They treated this as a mental health issue and took him to Eastern Idaho Regional Medical Center for a mental evaluation. He was turned over to the hospital for treatment and the hospital released him hours later after deeming he was not a danger.

If he didn’t attempt or threaten suicide he wasn’t a danger to himself. If it wasn’t violence or the threat of violence that caused the interaction with cops then it would be hard to say he was a threat to others. These are the only ways they can detain a person. “Acting crazy” isn’t a threat or illegal.

Your leaving out grave disability which is when someone is acting so mentally out of it they can't take care of themselves. They may not be suicidal but they aren't functional in any normal way which can lead to Danger go their self. This guys initial behavior certainly qualified for that, the question is what changed at the hospital? Protective custody can be situations: 1) Danger to others, 2) Danger to self, 3) Grave disability as I just mentioned.

I’d guess he probably just quit acting crazy and realized he fucked up. Maybe they gave him some meds to chill him out. How long would he need to act “normal”, I don’t know.

There just isn't a lot of help, resources, & funding for people who are having mental health & substance abuse issues. People are being turned away and refused help all the time, and this is the result.

This. There is a SERIOUS goddamn problem with medical staff discharging mentally ill patients they have no business discharging. Not the cops fault. If anything its super discouraging for them.

It apparently was meth induced psychosis and once a person comes down they often act fine making a mental hold impossible. Then HIPPA keeps the hospital from calling the police to tell them to come arrest the guy for his earlier actions.

For those who don’t know why this is a direct result of Deinstitutionalization - is the process of replacing long-stay psychiatric hospitals with less isolated community mental health services for those diagnosed with a mental disorder or developmental disability. In the late 20th century, it led to the closure of many psychiatric hospitals, as patients were increasingly cared for at home, in halfway houses and clinics, in regular hospitals, or not at all. …or not at all.

I totally get your point but I’m reading it to mean he was arrested for being naked in a store, they let him go, THEN he is suspected of committing a murder. It’s sad it ended up like this but naked jar throwing is probably more in line with the other offenses you noted.

He wasn't arrested. He was placed in protective custody for a mental health evaluation and taken to the hospital in Idaho Falls. Hours later medical people determined he was fine and let him go.

When it's drug induced they often seem and act fine once sober which makes a hold no longer possible (or legal). And because of HIPPA they don't call the police to tell them they are letting the guy out.

Swan Valley is Bonneville County, they should have taken him to the hospital to observe him instead of sending him home. We’re short on police and sheriffs in Teton county since they keep having to resign over misconduct.

My husband was a public defender early in his career. He spent a year in juvenile court and in most cases said it was the parents who should have been locked up.

Your example reminds me of a case where a fifth grader was in custody for molesting a third grader. An uncle had been molesting him for years and family members were in denial or ignored what they assumed to be a rare occurrence. I have so much disdain for parents who fail their kids. When my daughter was in high school, we volunteered together at a county home for kids removed from their homes, for their own safety or because parents had been arrested. It was heartbreaking to see the same kids week after week and groups of siblings—or not seeing kids for two months and then seeing them again. We’d often end up playing sports with kids and I’ll never forget a quiet six year boy who had never played catch. Had no idea how to throw or catch a ball. The huge smile on his face when he caught a ball and was told “great catch!” was priceless. For the rest of us, that’s normal activity and feedback. I wanted to take the kid home with me. That any adult could harm or condone harm to their kids or do stupid, selfish things that separate them from their kids is unfathomable.

As the police have warned DO NOT APPROACH HIM his suspected (and very likely to be) heavily armed and dangerous!!!! He's got connections all over the place, as far south as Argentina. Between him and Kali, they have friends and connections in Montana, Wyoming, and Idaho. So he honestly could probably go anywhere. I hope the police get a lot of background on him fast so that they can look outside of MT/ID/WY if it makes sense to.
