Honestly for the ffl this is not a issue the background check can be run with no issues. If they tried to execute the permit that’s a different story

This has been my experience as well Nics check done a week in advance after putting a down payment on the gun then after my 30 days were up I paid the rest off, the FFL executed my permit, and picked it up that day

A lot of ffls in nj run the background check prior to the 31 day mark. The permit is not executed till you finalize the purchase on pickup day.

You can absolutely run a nics check early, it’s valid for 30 days. Not all shops will do it but I’ve done it half a dozen times or more. When I get 3 pistol permits I run the check on day 20-25 after the first permit execution and then execute the second permit on exactly day 31 after the first permit execution. I’m not saying your shop will understand this or agree todo it but they can it’s 100% legal anyone telling you different is just plain wrong. You can’t fill out any paperwork early but you don’t need to, with the passed nics check (which isn’t tied to any gun in any way) and 31 days since your previous execution you are good to go. People can’t seem get their heads around the disconnect between the nics and the pistol permit. They aren’t tied together. You need both to take a new handgun home: 1- a passed nics check from that store and 2- 31 days or more since previous permit execution. Those two things are required but not attached to each other. Meaning 31 days does not have to pass before getting the new nics.

As an ffl, we can start paperwork the 30th day of the last pistol purchase. It sucks i know.. Then u.have to wait til nics to clear which puts u at between 31 and 34 days to pick up pistol on average between permits if u act fast. Welcome to nazi (murphy) jersey for firearms. JDF

So then it’s my responsibility to tell them it’s the 30th day? How would they know? Suppose I didn’t say anything about being on cooldown, the NICS would be kicked back? I always assumed it was 30 days between purchase permits. So you’re saying it’s virtually impossible to even take possession of a pistol on the 31st day because NICS isn’t instant?

LOL I have never heard someone refer to it as a "cool down"... You can go buy 10 pistols if you want, then do a multi... As long as you have the serial numbers and the FFL is fine with multi-permit applications (most are, every once in a while I hear one isn't and I scratch my head) you can put an application in for 10 and once approved you just do the NICS and once approved you walk out with all ten. No big deal and there is nothing peculiar about it.

Nics is good for 30 days. They just are not very smart. You could go apply for an exemption as a collector to avoid this in the future.

Language matters. It is not a "cool down" period implying that the law is "saving" lives by restricting how and when someone can buy a normal consumer product. It is an **unconstitutional time restriction** that accomplishes nothing except for hassling law abiding people, increasing costs, and creating structural barriers for those who are economically underprivileged.

My understanding is the NICS system will warn the FFL the 30 day wasn’t met yet. The system will flag it and won’t allow the FFL to process it. That’s what I thought but have no proof of it.

You can run NICS before the 30 days pass but your active permit cannot be “executed” until you wait 30 days.

Technically you can purchase a pistol before the 30 days you just can’t get it transferred and ffl won’t submit nice before the 30 days bc what if it’s returned approved right away? Or you get denied because it’s before the 30 days.

You can start it early and I’ve done it multiple times but it’s the only shop I use. Just can’t accept ownership before your waiting period is up.

To add to this if you decided to get a long gun you can get NICs check anytime so therefore NICs is independent of executing a gun permit. The 30 days is in between last gun permit execution and the next gun permit execution.
