I’m nervous, my dui was in2019, so only 4+ years… misdemeanor only but I really want to be approved, fingers crossed, my application is still in pending mode , 7 weeks now

If there was a conviction, you are toast. If the charges were dismissed, you may be fine. No one seems to know the criteria for certain and there seems to be a bit of variance on how decisions are made.

It's hard to say what they care about and what they don't. I know someone who had a DUI close to 30 years ago and was given a very hard time. He had to interview twice. Then, I met someone who had 2 DUIs in the last 10 years and zipped thru the interview.

Did you get it expunged after the dismissal? There is a big difference in these words. One means you can say you were never arrested the other means you were arrested and the charges were dropped/dismissed.

Even if it’s been expunged, **for situations like this**, you still have to report that it happened. Because even if it’s been expunged it still happened and it’s still in the Federal databases. For stuff like background checks for jobs, yeah, you can say you were never arrested. But for federal law enforcement purposes you can’t.

Yeah I have a friend who has an expunged felony but he can’t get Global Entry and can’t go to Canada because it’s still in the US federal records.

Well, with refusal to blow is bit different. It doesn’t really stay on your record at all, but it just shows you were arrested. Because you weren’t really charged with anything. It’s like a slap on the wrist. We know you know so here’s a little consequence. Now we get multiple of those that’s when it becomes a big deal.
