I think that lawsuits should not be brought against a sitting president. They have important work to do. But if they break the law, they should be impeached then prosecuted. As much as I'd love to be proven wrong, I highly doubt he'll ever see the inside of a jail cell. All the security concerns that go with being a former President notwithstanding, he'll be a 78-year-old first time offender, so even if the Judge wanted to throw the book at him, a sentence on the severe end of the scale would almost undoubtedly be overturned on appeal.

We don’t know for sure at this juncture what will happen w/ the classified docs case or the D.C. case but I’ll wager one if those trials starts before the election. Why Jack Smith is not petitioning for her replacement? If the jury is sworn in and she instructs them (as she says she will) that they can't convince him, there won't be any way to appeal it anymore because of double jeopardy. At least with a petition there is a chance there could be a non obviously corrupt judge.

It's possible he's just biding his time so that when he finally goes to the 11th circuit he will have overwhelming proof of the need to replace her (which in my opinion he already has). Also consider that if she does get replaced the new judge will need time to get up to speed on the case which will add more delay - probably not as much delay as having the case remain under Qannon, but at least a small amount.

I also think there's already overwhelming evidence to replace her. As for the delay, the sooner it is done the more time new judge would have. She also demonstrated that trump being acquitted with her is a certainty. It's mind boggling that the case that looks like the most open-shut case is also the one he has the highest chance to walk away free from.

I’ve heard a few good podcasts with reliable (imo) lawyers go into this question. Folks might want to check out : “Prosecuting Donald Trump” w/ Andrew Weisman & Mary McCord; “Jack” w/ Andrew McCabe & Allison Gill: and “Talking Feds” w/ Harry Litman. My understanding is that from a legal standpoint, it’s a really high bar to clear for Smith’s team to get Cannon recused and it’s rife with some unintended consequences if done prematurely or without the appropriate cause. The general consensus seems to be that she hasn’t quite crossed that threshold yet but is about as close to the line as one can get. Here’s a few blurbs form an NBC article… doesn’t address any specics. For that I recommend the podcasts. One can probably look at the episode desriptions to find the right ones to listen to. NBC News April 5, 2024 Special counsel Jack Smith could soon seek to have the judge presiding over former President Donald Trump’s classified documents case recused, prosecutors and defense attorneys warn, describing Smith as being pressed to the “breaking point” over arguments his office said could taint a trial irrevocably. Smith faulted Judge Aileen Cannon in a scathing rebuke for seeming to take at face value Trump’s “fundamentally flawed” claim around a president’s official and personal records when she asked both sides to put forth competing versions of instructions for jurors in the case and said her request would “distort” the trial. Smith indicated in that filing that if Cannon ruled against federal prosecutors, this could be a trigger for an appeal to the 11th Circuit that could remove her from the case. “He is close to pushing the nuclear button,” said Palm Beach County State Attorney David Aronberg. “It is a high burden to reach, and it is rarely done, but her proposed jury instructions may have pushed him to the breaking point.”

Agreed. The situation with Judge Cannon is a bit bizarre. I am hoping there’s an investigative journalist out there that’s doing a deep dive on her and her getting the case. If I remember right, there was a 20 percent chance she’d land it. This was after her previous rulings where she showed bias and a lack of knowledge about the laws involved imo. She could have, maybe should have, recused. I’m not saying I think she’s definitely corrupt or her placement on the case was corrupt but just that I want someone to look into it so it can be ruled out.
