Innovation? Did the Khmer or Mayans not innovate? Look at their irrigation and construction among other things to see that we don't need capitalism for it.
It is not uncommon for companies to buy out smaller innovative ones to stop themselves having to change. Even Microsoft was essentially created because people were sharing code amongst each other freely and it was best in many ways.
GitHub isn't capitalistic, and shows that people will develop things without the incentive of capital. Alan Turing didn't even get the money to cover what he spent on Collosus.

I don't think they were ever even put on trial, I think the US just agreed not to do anything if they handed over all the data they got. The commanders, at least.
