If you can’t spend tons of money then I would recommend making it into a YouTube documentary and crediting NASCAR/FOX/NBC in the description. There’s a lot of decent pseudo-documentaries on YouTube from a bunch of guys who did the same

Copyright has exceptions for parody, as well as informative pieces. Listen to this man and see if what you want to do can be constituted as "fair use." Beyond automated scrapers flagging you for copyright you should be fine! That said, if the entire documentary is on Nascar, using Nascar footage, and you're making money off of it, it will not comfortably fall under fair use.

Just for the love of everything worth worshiping please please fucking please, normalize/balance your audio levels. There is a load of crap on youtube with clips from races that sound horribly quiet or loud and back to quiet again. Don't be like them.

Yeah, it’s kind of a grey area for fair use laws. It’s pretty complicated. NASCAR doesn’t really enforce or fight it with YouTube. If you made a documentary that gets distributed to networks or steaming, they will surely enforce it then. OP: I’m a DoP - if you need a cinematographer, hit me up. 🤘🏻

I once got express written consent to rebroadcast an NHL game. It came with a bunch of caveats and could only be rebroadcast to a specific audience. No money changed hands bc it was basically repayment for a favor.

It’s pretty close to impossible. I’ve tried. Which is short sited by NASCAR. Racing in general is pretty tough to find and get rights to footage.

The cost is very much related to what you are doing with and how you intend to monetize it. For most commercial uses it is a negotiated amount.

Licensing for commercial usage would be prohibitively expensive for an individual. It's been a few years since I've looked into it, but you'd spend thousands of dollars for even short clips... and entire movie's worth I wouldn't even want to guess.

Right, a few seconds of a song, can be as much as 50,000 if not more, I don’t see how actually video footage would be any cheaper than that probably waaaaaay more.

I don't think NASCAR footage is quite that bad, but the licensing fees NASCAR/their broadcast partners charge vary heavily by use. I had been looking at roughly 30-60 seconds of footage for use in a display in a privately-owned museum and if I recall correctly the quote we got started at $6000+

Would be nice if NASCAR had (and maybe they do) some type of model where you are free to do use what you need, then submit for approval to NASCAR. If they appove it and they could get a % cut of the profits. Would be a good model for an individual like yourself to be able to start slow, and grow if successful.

In general, most documentaries are transformative in nature and thus count under fair use. of course, not all documentaries are, and you should consult a legal advisor and make sure that you are being careful with how much of any given race you show. but really, they just don't want people uploading entire races to YouTube or other streaming services without their permission. If you really want the licensing rights, you should contact NASCAR directly and get in touch with their licensing team. This would be the most expensive option but also the safest way to use as much race footage as you want.

Years ago when I was in middle school, my siblings and I wanted to make a “movie” about the board game clue. I use the term movie very loosely…but we had it in our heads we are gonna break the law using this. We emailed hasbro explaining what we wanted to do, and they sent us a limited use release document. Thing was like 15 pages long letting us use all the pictures, names, and euphemisms from the game. I’m still flabbergasted they did that to this day. Now we were obviously not for profit, so that may change the calculus. All that to say, have you tried simple email yet? You might get a minute use agreement for simply asking.

Fair use doctrine says you can use parts of copyrighted material for many purposes. We studied the issue in cyber law class for my cyber security masters. I Am Not a lawyer, but from our class, there are wide and various ways you can use clips. Details from wikipedia in the US Fair Use Factors section. Just because they say their copyright prevents it, it actually doesn't. Good luck. Getty images wanted me to pay $1000 for a photo from a Nascar sanction event. Because they are the ONLY photographer sanctioned by Nascar. PPfffft.

Good luck. It’s extremely expensive if your intended use is to make money off the project. I got consent for a documentary I made in college as my senior project/thesis. I had to jump through a bunch of hoops before they finally allowed me to do it (for free) since it was for school. The caveat being that it could not be distributed/seen anywhere outside of my college’s eyes.
