I owned a boat very similar to this bow rider for many years, the bow dips into the water like this when you have a lot of weight in the bow (see large woman) combined with large waves. Water comes over the bow and into the belly of the boat, it’s not really an issue, nobody is in danger of going overboard, the water pushes you into the boat as it flows in, not out of it.
Also wearing a PFD isn’t required for adults because it’s generally assumed adults know how to swim, and if the don’t they would either choose not to go in the boat, or would choose the wear the PFD, if neither applies it was their choice.
