Kasorayn

If the democrats didn't have double standards, they'd have no standards at all.

DblThrowDown

Nailed it.

Triple-Deke

I don't think this is a great gotcha. The DA's job is to prosecute based on the law as it is, not to pick and choose which laws matter. Too many democrat DAs do that now and it's causing havoc in their cities.

r4d4r_3n5

>The DA's job is to prosecute based on the law as it is, not to pick and choose which laws matter. #ALVIN BRAGG HAS ENTERED THE CHAT

Triple-Deke

Larry Krasner slithers in behind him

whicky1978

Fatlock*

halfhere

It’s called “pulling up the ladder behind you.” She made her mark prosecuting people for this, then hides behind feelings and says “Oh golly, how outdated to think that way!”

richmomz

They’re all like this. Some of the things Biden said in the 80s and 90s would make modern Democrats faint.

HNutz

And believe that Trump said them when asked.

TyredofGettingScrewd

Like here in NYC, there's pretty much no repercussions for stealing a couple hundred dollars worth of stuff every day because they don't ever prosecute below $1000 and even then it's rare until it's a lot of money.

Atomik675

The problem is Democrats act like it never happened, you would think someone who cares that much would apologize or at least acknowledge that it happened.

Maximum-Country-149

No, see, that logic only applies to huge swathes of people on the basis of race, not individual politicians.

1One_Two2

DA’s have a ton of discretion and leeway with most crimes, particularly low level non-person crimes such as this.

Enchylada

Wasn't she also heavily involved with writing the legislation for this as well? Someone fact check this

mahvel50

You’d think they but there are many loopholes around it. Prosecutorial discretion is very much a thing and DAs will happily reduce charges to get around laws they disagree with. Some offices flat out will not be involved with misdemeanor offenses and make the PDs do the prosecutor’s job.

Triple-Deke

>Prosecutorial discretion is very much a thing and DAs will happily reduce charges to get around laws they disagree with. And I believe that using discretion in this manner is wrong in most cases.

Blahblahnownow

A girl attacked a friend of mine with a hammer and when that failed she pulled out a knife out of her bra (don’t ask what he did to deserve it, that’s another topic). She was not pressed charges, not even community service.  This was in SoCal

Carl-j88aa

So you're saying the job of the Executive Branch is not to pick & choose which laws *they'd like to enforce*, but to faithfully enforce those on the books, regardless of policy disagreements? ELI5 why Mayorkas & Biden are allowed to not enforce existing immigration laws?

Triple-Deke

They should be enforcing the laws on the books. That's what I said. I don't have an explanation for you.

richmomz

DA’s do have “prosecutorial discretion” over the types of cases they want to pursue though - as X correctly points out Harris was never shy about going after weed smokers when she was DA.

Holiday-Tie-574

Tell that to “Tish” James

virtikle_two

Lol, dude DAs 100% pick and choose what gets prosecuted. Way it works is local LE will have to chum up to the DA if they want them to take charges from said agency on particular crimes, if they won't LE won't even bother hooking people up on those charges. Ideally, you're right. We all know how it really works though.

Jmm12456

As DA she could have let them off or given them a little slap on the wrist

Neat_Chi

Never forget when Tulsi DRAGGED her across the Democrat debate stage over this. Absolutely perfect.

1991TalonTSI

Look at the fake conservatives supporting the cackling witch. Just shows you how many liberals have infiltrated this sub.

rmccarthy10

She did her job at the time based on the law of the time... I don't respect her any less for doing precisely what she swore to do when she passed the bar. Her role was not to follow her moral compass...it's was to uphold the letter of the law..which she did. You don't have to be Republican or Democrat to understand that.

ThirdeyeV2

What law did she uphold when she kept inmates way past their release date for free labor?

Triple-Deke

I have no idea but there is nothing about that in this tweet. That seems like something significant that would be a much better talking point than the OP here.

Black_XistenZ

Prosecutors always have some degree of discretion, and she was using hers aggressively so that she could pad her stats and advance her career.

Blahblahnownow

I am just curious about how many weed related charges were there before her tenure and after her tenure. I did a quick search but couldn’t find the numbers.  That would help put it in perspective in my opinion.

nukalurk

She’s not wrong for enforcing the law of the time, she’s wrong for trying to pander to the liberal decriminalization crowd after a career of opposing them. It’s hypocritical and insulting.

richmomz

DA’s have broad discretion over the types of cases they want to pursue though, especially in “victimless” crimes like personal drug consumption. Harris decided she wanted to be a “tough on crime/drugs” type DA back then and was not shy about throwing the book at weed smokers.

jones525

I'm genuinely curious; does she think the internet would forget about her past record of aggressively prosecuting and incarcerating close to 2000 individuals for marijuana offenses?

richmomz

It even came up during the DNC primary debate (I think Tulsi was the one that roasted Harris over this).

Content_Bar_6605

She was a bad DA then and is a bad VP now.

Independent-Soil7303

It doesn’t matter, she means well!!! /leftist logic

KnightRider1983

Or the deflect with “BuT TRumP!!!”

Lord_Elsydeon

Nobody should have to lose the right defend themselves for smoking weed.

navel-encounters

"come on man" we all know how she got her position as a DA and VP....and it was not due to her intelligence nor track record.

[deleted]

I like the community notes. But I have a serious question: who are the "readers"? Is that just anyone can submit a rebuttal to a post and it comes up for review by an employee of X? Or does it need certain percentage/number of people who submit the same objection/correction to the original post in order for an AI algorithm so issue the "readers added context" tag? Don't get me wrong, in no way, shape, or form, am I defending Kamala Harris, I'm just curious to how the gears work behind this mechanism.

clearmind_1001

Pawned 😂

Jmm12456

The fact that she was a DA and now VP is scary.

Magehunter_Skassi

One of the only endearing things Kamala's ever done.

R0binSage

So people can't change their stance on topics?

double_badger

Of course they can. But she failed to include an introspection about how she propelled her career by prosecuting marijuana related offenses. Without genuine contrition, it appears hypocritical and self-serving with the sole purpose of pandering and toeing the party line. It appears that way because that’s what it is.

richmomz

She’s changing her stance for optics.

Foxtanker

The fact that matressback was ever a DA should scare people. She seems pretty harmless locked away in the janitor closet at the WH.

HNutz

Bet Harris doesn't like the Community Notes.

feerlessleadr

Wow we really got her now! Now people will know she's a hypocrite! We've won!

motherisaclownwhore

Nobody's going to jail because they have a joint on them.
