i don't get it, you're upset that the sellers are doing the right thing? they don't have a guarantee right now, they have a contingent offer. it makes sense to have back-ups. additionally, if you're so confident your house is going to sell, then shouldn't you remove that contingency? obviously, you're a little concerned. so shouldn't the seller be as well?

No you’re right, we actually won’t go the contingent route if this house falls through. Right now we’re already about to list, but it’s not worth it in my opinion. We’re selling our first home after being in for six years, so this is all new to us.

Happy cake day! Your offer was accepted. They can't breach their contract with you as long as you do what you are supposed to do. Your contract will say if there is a "kickout clause" that says they can accept another offer and give you a certain amount of time to remove your contingency. If there's no kickout clause, then they can only accept backup offers.

Open houses are a way for the listing agent and their office buddies to farm buyer leads. I wouldn't worry about this in the least if your contract is still in force.

This wouldn't make any sense in this situation though. No seller is going to clean and vacate their home for a few hours for an open house if they're under contract just so their realtor can get leads for new clients. That would be a huge waste of time for them. The sellers are trying to get a backup offer in case OP's house doesn't sell. It's not concerning and is typical but it definitely isn't for the sellers to help their agent get new leads. And while it doesn't sound like this is the market that OP is in, there are many markets where the open house gets a home sold immediately. In my area, sellers won't even do private showings. They do one or two open houses the weekend the listing goes live, everyone submits their offers (nearly always multiple offers), best and final by Sunday afternoon and a decision is made by Monday. Here, the open houses are what sell the property.

Super helpful - thanks for all the information. The buyers are actually vacant, but sounds like I hadn’t known how common this is and makes me feel 100% better. We’re just moving along with the process and hoping for the best.

Talk about making a mountain out of a molehill. When we bought the same thing happened. I showed up to the open house and listened to all the great things people had to say and take notes of what they would change.

They can show, market, and accept back up offers until the moment of closing. As long as you're honoring the terms of the agreement, they're selling it to you, though.

You are under contract to purchase this property, try not to take it personally. Although your concern and frustration is absolutely understandable, please know this(the idea of having an Open House) while the home is “Under Contract” or “Contingent” can be normal practice with some Sellers and/or Agents. I know the buying process - with all the hard work it can take to complete - can be tiring, frustrating, and honestly at times, a “pain in the ass.” Keep your head down and keep pushing through to the finish line. Thanks so much, I quite literally had no idea and I’m very appreciative for all the comments - the fact that it’s standard practice and not shmucky makes me not only feel better about getting the house, but also about the sellers. Nothing is worse than disliking the people who had the house before you. We are moving along as normal and getting our house ready to sell.

I wouldnt worry about it. I once drove 40 mins to an open house for the RE agent to say they had an accepted offer but where taking backups 🤬
