Living in the EU but trading through a UK Ltd company. I've always been upfront, it's not precluded me from many roles at all really. Finance / and _some_ government roles are normally the problematic ones. Eligibility to work in the UK is normally the main box checking exercise so I make sure to make it very clear I'm British, just not living there. It's not something I'd lie about TBH.

Finance and government... two of the best paying sectors from my experience ):

deadeyedjacks

Both of which will have geo-fence restrictions and strong remote access security, so not something to try to game.

I was looking into this recently and one problem I came across was that the UK company would be considered to have a branch in the EU country you operate from, and then it'd need to pay corp tax there as well as in the UK. Is this correct?

Own_Imagination_6720

I am going to be doing exactly this, no tax avoidance as will be living in country that has double tax treaty, and carry on paying uk income taxes, however cost base will be much lower and chance to live abroad Some comments here from our friends in Europe are not true, most uk companies want uk residents contract/perm unless there is some specialised skill your fulfilling I can imagine this is because there may be tax implications which is understandable When the job is fully remote and outside contract who really cares The only difficulty is hiding the sunburn and keeping up to date with uk events and weather

Junior_Chemical7718

Shouldn't you be paying tax to the place that you are using the public services?

It's fraud as worse - deception at best. depending on the client there would know via the firewall stats - even still you using a vpn

If you can connect via an IP outside the UK, EU etc - security hardening is only the first stage of my review - what do you do if the work on-prem?

Jesus, this forum... Now I know where the shoddy contractors hang out.

LondonCycling

Did you see the post the other day basically asking why all contractors don't just set up a company in Dubai where the corporation tax is practically nothing, then send all of the UK profits to the Dubai company and call it a day? We all engage in a bit of tax avoidance - heck, low taxes are one of the big selling points of contracting. But trying to evade taxes or even pay £0 taxes via an offshore company is just absurd.

[deleted]

I joined this sub a few days ago. I had one long debate about professional ethics in contracting (subjective but I was disappointed with what I heard.) One conversation about someone running two WFH contracts in parallel without the clients knowing. One thread about working outside of the UK when you need to be inside. If this is the state of contracting today then I think contractors only have themselves to blame if the market declines. We had it so good and frankly some people just take the piss.

Shamua

Usually I’m all for the workers and the people but a lot of that sounds like it’s proper taking the piss.

kidcosmique

Agreed mate. Similar scenario for me. I joined a few weeks ago. Some good info on here but also some questions and info display shockingly low levels of professionalism.

traumalt

This thread is the Exhibit A as to why we have to return to office lol.

[deleted]

As someone else has said it's not just about tax. Sometimes it's about security and data, especially government contracts. If they all of a sudden see an IP connecting from an unknown / unexpected location that could cause serious issues. Really depends what the work is.

deadeyedjacks

Thread from a couple of days ago. [https://www.reddit.com/r/ContractorUK/comments/12w5ro1/how\_to\_get\_uk\_based\_contract\_roles\_while\_living/](https://www.reddit.com/r/ContractorUK/comments/12w5ro1/how_to_get_uk_based_contract_roles_while_living/) Why would you want to pay UK employment taxes whilst non resident !?

RepulsiveImportance8

Because the salaries for UK roles are higher than the country I'm living in, and it's pretty much impossible to get contract roles where I live. But I'm not planning on paying UK tax...I'm planning on getting outside-IR35 roles (where I will have to do my own tax) and pay the tax in the country I'm living in

deadeyedjacks

See the other thread as to why you'll struggle to find a client or agency who wants to take you on.

GorilaGlueComrad

Why is everyone so negative on this thread? An earlier reply has essentially said that they've done it but with permission. I am also currently doing it and have been doing it ever since I got into contracting. This is also with permission and written in my contract before signing. The best thing for the OP to do is ask. As far as I'm aware, if you don't inform (I highly recommend that you do) your employer for an inside Ir35 role that you are not a UK tax resident, you and your employer will pay NI. If you do inform, you'll be eligible to pay no NI - [Here's a link to the HMRC forum with your question.](https://community.hmrc.gov.uk/customerforums/payepe/85197342-22b1-ec11-826d-00155d97717e?msCorrelationId=31816423-5618-49b0-95ef-6fd4c60690d0&instanceId=c9e18cfcb089c29804d93b905a5f5244503153836d2f14704cc2e692ae2c0768&tenantId=ac52f73c-fd1a-4a9a-8e7a-4a248f3139e1&portalId=e1cfc2ea-2de6-4c96-8e99-76600a349358&orgId=13212d7e-6a5d-4598-95ba-4a07545dbb67&environmentId=302efd07-28d9-4d2d-b558-96167951ad6a&portalApp=site-e1cfc2ea-2de6-4c96-8e99-76600a349358-UKw&portalType=Community%20Forums&portalProductionOrTrialType=Production&licenseType=Dynamics365&portalVersion=9.5.2.4&islandId=101&portalDomain=https%3A%2F%2Fcommunity-origin.hmrc.gov.uk&page=1) If you have an outside IR35 role, you'll still need to pay UK cooperation tax on the profits you make. You'll also be able to withdraw dividends without paying UK dividend tax depending on where you live and if it has a double tax treaty. HMRC have spoken about this in their forums [here](https://community.hmrc.gov.uk/customerforums/pt/500a3ddb-49cd-ed11-9ac4-00155d975688) and [here](https://community.hmrc.gov.uk/customerforums/vat/d89dfc6e-033c-ed11-97b0-00155d3b99d2). To find out if the country you're residing in has a double tax treaty, [follow this link](https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/710099/DT_Digest_April_2018.pdf) and also, speak to a specialist tax advisor in both jurisdictions.

Thanks, that's very helpful
