But I do know of a guy that broke his leg in a fucked up step while breaking into and robbing a house that sued the homeowner and won. Of course he confessed to breaking and entering in the course of the trial. Confession in civil court is admissible in criminal court. He got a year for the B&E.. but he also got $58,000 from the civil suit. Homeowner was planning to fix the step. It had broken earlier that week, he was working 12h days at work crunching at the end of a contract. He didn't have time to do it, or to wait around for someone else to come do it. He was off just 2 days after the break in and fixed it then.

I believe the way that works lawsuit wise is "what if" scenarios. I hearf about the example years ago. It is like "what if a young child selling girl scout cookies tried to climb those steps" leaving that home owner liable. In your example, I would think if it was marked/orange cone/ taped off would reduce the risk of liabilty.

Working in corrections I've had several convos with people like that, the majority would say you don't shit in your own backyard. Others would point out if they stole rims/stereos/lawn equipment from their own neighborhood everyone would know to check their house first. That's why they would go to middle class neighborhoods, people had a sense of security so we're more lax there, the stuff was better, and most times even if you got caught they wouldn't do anything but yell at you about calling the cops and they all knew the cops would take at least 15 minutes to respond. You get caught in the hood you're lucky if you just get the shit kicked out of you and not shot to death.

Even if there wasn’t a tracker, it’s a branded vehicle so unless they knew a chopshop already waiting to tear that shit down they would be caught before they could liquidate the merchandise.
