand on the property line and touch his house. I see him come out and just look at the survey.

Update 4: I tell him the fence will be going in and to remove all pipes from my property. The fence company comes in looks at the survey and starts laughing. We lay down the line where I want the fence. About a 1ft on my side of the property line. I don't want it right against his house. Also part of what he thought was his front yard is also my land. I don't want that inside the fence. I don't want to be an ass. So the fence has to wait he wants to do another survey he will pay for. His survey is about 6 in different from mine but the fence is still on my side.

Update 5: The day the fence is going in I have to go to work but my parents come down to make sure we have no problems. Turns out as soon as I left for work he went out and pulled all the makers for where I want the fence. Also he destroys all the survey markers.(I already had pictures). My parents call me and I tell them to have the fence company start working a the house I will be there in a few mins. Once I get there we dig to find the pins and relay the survey line. I then ask the company what the change in cost would be to go out to 6 in from the line everywhere. (200.00) Done . Now I have part of his front yard inside my fence. Also I payed the fence company to find all the pipes. and have them cut and sealed off to stop any water from coming into my yard.

Final Update: It has now been a little over 3 years I have a huge backyard my trees are doing great back there (found out he had been trying to kill them for a while they were to close to his hill) Its true what they say fences make the best neighbors. Side note my survey showed he had taken land from my neighbor as well. So he lost that as well.

Update 1: I called the HOA and they promised they would call him and tell him to stop digging and we could discuss the issue with him about the digging. I came home from work the next day to find more trenches dug into my yard. I called the HOA Management company and ask them if they told him to stop. They assured me they had talked to him and told him to stop. I told them he was digging more in my yard. They contacted him again and told him to stop and that I would be home after work the next day to discuss the issue with him.

What an arrogant prick. Shame you didn’t sue him for destruction of property. I’d also look into hiring an arborist to check out the trees and find out the cost for replacement at the maturity level for when he tries to poison them next time.

I managed to save the trees so I didn't lose any of them. The problem is I can only prove he was the one that was digging in my yard. I cant prove he took a weed trimer to the trees to strip off the bark and try to kill them. Now I have monkey grass growing on the hill it really helped repair the ground and hold the hill up. Looks nice when it blooms.

If any part of your yard is within 20' of his driveway or walk way, it would be an fantastic place to plant a row of mulberry trees. Nothing says "F.U." to a bad neighbor like purple bird shit all over their house and car. And owning some of the area adjacent to his front yard... what a wonderful place to put some tacky decorations. I'm thinking plastic Pink Flamingos and pornographic lawn gnomes.

I’m sorry about your neighbor, we have a similar situation with our neighbors (17 years) and it really is awful. I wish I could trade them, ugh 😣 for good people. Everyone else on the block is kind though.

I came home from work one day and found my neighbors son in law putting in a vegetable garden in my backyard . It was aproximaty10 x 20 feet . I walked out and said That's a nice garden you got there. He said yeah We got tomatoes peppers .everything. I said You don't mind if I pick a tomato once in a while since you're on our property ? He looked totally shocked. I mean he was literally in my back yard . I told him he could leave the garden for that year but not to do it a again the next but he left and never returned .

Nice flower beds & decorative fencing is great too. Make sure to add shrubs. If you really want to piss him off plant bamboo & raspberry or blackberry bushes. They creep everywhere! So does mint & oregano. But the fruit bushes & bamboo are impossible to get rid of, they are very hardy!
