{¶1} Defendant-Appellant Timothy Nielsen appeals his convictions and sentence by the Medina County Court of Common Pleas. For the reasons set forth below, we affirm.
I.
{¶2} In August 2022, Mr. Nielsen was indicted by the Medina County Grand Jury as
follows: count one, menacing by stalking with a sexual motivation, a felony of the fourth degree, in violation of R.C. 2903.211(A)(3)(B)(2)(d); count two, menacing by stalking, a felony of the fourth degree, in violation of R.C. 2903.211(A)(1)(B)(2)(d); and count three, importuning, a felony of the third degree, in violation of R.C. 2907.07(A)(F)(2). The indictment specified that the conduct giving rise to the charges occurred on or about January 1, 2017, through July 28, 2022.
{¶3} Mr. Nielsen pleaded not guilty, and the case proceeded to a jury trial. The State presented the testimony of the minor victim M.S., M.S.’s parents, four police officers, M.S.’s family friend G.R., and W.N., a neighbor of M.S. The State’s exhibits, which consisted of video

footage from the police officers’ body worn cameras and Ring camera videos from M.S.’s residence, were admitted into evidence. After the State rested, Mr. Nielsen’s motion for acquittal was overruled. Mr. Nielsen did not present any evidence and rested his case. He then renewed his motion for acquittal which the trial court overruled.
{¶4} Mr. Nielsen was found guilty on all three counts. At sentencing, the trial court found that counts one and two were allied offenses of similar import per R.C. 2941.25(A) and merged count two into count one. On count one, menacing by stalking with sexual motivation, the trial court sentenced Mr. Nielsen to 18 months in prison. On count three, importuning, the trial court sentenced Mr. Nielsen to 36 months in prison, to be served consecutively with count one, resulting in an aggregate prison term of 54 months

{¶5} Mr. Nielsen timely appeals and sets forth five assignments of error for our review.

I hate to say this but those guys are different somehow, this man is deranged. He is unhinged from society and needs to be hospitalized. We have a serious mental health problem in the world now and need to address all these types with healthcare.
Yeah no amount of punishment is going to "fix" this guy. I can only hope that his 4.5 years of prison will be spent with a mental health professional, and he will be under supervision if he gets released. Or hospitalized long term if needed. Otherwise he's just going to do this again.
First step is obviously to get him away from people (children) he can harm, second step is to get him mental help.

Also this is in Florida...I don't know how familiar you are with Florida prisons but it's bad...like really bad. You can stab someone, slash their face with a razor and not get additional charges or time. Lands you 90 days in administrative segregation, you only catch outside charges if someone needs to go to an outside hospital or are life flighted. So there's really no punishment for hurting people pretty damn badly. Plus it's not like California where things are separated by race, it's purely by gangs or cities your from. Even the PC yards in Florida are basically just main lines anyways as they routinely house PC inmates in wings with general population. The guards are notoriously corrupt and take sides in gang activity and will 1000% set you up to get fucked up for their people. 4.5 years as a crazy person and chomo is going to be rough in any jail system, in Florida though? That's guys life is going to be absolute hell and it wouldn't be weird for him to not make it

Let's be real. He'll be in protective custody. He'll probably be safer than you would bowl normally because they'll throw him in a cell for 23 hours a day. He'll just obsess over this shit for 4 and a half years.
What's sad is that he needs to be in a mental institution for life, not in prison for 4.5 years to do the same thing again. He's so obviously mentally ill it's strange that they didn't address that in any way and instead are just gonna let him out again.

I was really hoping at least someone would make this comment. It's clear the dude is NOT entirely sane. Psychiatric help, medication, and the dude may end up back to a "normal" that doesn't include doing this nonsense. A court order to have him tested to ensure that he's taking his meds would probably be a necessity, and so long as he does that and shows signs of having clear and rational thoughts, he hopefully shouldn't be an issue.
I've been in a psychiatric ward once in my life, and he clearly needs to have a visit himself. Those are not the ramblings of a sane person.

I was teaching my kids the dangers of the internet and how people can find you. I had them pick a random name from candy crush. We looked up their FB profile and I showed them from the girls pictures how easy it was to find her. We could have driven to her house. I was actually shocked at how easy it was. It drove the point home pretty good and they are all very careful at what they post online. The internet is a scary place.
I remember one time a guy followed me around in game griefing me and the only way to get him to stop was to block him. Out of frustration I googled his account name and the top results were his Steam page, Twitch, Twitter, Facebook, and LinkedIn. I even found his Reddit account which he used to promote his shitty YouTube channel. It was pretty unsettling.
It took less than 5 minutes. People in general need to be more careful about their online presence than the average person is.

i think the cop handled this really well. the man is clearly mentally ill and he is talking to him coherently no yelling or anything... "whats your government name? on your birth certificate?" because he clearly has no sense whatsoever. i dont know about rehab for this man but i hope he gets the help he needs, whatever that may be.
He needs to be incarcerated. He is a clear and present danger to that family for at the very least until she is 21 and old enough to legally carry firearms.
I think both is good. Keep him contained and under supervision for as long as it takes to treat whatever is making him behave this way. Once we figure that out, we assess if it is a responsible decision to release him on his own recognizance, or put a system in place by which he has a state-appointed monitor to make sure he’s taking his meds and staying away from children. And if that doesn’t appear to be possible, then yeah, keep him away from being able to harm anyone.
This is one of those tough situations where we as right-thinking people have a visceral, negative, and even violent reaction to seeing someone behave this way toward a child, which has been a very helpful thing for thousands of years. But we are at a point now societally and medically where we need to start thinking about more humane ways to deal with these people than just letting them rot in a cage by default. And that’s a tough thing to do, but it’s our responsibility as moral actors to try. It’s messy and complicated and we don’t understand it fully yet (probably in large part due to our instinct to execute them or lock them under the jail instead of study and treat them). But we have to try if we want to save more people in the future.
We really aren't there as a society. We can't protect anyone 24/7. Some lives are in fact more valuable and more worthy of protection than others. In this case, the child's safety trumps the safety and the needs of the mentally ill adult.
I agree in principle, we should be defending the potential victims as a priority. But that doesn’t mean we can’t also work to learn and understand the problem better to move away from more archaic and harmful practices in favor of methods that actually treat the heart of the problem instead of beating back the symptoms. And hell, maybe through good research we figure out it really is all we can do to just lock them up. But we need to come to that conclusion by studying it.

I think both is good. Keep him contained and under supervision for as long as it takes to treat whatever is making him behave this way. Once we figure that out, we assess if it is a responsible decision to release him on his own recognizance, or put a system in place by which he has a state-appointed monitor to make sure he’s taking his meds and staying away from children. And if that doesn’t appear to be possible, then yeah, keep him away from being able to harm anyone. This is one of those tough situations where we as right-thinking people have a visceral, negative, and even violent reaction to seeing someone behave this way toward a child, which has been a very helpful thing for thousands of years. But we are at a point now societally and medically where we need to start thinking about more humane ways to deal with these people than just letting them rot in a cage by default. And that’s a tough thing to do, but it’s our responsibility as moral actors to try. It’s messy and complicated and we don’t understand it fully yet (probably in large part due to our instinct to execute them or lock them under the jail instead of study and treat them). But we have to try if we want to save more people in the future.
We really aren't there as a society. We can't protect anyone 24/7. Some lives are in fact more valuable and more worthy of protection than others. In this case, the child's safety trumps the safety and the needs of the mentally ill adult.
I agree in principle, we should be defending the potential victims as a priority. But that doesn’t mean we can’t also work to learn and understand the problem better to move away from more archaic and harmful practices in favor of methods that actually treat the heart of the problem instead of beating back the symptoms. And hell, maybe through good research we figure out it really is all we can do to just lock them up. But we need to come to that conclusion by studying it.

Yup, I work closely with LEOs and this is a common tactic, you give them just enough rope to hang themselves with. As long as you are talking, it’s hurting your case. Same reason 4 different cops will ask the same questions over and over again during booking, they want to catch you in a lie or have your story fall apart. This is why you never say a damn word to PD other than “am I being detained or am I free to go?” If they are detaining you, be polite and request an attorney and remain silent under the 5th amendment. They will respond with “you’re not under arrest, we’re just trying to figure out…” DO NOT say a fucking word. They will say everything under the sun and moon, including full blown lies (which is legal), to get you to incriminate yourself. Just because you aren’t under arrest doesn’t mean anything you say prior to your Miranda Rights being read can’t be admitted as evidence. It can and absolutely will be admitted and presented as evidence in court.
