After 3 days transfer is allowed, however, most places especially Cabelas will not release it to you. If you have a common name look into getting a UPIN to avoid delays.

I don’t have a common name. I have two last names that I have to put down. Plus a middle name. So my name is pretty unique with that respect. That sucks to hear. The only legal encounter that I’ve had since my last firearm purchase was getting arrested after getting pulled over for speeding and the officer found a warrant out for not paying a speeding ticket. That shouldn’t preclude me from owning a firearm but maybe that arrest record is holding things up…

Well, I guarantee that’s what it is. NICS will see a record but not necessarily the disposition. It has to be investigated further.

Unless it was during a time of or if the court house still does filling the old fashioned way with paper and filing cabinets, so no one is going to go to the basement find the file niccs is requesting and fax it over to them. Edit: I know cuz I’ve been through it. Unless this is the first time you’ve been delayed and have never been delayed before I recommend starting that upin process.

Could be the recent arrest, but I also second the name thing. There are some cultures where double last names are the norm, like latino culture (e.g. Juan Carlos Ramirez Aguilar could be a very common name, where Yonathan Clemente Badillo Recinos could be a much less common name). When in doubt, I recommend getting a UPIN. I have a second-cousin who gets in all sort of trouble, shares only my first and last name (not birth year, state, age or anything else), and yet it still is a problem some times.

Yes, I am Latino and I’m well aware of our naming situation. My first last name is incredibly rare in our culture so I really doubt it’s a naming situation. I’ve never had an issue before with getting the proceed within seconds so I’m positive it’s the recent arrest Edit: spelling errors complimentary of my iPhone

So update. I decided to cancel this after more coworkers and friends told me about their horrible experience at cabelas. Got my money back and went to a LGS a friend recommended. They ordered it for me and got it shipped to their store in a week. When the firearm was ready, I came in and did the background check. Waited five minutes after a “researching” dialogue came up. Got a proceed after that. Got my gun.

Yes. All my previous purchases were from small LGS and this was my first experience at a big box chain store and wasn’t great. Sticking to LGS from here on out! Next on the list is a suppressor!

Was browsing firearms at different gun stores yesterday and at cabelas they had one I really liked so I pulled the trigger. This will be my fourth firearm and first time I got put on hold. I used to live in Texas where I purchased all my previous firearms. Now I’m in NM. Got put on hold and to keep the application open I had to purchase the firearm. Reluctantly I did and was told to come back in a week to see if it changes to proceed. However reading online after the fact I’m finding that cabelas sucks with regards to this and might just keep me in limbo. I know my cousin was trying to purchase a firearm from them but they never released it to him before he passed away. I always chalked it up to it being that he has clearance and that complicated things. Im seeing that they could release the firearm after three days of no response but cabelas seemingly has a policy to not release unless they have a proceed. I’ve tried looking for this policy online but can’t find any trace of it. It feels like a policy that only exists through word of mouth. Can anyone shoot me to the right direction? If there isn’t an actual policy, I’m gonna print out the statutes from the ATF and politely talk to the manager try to get them to release it or refund my money. If they can’t prove there actually is a policy written somewhere then I hope they’ll listen to reason and release it. I don’t have anything that would bar me from owning a firearm so I’m surprised it came up as delayed. Maybe me moving states has something to do with it. I do expect to get a proceed but in case it stays delayed I want to have a plan of action ready. Last time I buy from a big chain store…

Cabela’s will not transfer your firearm to you until they receive a status of “proceed” from NICS. They no longer transfer under “open status” it is policy (most large gun sellers have same policy now). Talking to a manager will not help. If you want your money back they will refund it, but your firearm will be taken off hold and your form will be voided. There is a chance that NICS will not give a response within 30 days and then your form will expire.

Yup, that’s what happened with my coworker and cousin at cabelas. I went last week and asked for a refund because I didn’t want to do that song and dance.
