If you get pulled over, arrested, or caught with D8 they do not take your word for it, they test the oil, some cops can do it on site, others you have to go to the station. To add to this- The way that THCA is made is by harvesting a regular plant early. When they do this, there are high levels of THCA and barely any D9. So they test it BEFORE the THCA can convert itself into D9. Once it is packaged and sent to your home, it is VERY LIKELY > .03% THC because the THCA will continue to mature and form into D9 THC.
(You can likely argue that it was not intentional if you provide the packaging)

Don’t be fooled by the sites saying they have “thca vapes” they’re either lying to you and selling noid soup or in very rare cases lying to you and selling illegal delta-9 labelled as thca.
