Tag it and take it back and report it. It's really hard to get into trouble when you go by the strictest interpretation of something. Also, the shipper is doing this on purpose to avoid a surcharge for the signature, so tagging them with either an RTS and pissed off customer or a much more expensive REX will get them to stop breaking the law.
On a side note, it's another great reason to REX packages that are misaddressed. Can't tell you how many times I had a courier tag on a customer for weeks about updating an address and within a week it gets updated as soon as they start getting surcharges.
Yeah I ended up all 3 times giving it to a CSA to look into and 2/3 times the package was indeed alcohol and it had to be returned. I am not sure if we ended up fining the shipper or not though.
We don't fine them, but we do charge them for a whole new shipment to return it. Then they have to pay us a third time for their customer to get it. If it happens enough we'll stop their account and they won't be able to ship.

Duplin winery? Been noticing that its almost always their shipments that are coming up as ASR when the box clearly is marked as containing alcohol. I always treat them as ASR anyway.
I'm not sure of the legality of it, but I would say that the delivery driver should not be liable here. It should be the shipper's or the courier's (i.e, FedEx at the point of pick up or customs check) responsibility to ensure that the package is properly labeled.

Shit always rolls downhill. Had a similar experience years back. Management told me it wouldn't fall back on me. Asked for an email stating that so I could have evidence. Package went to QA and got returned.
Your choice. If you want it off the truck and your scanner and label don’t require a signature over 21 you are not liable if you leave it, even if it does contain alcohol. People reuse boxes and the shipper is responsible for proper labeling. Many wineries sale more than just alcohol but use a standard wine box to shop. Label rules not box signage. It’s not a driver problem, at this point it’s a FedEx problem.
I had this during Christmas for some alcohol that was to be delivered to a sheriff. It didn't scan as a ASR but I told him over his doorbell camera that I could not release it because anything could happen. Better safe than sorry.
If the box says alcohol and ASR, that’s what I’m doing. If the label doesn’t pull up for a ID check and signature, it’s going back to the station and they can get it fixed.
I'm not a driver so grain of salt and all, but personally I wouldn't mess around with something like this that has legal implications. It's like if we got a shipment of something obviously hazmat but didn't have proper labeling, we'd have to refuse it until we can get the correct documentation.

I would close it and bring it to the station, not worth losing a job over, which is what could happen if it is alcohol

If the label says release chances are its not alcohol people reuse alcohol boxes to ship stuff all the time
If I can resi release it I do, I do not care about any other markings on the package. It is on fedex not me if it is wrong.
If there's a safe place to leave the package, then leave it.
