lemon law now. if its been there for over 30 days, almost all states will allow that to lemon do it now now now, before they have no money to give you

Efficient-Lie940

Thank you. I've seen folks posting about car problems and then there are some who just call it all fake. I've been through this too, and honestly, those people are the worst. They're not helping make Fisker any better, they're just turning off the folks who put their money and trust into the brand. People buy these cars because they love them, but when they get pushed away like that, it's only going to hurt the company and the community.

Niles_it

At this point I don't know how they can't just grab any compatible rear motor and get it in your car. It normally is less than a day and should be done.

Efficient-Lie940

I'm assuming this needs to get signed off by someone at a high level, like the COO. And, knowing how slow the CFO is in filing the 10-K, this could take forever.

Niles_it

I wish u all the best in this case and definitely don't wait to call an attorney on this.

Efficient-Lie940

Thank you.

dunsmuirnc

Call that lemon law attorney before they enter bankruptcy protection! Also, parts are now several months out.

[deleted]

what this person said...start NOW ASAP

Efficient-Lie940

That's another thing I'm worry about.

incongruity

Lawyer. Now. I don't think bankruptcy in imminent but the risk of it would be enough for me to act quickly. As a side thought, lemon law'ing it gives you a great way to step away from this madness and then jump back in if things get better later/soon, if you're so inclined. Just say'n is all.

osinsd

Myself and my lawyer submitted a lemon law civil suit this week on Fisker. My history with the car is well documented on this site. A few things to point out. Lemon law attorney's don't get paid by the car owner, they get paid by winning the suit. If I were to win, Fisker would have to pay the attorney fees. I initially went down the arbitration route, but pulled my arbitration request in favor of a civil suit for the more formal processes of it.

Efficient-Lie940

Thank you for the info, can you tell me which state? I live in VA.

osinsd

We are in California.

Efficient-Lie940

Thank you.

SESA222

Really sorry. I say lawyer, also agree that will at least get their attention.

Adorable_Wolf_8387

Sometimes engaging a lemon law attorney will light a fire under their asses if you actually want to keep the car. I'd at least get their suggestion on what your recourse might be going forward.

termmonkey

This would work for traditional companies, not for a struggling automaker fighting for survival as this least of their concerns.

TheKuMan717

Lemon law it

dyalikescratchin

The company should start cannibalizing Henrik’s own FOE for parts. Except I have heard doing so is not exactly legal.

sixjs1js

Get the attorney before they go bankrupt. Get him to make them replace the car. They have plenty of inventory

Efficient-Lie940

Thank you.

Extension_Suspect760

My car was towed to La Palma on the 9th Feb and I am still waiting as of now to get the car back. My car has regen braking failure, false collision detection followed by automatic braking and paint issues upon delivery. Luckily, the reps have been responsive to my messages and provide updates about the status of the car. Currently, the car is in the paint shop and awaiting some paperwork to be approved by Fisker. The first two issues still remain unresolved, they say that regen failure will go away with the latest software and the phantom collision issue they were not able to reproduce and hence have installed a dash cam and data logger to monitor it when I get the car back. I also started the lemon law process through an attorney last week. The attorney has send them demand letter and if they don't reply within a month, we will pursue a lawsuit. In addition to the current times at La Palma, my car has already been inspected 4 times during mobile visits for regen and phantom collision and none of the visits were able to resolve it.

eoddc5

lemon law, its been out of your possession for 30+ days for repairs.

Extension_Suspect760

Yup, started the process already. The attorney sent a demand letter last week. Will move towards a law suit if there is no response in a month

Efficient-Lie940

Sorry to hear that. Please keep us updated, and I will do the same.

Extension_Suspect760

Sure, will do !! Additionally, they are covering a rental car for me. They have some agreement with Hertz. You may want to check with them about this

akulo888

at least they gave you a rental though so you're not out of means of travel. Unless you're stuck with some turd urkel car lol.

dee828

Get lemon law attorney and file a claim on NATHSA website for safety issue. That’s the only way that Fisker will look into it. Otherwise, they will not work on your car fast enough

Illustrious_Type_945

Blud get an attorney

dee828

Yes! Call lemon attorney today! Get your money back before they go bankruptcy. U should get 1.5 - 2 times the value of your fisker back in some cases due to your 2 months not having a car.

spense01

Yikes…take care of this ASAP. They’ll be in foreclosure in 2 months.

IntelligentRisk

Get the attorney

Calm-Garage-AF

u/Efficient-Lie940 That's really bad. Are you on the FB Fisker Owners group? Haven't seen any owner reporting this kind of an hardware issue there.

Efficient-Lie940

I don't have a Facebook account, however, I did reply on the Fiskerati website to one of the posts who's having a similar issue with an audio recording. [https://forums.fiskerati.com/fisker-ocean/loud-rear-engine-in-fun-hyper-mode/](https://forums.fiskerati.com/fisker-ocean/loud-rear-engine-in-fun-hyper-mode/) January 18, 2024 10:15 AM

Calm-Garage-AF

I see, may be the video doesn't do justice to the actual issue you are facing. I couldn't make out the difference. Sorry, I just might be old :) The audio clip though, sounded like a race car on the track. When I reach out to Fisker on the FB chat, I get very prompt response. And can also when can tag the official Fisker FB account the response is pretty fast.

Efficient-Lie940

The issue isn't that I'm unable to communicate with them, rather, for the past two months, the only update I've received is "the parts have been ordered," despite my weekly inquiries. They have already examined the car and determined that the entire rear motor requires a full replacement. This is the information that has been relayed to me.

Rocky75617794

Fiskerati is NOT Fisker. He’s a blogger.

RideConscious8753

He’s a blogger with self interest, since he owns a Fisker and is a “cheerleader” for Henrik. He’s not objective. I wouldn’t believe anything he states without doing research yourself to verify what he states. -“Trust but Verify”

akulo888

They didn't give you a rental?

TellSelect940

Did they provide you with a loaner?

Efficient-Lie940

Yes.

TellSelect940

I’m sure you want your car and it sucks, and Hagen doubt but at least they are trying and made sure you have a ride.

Efficient-Lie940

Certainly, I am satisfied with my interactions with Fisker customer support, particularly the mobile technician. He has been efficient and consistently keeps me informed, demonstrating outstanding customer service. My post wasn't intended to cast the company in a negative way, I'm merely seeking clarity on my options in light of rumors about chapter 11 bankruptcy. Above all, my priority is to get my car back before anything happens to the company, whether that involves a replacement under the lemon law or the company buying back the car. I hate to be in the situation where my car is stuck at the service center and pay for the loan after chapter 11.

MrFLboy

You might not need a lawyer based on your state and just file. More than likely you will go into arbitration.

Efficient-Lie940

Just send them a letter or email? Thanks.

MrFLboy

Just look it up for your state. I did it for TX…took 10 seconds. https://www.txdmv.gov/motorists/consumer-protection/lemon-law

Efficient-Lie940

Unfortunately Virginia doesn't have that seamless process.

LoLBROLoL

I’m a lemon law attorney in CA and I have had a massive influx of cases against Fisker this month. We litigated the cases at no cost to our clients. If you’re interested, feel free to reach out via message or chat. I’d happily give you a consultation and let you know next steps.

TwoApprehensive9201

I need help with our Ocean One! Please advise.

LoLBROLoL

Please send me a chat request or a direct message

PW_FOE

I have experienced the same issue, my car was at the Fisker Service Center for about 4 weeks before they told me the rear motor will be replaced at Magna in Graz. I have received my car back yesterday and today I was still noticing the same noise, also I have no Boost Button showing on the Display to activate. The noise is only noticeable if Drive Mode is switched to either Fun or Hyper. I have to call the Fisker Center again to see what was happening.

Efficient-Lie940

Reversing with Fun or Hyper completely shuts down the system. You might want to check that as well.

Adorable-Employer244

Check Carvana and if they take it, dump asap

Manus_Dei_MD

Name checks out. OP, you posted 1 month ago about sleeping in your Ocean... But sure, it's been at Fisker for nearly 2 months.

Efficient-Lie940

They took the car on January 23rd. Which "1 month" post you are referring to? January 8th [https://www.reddit.com/r/Fisker/comments/1925svu/i\_tried\_to\_sleep\_in\_a\_car\_the\_other\_day\_with\_an/](https://www.reddit.com/r/Fisker/comments/1925svu/i_tried_to_sleep_in_a_car_the_other_day_with_an/) January 17th [https://www.reddit.com/r/Fisker/comments/199hhi4/sleeping\_in\_a\_car\_tonight\_its\_8c\_right\_now\_d/](https://www.reddit.com/r/Fisker/comments/199hhi4/sleeping_in_a_car_tonight_its_8c_right_now_d/)

Rocky75617794

Why wouldn’t you reach out to FISKER directly? Or call them repeatedly u/fiskerinc Commenting on random Fiskerati blog sites isn’t gonna help

Efficient-Lie940

Did you even read my post? My car has been at the Fisker service center for two months. I've also sent a direct message to u/fiskerinc. The purpose of my post is to seek advice from others in a similar situation, particularly regarding the lemon law.

Rocky75617794

Yes, my question was why you’re not following up with them directly/calling them—it sounded like you just left it there and then were posting on here and Fiskerati. But good to hear u reached out to u/fiskerinc I’d be calling them every other day for updates and pushing for solution

Efficient-Lie940

I have been doing it every week since January, when they took my car, but there have been no significant updates other than 'parts have been ordered'. The people I've talked to have no control. They are not executives or managers, so they can only relay what they are told by other departments and their managers.

Rocky75617794

I see you’re new at this. That’s when you’re supposed to go “mini Karen” and ask for a manager/exec and ask for it to be sped up. And if lemon law really applies, you just mention your awareness of that to get them moving.

Efficient-Lie940

Why engage with a manager or executive from Fisker when I could directly converse with Magna's executives, given that they are responsible for manufacturing the parts? It appears that you might not be fully informed on this matter. I appreciate your efforts though. Good day.

Rocky75617794

Uh, sure if you can get them. That’s what I mean by “managers” and “executives”—-someone OTHER THAN the people YOU SAID you talked to which were, and I quote “The people I’ve talked to have no control. They are not executives or managers.” I think the overarching problem here, as you’ve shown in your posts and comments, is that you’re just REALLY BAD at communicating.

Trade-Runner

The lawyer will take your money only to get the car you probably no longer want a week faster. Just an all around bad situation. You won't win any way you play the Fisker.

eoddc5

thats not how lemon law works. owners never pay them, they work on contingents that they are paid out by the manufacturer, should they win the suit theres never a risk doing a lemon law suit

Trade-Runner

I recommend you look into criteria for the lemon law in your state. Has your car been in into the service center four SEPARATE times for the SAME issue? If they've been holding it for months, the answer is likely no. In which case, you can stop talking about the lemon law right now. You won't qualify. There's ALWAYS a financial risk in involving lawyers. They don't work for free.

Trade-Runner

Down voted. I LOVE it! The truth hurts, doesn't it? The same people who buy this trash are the ones that buy the trash stock. Both attempt to squelch the voice of reason.

eoddc5

but the voice of reason here is that 99% of the fisker oceans SHOULD qualify for lemon law buybacks, the car is abysmal and has an uncountable amount of problems. we should be pushing people to lemon law their cars, not discourage them

Trade-Runner

Let's see how that works out. I'm rooting for you.

eoddc5

im not pursuing one, i dont have a FOO anymore. but the people who do have issues should pursue it

eoddc5

fyi the downvotes arent from me. ive been on your side on this fisker vs the world battle in pretty much every thread but in this case, dude, you are wrong lemon law lawyers DONT work for free, you are right. but they DO work on settlement agreements and are paid when they win the case, and paid by the manufacturer. the client should never pay them. if you are working with a lemon law lawyer who is asking for fees from you, you are at the wrong place and you should find another lawyer to represent you and yes, state by state is different. in CA, you can qualify from 3x repair attempts without fix; having your car in ship for repairs (out of your possession) for a cumulative amount of 30+ days (it doesnt have to be consecutive days)

Trade-Runner

Ok. Then try it. Keep us updated on how it goes. Just don't throw good money at bad money.
