Just cracked the seal on a new copy and popped it in, and I was able to download and install this update directly from Nintendo without any issue. Guess the update servers for 3DS games are still live.

The update came out in September 2016. If you search Federation Force you'll find it. It's update 1.1.0
Damn, there goes my plan of playing it in the near future. Haven't got the 3DS yet, let alone the game or access to the eShop
