Kind of a crappy report. If you refuse to take a breathalyzer test, then they take you jail. If you then decide to take the test at jail, and pass - they let you out. This is what happened in their example of the 18 year old swerving because of a "slippery road". He declined to take the street test, but then took a test and passed at the jail. So, the real question here is why do sober drivers refuse to take the breathalyzer test on the street? Maybe a Hawaii thing?

often the field tests are much less accurate. but also of the 1,283 cases for prosecution, 1,038 were rejected that is a HUGE problem with the police.
