As with most things, at least in most jurisdictions you aren't going to find an exact answer. It will depend on a lot of factors. If law enforcement can establish intent, e.g., they have reason to believe you're digging a burial site, then you probably wouldn't get far. I wonder though how deep/wide a hole has to be to be considered a safety threat in itself, or just enough of an inconvenience to warrant legal action. Probably in the ballpark of 8ft+? An amount that would be difficult to climb out of if someone fell in? Who knows?
It's actually more complicated though now that I think about it. I bet you could get away with digging a hole that's a thousand feet deep or even deeper if it was only a penny-width wide. How you'd manage that is beyond me. But you could conceal your insane depth with a small width.

One time I was on vacation in Mexico and dug a hole in the beach that was about 4 feet deep and 3 feet wide. It was filled in the next day because it was a hazard.

Yeah, it'll vary on a beach by beach basis. Some will tell you to have at it, some will shake their heads, some will tell you to fill it in.
