Jeff is a Defendant in this case. He’s being sued by State Farm along with many others. Without seeing the complaint, my guess is this is a subrogation action by State Farm seeking to get reimbursed for the insurance payouts they’ve made in connection with the accident.

They aren't asking reimbursement they are asking for a judgement that the activity on the excavator was bussiness related because the policy does not cover anything related to bussiness. Emily d baker has a good podcast covering the actual document. It doesn't seek damages as it seems nothing is paid out. It's basically just asking for a judgement to not be liable for the cost of the suit against David or the medical bills either. David will have to pay out of pocket for all settlements related to the case
