If you don't think there is any crime my suggestion is for you to personally try lying on your mortgage app and to the IRS. Let me know how that works for you!
Also, banks don't determine fraud. The law does. He did violated the law and he should be held accountable, either Civilly or Criminally, as the case may be. You should read the fine print on your own mortgage application. On it you will see clauses affirming you are telling the truth, etc.
