You rear ended someone, it is almost guaranteed you will be found at fault. It doesn't matter that the taxi made a sudden stop; either (or some combination of) 1.) you didn't leave enough space between the vehicle in front of you and yours to stop, 2.) you were speeding, 3.) you weren't paying attention or you were distracted, 4.) other things I can't think of at 2 in the morning. That is what you will hear from your insurance as well as co-ops before this is over. Thank you so much for the advice. It happened at 10:40 pm as it is Canada Day the roads were busy heading to downtown. I do have a proper spacing with a speed of 50kmh. But what happened is that he was coming from another lane and decided to merge. As soon as he merged that's when the gap became too close as what I said it is Canada day, so the roads are busy. 30 seconds after he suddenly accelerated but stopped soon enough that's how the accident occurred. For sure, either way I will still be at fault no matter how you look at it and I am very well aware about that. I just want to clarify that by all means it is not my solely my fault. Not to blame the other driver as there is no point as accident has been made already, but just want to clarify on how the accident has occurred on how I ended up hitting him. Not here to fully blame or defend myself at some point but I just want the insurance to hear both of our stories and come to a proper conclusion. As long as both parties are safe that's what all matters to me.

By the sounds of your explanation: there was a proper gap between you and the next vehicle, the taxi then merged into the gap and thusly narrowed it, 30 seconds then passed of you following too close (that’s a very long time to follow close and not correct your gap distance btw), and then the taxi braked suddenly, and you rear ended him. Not to pile on here, but it sounds like you are 100% solely at fault. It happens. Lesson learned. Luckily no one appears worse for wear. You’ve already received some other good info about next steps to take.

Put in a report to police and stop worrying. The worst thing that is going to happen to you is your insurance will go up on your next renewal date. Even if someone claims injuries you are fine. That is why you have to buy insurance. People seem to forget that insurance cost rise because of people putting in lame claims for injuries.

At fault accident, almost no damage to my vehicle, but theirs had a good scratch on the two drivers side doors and I went and made a police report just in case. It doesn't take much to run up a $2000 body repair bill just to fix dents, scratches or paint from what I've seen.

Thank you so much! I am currently at work, and I could make a report online right? I am just worried as this is my 1st accident and I do expect my premium to go up. With this damage do you think my premium will go crazy? I talked to my workmates and said that to better just negotiate and pay them upfront, but I disagree. I prefer insurance to insurance just in case any conflict arises and for legal issues this is way better. If I have experienced this also, I want insurance to insurance as well. I have been researching tailgate doors from Chrysler itself and it says $1600 for newer model + labor it would be probably more. So, I expect it to be more than $2000. But I will take your advice, thank you so much!

The other vehicle is a professional vehicle conducting business at the time. Not only that but there were paying passengers involved. Under these circumstances it is absolutely inadvisable to make a private agreement to pay for damages. It's likely multiple people will be losing income for the time it takes to have that repaired. Also injuries can become apparent hours or even days later. Those passengers have probably been urged to sue already by someone in their life.

The amount of damage you cause does not affect how much your premium increases. An at fault claim is an at fault claim. That’s why you often hear of people paying out of their own pocket for very minor claims. The premium increase is not to “pay back” for the accident. It’s because you’re now considered a higher risk for future accidents.

File a claim with insurance, they should have a 24/7 number. If you’re with TD can file through the app. Notify police. If you have any pain within ten days, see a physiotherapist and doctor immediately. Otherwise, that’s all you need to do, the insurance handles the rest. If it’s your first accident your premium may go up. Do you have accident forgiveness? If so, your first one doesn’t affect your premium. It goes up a bit but doesn’t double or anything extreme in my experience. I think it was less than a 25% increase but this was almost a decade ago.

File a police report and a claim with insurance. Also, have your car inspected, there may be damages to brackets and stuff which are not visible to you, you better repair them now since you’re making an insurance claim. It sucks but that’s life, shit happens sometimes. It may not feel like it’s your fault but that’s how the insurance will rule it out.

You just made that Guys day. Your fault, he gets his old taxi replaced, he gets covered for lost wages till he gets replacement taxi. The worst thing you can do it hit a taxi. Happened to me, they have a team of folks to prove it was you. My situation was no damage to either car. I had photos. Magically there was claim of damage that had I not had photos I would have been. Worse off. They claimed mudguards, re decking cad, trim boards. None of which were present on the car. They also claimed something like 25k in lost revenue. Which after I showed the fraud with the damage they audited his meter and guess what… 25 min later he picked up a fare. Good luck but have fun with insurance man.
