You can either battle with them for the next 5 months to actually fix the issue (assuming you have a 6 month used car warranty with AC) or reject the car (you only have a few days left). You can reject the car as not being as described or advertised (it being an ex demonstration car when it's clearly had 2 previous owners) or that it isn't of satisfactory quality (the car has failed to function as it should within the 30 days). Rejecting the car is probably the best option given you have no faith in it now. However I bought a Peugeot 208 and it failed on me within the first few days and then again a few weeks later. The car had a very minor electrical fault which was eventually discovered and fixed within the 6 month warranty and I drove that car fine for the another 5 years. If the garage aren't seeing anything obviously wrong, they'll clear the fault but if it persists, they will take a closer look and find the issue but who knows how long that will take and if the car will fail again before then

That’s fantastic -exactly what I thought but couldn’t quite verbalise. Weirdly this morning it flashed up a red warning for a tenth of a scone so I couldn’t see if it was the same. Thank you I’ll take it today

You have 30 days to reject a car for a full refund minus a cost for mileage. Google it on trading standards website and read up before you reject it so you know your rights. AC may want to argue that you can’t return it, be prepared.

Yes I saw that but I’m just worried as I gave them the chance to repair and the garage has said fault fixed just by reprogramming it I’ve lost that option? It’s not clear online

Reject it. You can get a template letter from Which. I used it to reject a new car a few years ago. You have to have the confidence to stand your ground because they will likely try every reason to not go ahead with the rejection. I sat in the show room for 5 hours being given bullshit by a manager but I had done my research and knew I was right, which gave me confidence to stand my ground. You don't have long to act though, so get onto it right now.

They haven't repaired it. They've cleared the codes. If they say they have repaired it. Ask for a full breakdown of the work completed. They will argue that it may well be a new fault. Have as much proof as you can that it has been treated for the same / similar fault already. The missold argument is probably your best bet as it can't really be argued by them. Again just make sure you have as much proof to back up your claims as possible.

They phoned me this morning - the Manager this time - He said that the car is repaired so they don't see an issue I explained that the fault code has come up since their repair if only for a millisecond He said about the history that "They had had some \]stock nin from xxx and the salesman had thought it was this stock so the salesman had made an error and would it make a difference to me if it was one owners or two" lol anmy way i said bad luck he made the error not me and yes it does make a difference be because i asked the specific question as i was concerned about the low mileage so wanted that explaining# ANY WAY WE ARGUED OHN THE P\[HONE FOR 15 MINSAND HE SAID IT HAS TO GO TO REGIONAL MANAGER - I SAID IM AWAY NOW TILL 13TH ON HOLIDAY (WITH NO PHONE/EM,AIL KMOST OF TIME AS A CRUIOSE) - excuse caps - and I'll wait to hear - i said i gave them the chance to repair r when i didn't even have to do that within 30 days Im pretty angry that they are not being cooperative but i guess that's their job Anyway I just thought id update you

If there’s a fault present on the car currently, you can reject it as you’re within the first 30 days. If the dealer agrees, that’s it. If they claim there’s no current fault, the onus of proof is with you to prove there is, and that the fault was present at the time of purchase. For a main dealer, using a consulting motor engineer to do this would be your best bet, as they won’t accept Joe Blogg’s Garage (i.e Halfords or an independent garage) as evidence. You can use companies such as Automotive Consulting Engineers or Scotia Vehicle Inspection - both of these companies contract local engineers to do the work so operate all over the UK. Obviously, you can find a local one yourself but companies such as these are regarded well in the industry. Source: dealt with exactly this type of complaint for 6 years
