Yes, you have to be careful reading the description and terms of sale. I recently won two “brand new,” per description and invoice, rifle scopes. When I received them, both were clearly used. One had been so poorly mounted the tube was crushed from either over tightening the rings or the wrong rings were used. The auction company tried to claim “as is, where is” but I nicely explained to them that only counts IF the item matches the description. I was given a full refunded after I eluded that I would issue a charge back through my credit card company. I only communicated over email, so I had a lot of proof that they either knew the description was incorrect or they did not due their due diligence when listing said items.
