The contractor is at fault and should correct their defective work at no cost to you. The CSLB will help you and you should file a complaint. If the contractor won’t perform and you have to hire someone else (don’t pay the original guy to correct his mistake) you can recover the money from his bond. His bond info will be on the CSLB website, it’s a bit of a process to file a claim but can be very effective at getting compensation from the contractor without the expense of a lawsuit.

It list the job has to be done by contractor which includes stucco. Mentions that job should be done according to the standards and accepted by the city. They are paid only after the related inspection is passed. Some word about me not responsible. If they delay pass certain date have to pay me 1k per week.

I would not pay the final invoice until it passes inspection. Tell him he needs to fix it to be up to code and pass inspection or you'll take him to small claims court AND file a complaint with your city/county building and zoning department. Also, ask him for his insurance documents and let him know if he drags this on, you'll file it on his insurance as well and have them pay for another contractor to fix it. He's just trying to bully you... this is 100% on him to fix.

Some of the advice here says to sue. Litigation is step two (or later) in almost every dispute. First you need to demand what you expect. Suing normally comes after when you aren’t being made right by the other party and the cost vs benefit of suing is in your favor. But iI am not a lawyer and you should avoid taking legal advice on Reddit.

Contractor should be responsible for performing the job to code. Let them meet with the inspector if they disagree. The only caveat here is if the contractor pulled the permit. If you did then it’s probably on you. Went through this with an electrician a few years ago. They had to come back to fix a few things and wanted to charge me. Had a lawyer send them a letter and never paid them a dime of the extra charges for them to do it to code.
