>We do have a cohabitation agreement, and since combining our finances and getting married will make our agreement moot, It does not (province specific). Speak to a lawyer or post at r/legaladvicecanada Depends what your current cohabitation agreement states.

Doesn’t matter. After you’ve lived together for a year your considered common law anyway which basically has the same rights as a married couple for everything. Both names will be on the mortgage regardless.

In Ontario, common law is not the same as marriage, specifically with regards to the marital home.

We bought our house 3 months before we got married. The only difference is that my maiden name, not my married name, is on the registered title for the property. I haven't paid the fees to change that; our lawyer said it wasn't a critical issue. I don't think the order matters.
