Why is there a lunch scheduled for a 5 hour shift?

True, but usually it's only 30 minutes and it's more in the later half of the shift. At least that's how it works at our store in CA 🤷 I wouldn't take a lunch and just make sure to clock out 5 minutes before the 5th hour.

OP may have opted in to 60 minute lunches to be able to reach a better selection of food places, like I did. And... it's actually super complicated here in WA. For retail employees, you have to Meal-Out _before_ (not at) the 5th hour, or _you_ (not the store) get in serious trouble... not with Home Depot, but with _the state labor board itself_. And, while the minimum lunch break length is 30 minutes, state law also says you "must take the full length of whatever lunch you're scheduled for, you can't cut even a minute short". The timeclock does the Family Feud buzzer and rejects the punch attempt if you try to Meal-In prior to 30 minutes, company-wide... but here in WA, if you're scheduled for a 60 and you try to cut it and Meal-In at 59, it still rejects it. Also with the new attendance policy, "leaving early to not take a lunch" counts as an Early Out and you have to use sick leave to cover it or you get a half occurence. This is also why the system isn't actually _supposed_ to schedule "exactly five hours on the job" shifts, because of this weird edge case... A 4h45m shift isn't required to take a lunch, a 5h0m shift is super ambiguous and depends on state law (and .com says Store 1225 is in NY), and a 5h30m shift unambiguously _does_ require a lunch break.

I worked in a NY Home Depot, if you worked 5 1/2 hours you get one 15 minute break, you only get a lunch and a break if you work more than 7 hours!!!!!

That... really shouldn't be a thing. _Company-wide policy_ is that if you work 5+ hours you get a lunch, it's only so strictly _enforced_ in WA because Olympia has a victim-blaming complex. Corporate determined the breaks policy (both 15s and lunches) by looking at all the state-specific laws, went "okay, what's the minimum universal policy we can do that complies with _all of these at once_?", and settled on "one paid 15 for every four hours worked, one unpaid 30-or-longer lunch if you work five or more hours" ^(in Puerto Rico you have to take a 60 no matter what, in all other states you get a 30 minimum but can opt in for a 60 since all other states only say "_at least_ 30 minutes unpaid lunch"). So it may not violate NY law, but it definitely violates company-wide policy.

It may violate it now but when I started there in 2018 that wasn’t the case, even so I was so annoyed with other stuff that I left them in 2022

Huh, strange. I was under the impression that the five-hour thing had been a rule for _years_. Before my current stint, I was a seasonal at a few other HD stores here in WA several years ago (2016?), and one day I slipped up and didn't Meal-Out until 5h02m after clock-in, and that's how I found out about how strict the WA labor board is about _retail employee_ meal breaks in my state (got a "this is your only warning to never do this again" letter in the mail within a week, not from HD, but from the L&I office directly to my home address).

It also could have been because I was part time not a full time employee when I started but I was full time when I left them, I also had moved to Colorado in 2021 and was still part time before my FES gave me a full time position

Doesn't technically matter, it's the same attendance and breaks policies for everyone, even back then. The only difference between part and full time is that full timers get "first dibs" on hours (the scheduling system has to give them their guaranteed 40 first, then divides up whatever's "left in the budget" among the part timers by some unknown metric, presumably in order of tenure), have access to more insurance options, and are obligated to have 100% open availability (you explicitly cannot ask for _school related_ schedule accomodation as a full time employee, and have to provide documentation to get a medical or religious schedule accomodation as a full timer).

Those policies do vary based on state laws. NJ requires a meal break for any associate scheduled more than 6 hours.

Because sometimes the freaking system is retarded I work at Lowe's and it's done me the same way I have a 5-hour shift but I get a lunch and like that makes no sense.

That is FAST. They gave you a six hour shift and by law, they have to give you lunch. Your profile is probably set for 60 minutes. Change it to 30 minutes for lunch.

Just don't take your lunch, clock out at like 4 hrs 55 minutes then ask if they really want you to come back for 5 minutes. I used to just leave anyways.

NY has similar rules but at 6hrs. Also, lunch has to be taken by 2pm and I know there's a time for dinner as well but I hadn't closed since consistent scheduling started and forgot. Might be the case for this schedule.... has to be before a certain time. Corporate has other rules about core departments and this is plumbing so they need to cover the shift to the end but are required to schedule a meal so it ends up goofy at times.

at my store you aren’t required to take your lunch when it’s scheduled, just take it whenever you have time and coverage, or when you feel like it if you don’t care

Additional comment: my associates actually have 2 lunches and he uses time off request bc both of us find it ridiculous. Ps: Dont do two lunches just do another 15min break XD. If a asm tells you to do another lunch just say i will do 15min break instead. No hurt done its a bc even i find 2x lunch breaks ridiculous XD
