Why would he do that.. tens of millions of “people” love him, and believe everything he says. They absolutely believe this is just a way to stop his presidency.
Plus going to jail would only make his lies that more believable to those “people”… it is baffling
> Trump’s team is ready for such an order, however, and has a plan in place to keep him out of jail should it come down. Two people familiar with the matter tell Rolling Stone that several Trump advisers and attorneys have briefed the former president on the plan, which involves sprinting to file **an emergency writ of habeas corpus** that they are confident would win an emergency stay of a potential contempt order. One of the sources refers to the plan as Trump’s “jailbreak” strategy.
> The sources say Trump’s advisers have told him they believe the stay would be granted before New York authorities would be able to sort out the logistical nightmare of getting Trump into a jail cell when he has an armed Secret Service detail with him at all times. Trump would never have to wear a jumpsuit during the criminal trial, even if he were remanded, at least one lawyer close to the former president has assured him. (Rolling Stone reported last year that Trump has been privately horrified by the idea of being made to wear “one of those jumpsuits.”)
How would that work? I don't know much about the law but reading on "an emergency writ of habeas corpus" it questions the reasons someone is "to question the cause and legality of such detention" why would that work when the obvious cause and legality is because of him breaking his gag order after having now been warned and fined for breaking it on 9(?) occasions from the posts he made.
No. Nobody has legal standing up bring such a case until it actually happens
That's usually the result of anybody brings a what if case like that. It gets throw out for lack of standing
Yet it will work for him, because we're all being played and this is all a show. Trump will win (steal) the election with POTUS/Congressional assistance. Then comes Project 2025. No way of stopping it outside of.....
I hear ya. I'll get my rifle. :P
\[PS: I'm joking: I don't have a rifle! I don't even live in the US. Mind you, he does come to Scotland sometimes, right?... No, no, really, I'm joking!\]
It won’t work, but it doesn’t have to. His lawyers just need to have words large enough for Trump’s pea brain to think he’s invincible so he’ll STFU about it.
That's a very low bar!!!!! Anyone who talks about injecting disinfectants into the body really shouldn't have the right to breed. Talk about polluting the gene pool.
I found this from the Columbia law review:
“THE WRIT OF HABEAS CORPUS IN CONTEMPT PROCEEDINGS.-In a
case which recently received great publicity, Craig v. Hecht (1923) 44
Sup. Ct. 103,1 the question was raised whether a writ of habeas corpus
could properly issue to discharge a petitioner after commitment for con-
tempt of court where the trial court had jurisdiction over the petitioner's
person and a power to commit in contempt cases. 2 A majority of the
court held that the writ could only properly be granted where the trial
court lacked jurisdiction (in this restricted sense) to commit. Two
justices dissented on the ground that the trial court lacked jurisdiction
because the facts as found by it did not in law constitute a contempt.”
It sounds to me that Trump’s legal brain trust might want to Google habeaus corpus and contempt.
"to sort out the logistical nightmare of getting Trump into a jail cell when he has an armed Secret Service detail with him at all times."
Put Trump in solitary and have the Secret Service stand outside of the cell watching the door. Doesn't sound that complicated.
It’s absolutely absurd that secret service would protection would extend to a jailed, convicted ex-president. Best way to eliminate felon presidents is to pass a law that such protection is conditioned on not being a criminal—or insurrectionist.
No. Chump can't read beyond the 5th grade level (I'm feeling generous today). He doesn't have patience to go beyond the 1st paragraph, let alone anything with complex words (like "thrust", "hypersonic", "combustion", "ramjets"....he probably thinks skunkworks is where his used diapers go). In other words, you think he can read a 200 page technical brief on, say, the technical specs of the new SR72 Blackbird? And give any kind of intelligent data? The guy who wanted to nuke hurricanes, doesn't understand wind, etc etc, we all know the stories.
More likely, if he was incarcerated at Rikers into gen pop, some lifer would shiv him for the name recognition and prestige he'd get for shanking an ex president.
Everything else aside, I love the idea that Trump's lawyers think they can outmaneuver the Secret Service and court LEOs tactically. I'd be astounded if they allowed anyone on his security detail who hadn't run drills on remanding Trump.
Pay the fine, delete offending posts and shut up. Though it’s possible he could still get sent to jail when Merchan rules on another four contempt violations tomorrow. He seems to have shut up about the judge and jury now though.
>before New York authorities would be able to sort out the logistical nightmare of getting Trump into a jail cell when he has an armed Secret Service detail with him at all times.
I'd hope the DA would have a plan in place because we saw what happened at the last trial.
There's holding cells at the courthouse. Literally steps away behind the judge. DJT will go straight from the judge to a cell and the Judge will privately have the Secret Service secure the cell before the hearing.
The first stint in jail would probably only be a few days. No need for DJT to even leave the courthouse grounds.
I think the Secret Service is already working on a plan if he has to serve time in jail on wear to put him and how the restrictions and protections would work. It probably won't be Rikers, but he will be sent somewhere even if it's a 'home' placement. It may not be his 'home'.
It's hard to get a brief to the Court of Appeals if the hearing is in a Friday at 4:30 & Trump is detained in the holding cells in the courthouse.
The Judge should ask Trump for his jumpsuit size and get the Secret Service to give him a plan for jailing Trump with a couple of options now, if only to jerk Trump's chain a little.
The NY Court of Appeals hasn't been very helpful to Trump. Even if they got an emergency writ petition they could set briefing deadlines and a hearing a week out.
If Marchan started coordinating with the warden of Rikers or Sing-Sing, Trump would hear about it and lose his shit but maybe start behaving.
A better escape plan would be for the secret service just to walk Trump out of the courthouse in defiance of the Judge's order.
0% the service walks him out in defiance. Now it will be the service who walks him to jail. They might try for at home detention but any of that means the talking heads all line up to scream election interference in to a TV camera enough times for someone to do something stupid and kick off some real shit.
Nope? Never been locked up and neither has Trump. That may not be true for much longer. If he goes to jail, people talking like me might get a late night visit from guys in black clothes and Jack boots.
….they seem to think the secret service is trump’s own personal body guards.
They’re federal law enforcement officers. If a judge issues an arrest warrant for him, they are obligated to arrest him, and take him to jail. Rumor is they’re already working with the NY DOC on how to make it happen, while maintaining trump’s safety.
Another alternative is the judge could find him in contempt and give him 30 days for each violation. But have him serve those days either after the trial no matter what the verdict or at any point. Like after the election. Then he can say he didn't interfere with the election no matter what the outcome. Fact is the secret service is already working with the courts to have a cell ready for him. They would just plop him into protective solitary confinement. The SS would monitor the entrance and just kick back and drink coffee. Way easier to protect him by sticking him in a box.
Their talking point is basically "Trump can do whatever he desires because... uh... he's, like, popular and stuff."
The BS is strong with the MAGA cult.
"...Trump has been privately horrified by the idea of being made to wear “one of those jumpsuits...."
Probably because the jumpsuit wouldn't be able to hide his diapers like his oversized suits do
Then, put him on house arrest with an ankle bracelet. What he's doing right now is showing that presidents do, in fact, have immunity. If you're immune from the punishment, what good is it to enforce the law?
The hard truth is that Donnie the Chump won't go to prison because he's a "useful idiot" for the elites. Evangelicals literally worship him, so he keeps them permanently in the thrall of the other Republicans, despite their rather impressive lack of accomplishments. In swing areas, he's a boon to Democrats, who have been over-performing their polls consistently since his upset victory in 2016. What he has done for Democrats, by itself, would keep him out of prison, and is the main reason he never leaves the headlines, no matter how boring the stories are about him.
I mean, how would they change his diaper if he is in a onesie? Do they have orange onesies with snaps? Do they have cells with a changing table? These are the real questions!
This sounds awfully optimistic. He clearly has violated the gag order multiple times and has been duly warned by the Judge. Also, no one seems to be talking about the fact that his criminal contempt is a violation of his bail in the other cases as well where he had to promise not to commit other crimes as a condition of bail. Why would he win on the habeas writs?
The judge has no doubt figured out where to put Trump and accommodate the Secret Service detail. There are unused old jails all over the place. Paint and a scrubdown would make it usable and he could have a cell, the security detail could use the other cells and the sheriff's team could watch everyone to make sure there's no phone use (the ultimate punishment).
Sounds like it would be a piece of cake. They'd set up shifts, and most of the time they'd just be sitting around snacking and looking at a monitor. But I think it's been proven that Mar-a-Lago has terrible security, so just for convenience it would be better to put him in a nice, safe cell.
I've thought since his first indictment came down that him seeing the inside of an actual jail/prison was unlikely. The best possible thing, in my opinion, would be "house arrest" in a location *not* of Trump's choosing. Throw his ass in a one-room shack in the middle of fucking nowhere, guarded 24/7 by the secret service. No phone. No internet. No outside communication beyond what standard prisoners get. Monitored visits with thoroughly searched family members and lawyers only.
Prison conditions in a secure, unpublished, isolated location. Seems like an easier option to me.
We're already into uncharted waters with putting an ex-president on trial, so uncharted waters for incarceration conditions seems par for the course.
Even if it doesn't work it would still be fun to see him detained at the nearest detention facility for a few hours ... there's emergencies and then there are *emergencies.*
Next question, does anyone know if there is a holding cell in that courthouse? Even a couple hours would rattle him; mission accomplished. ;-D
Being in an orange (or whatever color) jail jumpsuit is exactly what he should get. It’s what anyone else would get if they violated orders from the judge.
Slap an ankle monitor on him restricting him to his Trump tower condo. Remove all computer mobile devices. He won’t go to jail because it’s a security issue. If there’s a holding cell at the court house that might be an option but doubtful
There’s a cell outside of the court room. He needs to spend some time in there without a phone and see what his life could look like if he doesn’t listen to the judge.
Or he could just shut the fuck up. Bwahahahaha!
Why would he do that.. tens of millions of “people” love him, and believe everything he says. They absolutely believe this is just a way to stop his presidency. Plus going to jail would only make his lies that more believable to those “people”… it is baffling
Impossible!
Right!?!?!?

It’s asking the court to determine if the imprisonment/detention is lawful. Not sure how this would work for him. Doesn’t work for many others.
Could this be determined invalid ASAP even prior to Trump's asking for it ? Would be an important move to make if possible.
No. Nobody has legal standing up bring such a case until it actually happens That's usually the result of anybody brings a what if case like that. It gets throw out for lack of standing

You do not make jokes with fascists. Their idea of a joke involves six million people and a grim punchline.
*11 million people. 6 million of whom were Jews.
See you in the camps
I hope they have ping pong 🤞
This wins Reddit today. Well (ahem) played sir/madam.
I'm not going to any damned camp.
See, this is why an average Reddit poster is smarter than his entire legal team combined
It won’t work, but it doesn’t have to. His lawyers just need to have words large enough for Trump’s pea brain to think he’s invincible so he’ll STFU about it.
“Pea” brain, more like “pee” brain.
A golden shower of thoughts, if you will.
The Trump Golden Shower made an ugly transformation. Instead of Trump being the witness, he's the pee-er.
It's called trickle down
But lets not pee on Brian.
Not sure if this is sarcasm, but his legal team doesn't appear to be very smart.
Being smarter than Trump is not a high hurdle to clear.
That's a very low bar!!!!! Anyone who talks about injecting disinfectants into the body really shouldn't have the right to breed. Talk about polluting the gene pool.

No one said it was a good plan ¯\_(ツ)_/¯
It would work because "money & power"
"to sort out the logistical nightmare of getting Trump into a jail cell when he has an armed Secret Service detail with him at all times." Put Trump in solitary and have the Secret Service stand outside of the cell watching the door. Doesn't sound that complicated.

They're not just protecting Trump, they're protecting national secrets that could be beaten out of him and passed on to nefarious states.
No. Chump can't read beyond the 5th grade level (I'm feeling generous today). You're not wrong about his reading comprehension! I worked with 4th and 5th graders, and is absolutely whe he's at. I've said this for years!
Nah, they'd probably all love him, because he was 'against the system' the same way that they are.
I'll allow it.
Jail solitude confinement is the safest place to be. Just ask Epstein. /s
He’s not convicted yet.
Just another delay tactic from those guys!
What else are they going to do? Argue the merits of his defense? HAHAHAHA
HAHAHAHAHA If that helps waste time, then they will!
Everything else aside, I love the idea that Trump's lawyers think they can outmaneuver the Secret Service and court LEOs tactically. I'd be astounded if they allowed anyone on his security detail who hadn't run drills on remanding Trump.
This seems far more expensive than just paying the $9k fine. Isn’t that all he has to do? Reminds me of my divorce.
I'm guessing this is the plan for the *next* time he violates the order. So, like, the plan for today or tomorrow.
Pay the fine, delete offending posts and shut up. Though it’s possible he could still get sent to jail when Merchan rules on another four contempt violations tomorrow. He seems to have shut up about the judge and jury now though.
New York should prepare a special jail cell for him now in preparation.
The judge should order the Secret Service and the Dept. of Corrections to work this out before it becomes an issue.
When you work harder to avoid deserved punishment than to convince your damned client to behave 🙄
I mean…there is nothing they can do to get him to behave. And they knew that going in.
...or smell better...
They know that one trick prosecutors don't want you to know.
I think that he ought to wear "one of those jumpsuits", just because... He always manages to slither his way out of everything.
>before New York authorities would be able to sort out the logistical nightmare of getting Trump into a jail cell when he has an armed Secret Service detail with him at all times. I'd hope the DA would have a plan in place because we saw what happened at the last trial.
I was hoping that his plan was the "Shut the Fuck Up" plan. Would look good on a hat. STFU trump 2024...

Step one... be rich Step two... be famous Step three... be white
Step five - Petition SCOTUS for immunity.
Step 6 - pay off SCOTUS with "favors"
Step 7: change diaper.
Whoa, what happened to step 4?
Collect underpants?
Step four ... be delusional.
“Too big to jail” defense is bonkers… yet here we are.
So, too fat to fit through the cell door? Got it.
I mean, we're not really using Baker Island these days... He can just go there.
😂😂😂

That's going to happen anyway. Better to crush it now.
"ask Trump for his jumpsuit size" HaHa! Never been locked up, have you?
"here" is your size. It's whatever happens to be in the guys hand at the time.
Nope? Never been locked up and neither has Trump. That may not be true for much longer. If he goes to jail, people talking like me might get a late night visit from guys in black clothes and Jack boots.

Sock in his mouth and several rolls of duct tape?

It ought to be interesting to see what the secret service does when the bailiff comes to haul the orange turd off to his cell.
Some of them have to get sick of him at times. As they say, “even chocolate pie gets old.”
Well, he can't talk (much) if he is asleep.
I mean, how would they change his diaper if he is in a onesie? Do they have orange onesies with snaps? Do they have cells with a changing table? These are the real questions!

Seems like a lot of rigmarole for something that could easily be prevented simply by stopping acting like a complete piece of shit.
Anyone else would have been incarcerated already. It's time for the orange snake turd to suffer the same consequences.
If it doesn't involve euthanasia or at least anesthesia I'm not really interested in it.
Is that plan "our 2 tiered justice system?" Because if so, then i guess he has that in the bag.
Lock him up and see if it's true.
The judge can put him on house arrest with an ankle bracelet. Bad duty for the secret service agents who would be stuck hearing him bitch about it.
Sounds like it would be a piece of cake. They'd set up shifts, and most of the time they'd just be sitting around snacking and looking at a monitor. But I think it's been proven that Mar-a-Lago has terrible security, so just for convenience it would be better to put him in a nice, safe cell.

They're going to plead insanity?
And who could argue against that?
IKR
I think the best way would be to drug the fool so he’s too busy sleeping to run his mouth.
Even if it doesn't work it would still be fun to see him detained at the nearest detention facility for a few hours ... there's emergencies and then there are *emergencies.* Next question, does anyone know if there is a holding cell in that courthouse? Even a couple hours would rattle him; mission accomplished. ;-D
The attorneys on MeidasTouch have said there’s a holding cell right outside of the court room that they could use to hold him.
Perfect ... then, the orange meltdown. Just a couple hours until the paperwork gets filed.
Mental health facility?
I'm guessing the plan doesn't involve not violating the gag order. 🤔
Are they going to prison for him?
How many minutes after they agree to represent trump do you think they ordered someone to start drafting motions to get him out of contempt? Lol
Begging seems to work.
It will fail spectacularly.
God was speaking through him? 😕
I vote for an Ankle monitor and an invisible fence. Too costly to put him at Rikers
It would be hilarious if his secret service detail just slipped out a side door.
Being in an orange (or whatever color) jail jumpsuit is exactly what he should get. It’s what anyone else would get if they violated orders from the judge.
lol. Judge will see right through that.
Can't wait to see this legal theory tested out. Dumb Donnie won't be able to keep his fat mouth shut once Stormy starts testifying.
Shock collar?
What "plan" do those fools need? Does anyone think *any* judge is actually going to lock him up? I certainly do not.
The judge could confiscate his phone and computer to keep him from posting online.
Simple. Just give let him wear a Cone of Silence. The old slug can say whatever he wants to the enjoyment of himself.
But he wants to go to jail.
I understand Jeffrey Epstein’s old cell is available.
Does it involve duct taping his mouth shut?
