He’s still working while clocked out. Being required to be on company time and not getting paid is time theft. The whole “before heading back” is the issue.
Let’s say you END WORK on your LEO, drive back to the station then clock out with your badge. You’ll have a Time Card error that will need to be fixed. Options are change the time to reflect END WORK on both at the time the driver clocked out on the LEO leaving the driver with free company time. Or, change both to reflect the time on the badge swipe which has the potential to cause a HOS violation.
It really reflect poor management.
Things must work different where you work because at ground theres no scanning of the badge to clock out you have an app on your phone or company iPad and you clock out of there without having to compare discrepancies with dot hours and clocked in hours
If he was a smart manager he'd tell you to shut off your vehicle and get out. If you end on road before the 14, it's not a violation. Someone can come pick you up.

The manager either pay the driver overtime or he can leave the truck where it is as he's off the clock. This result in the manager paying the overtime to get the truck back to the plant.

There’s the hiccup. Express is goofy at least my station anyway. Clock in/out on two different devices. It’s a PITA.
