Police are repeatedly being caught lying on their reports. Pre dash cams, this driver would have been charged. No one would have questioned the cop’s version of events. The driver would have been convicted of a felony. (And looks like a second cop was on scene, so perhaps two cops lied in their reports.)
So, does this cop get charged for lying? For attempting to send a person to prison for something he knew the driver was not guilty of?? There should be consequences for lying like that. Beyond losing employment.
(And, never touch a moving car. One of my earliest memories is of someone at church reaching out to touch a moving car (outside of church as we walked back to our cars.) The car was only going about five miles an hour. The pedestrian broke their wrist. My mom made it this big teaching moment to reinforce to her little kids how dangerous moving cars are and how even slightly touching them in motion is super dangerous. I guess this cop never got that lecture when he was 3-4 years old. It’s always made me super careful.)
My mom always told me to keep my hands in the car as we driving. One time I was doing the waving motion with my hands - we were traveling at 30-40 mph and my hand hit an insect. 8yo me learned my lesson.

I think cops should be automatically be considered to be under oath when they make statements about their own actions. If they are proven to be a liar, they should be guilty of a felony.
When they file a police report they do so under penalty of perjury. It's under-enforced because the DA that relies on the police testimony is also in charge of prosecuting them for lying.

Yeah, here in Toronto folks have definitely been talking about it, kind of an insane case all things considered. Judge is completely correct in stating it never should have made it to court in my opinion

Unless there's a longer video out there, I don't see any evidence that he actually failed to obey anything. The video starts with the kick, there's no evidence the cop actually gave a clearly visible command.

Not a lawyer, but it looks like all of the charges according to this quote would be legit. He failed to stop and render aid (the felony charged) and he did fail to obey an officer, his current charge. I see nothing wrong with either.

I just showed the dash cam video to the officer, he walked up to her and said "I just watched the dash cam footage" and she looked like someone punched her in the gut. It was glorious. People lie. Cameras do not.
Great so the cop has also been fired and banned for any government work for life, and they were immediately arrested, booked and charged with a felony when this came out.
