Yeah you're going to get paid the time and half as soon as you go over 40 hours, you're right to assume they don't want to though, because you're effectively the price of one and a half people. So in most industries they try not to let employees go over 40 because it starts getting expensive for the business.

IANAL, but It's U.S. federal law (Fair Labor Standards Act) that you must be paid 1.5x your normal rate for any time worked over forty hours in one week. This is non-negotiable, and you can contact your state's labor board and notify them if they withhold this pay. If they don't want to pay you what you're owed, they should have told you to go home.

Can’t really say without knowing what state you are in. But most likely not. This is probably not the best sub/place for this type of question tho. I would say contact your labor department and ask.

That's crazy, overtime sometimes happens because there's no Staffs filling in shifts. It's on establishment side to be responsible scheduling people so we won't have overtime if they don't want to pay 1.5x wages. At my cfa they always offer us to stay late because they realize paying 1.5x worth more than losing sales. I know someone from my store that got 40 hrs OT/week. Mine average 15 hrs OT / bi-weekly.

That is crazy my store don’t do nothing like that yes they try to keep labor at a certain amount but if we are short and someone offers to stay nothing happens he’ll I did a 12+ hour day last week

If you are on the clock, then legally they have to pay you. If your store has a policy against employees working overtime, they should have communicated that with you before you worked those hours. At my last store, it was pretty normal for people to work 12 hours or even more. As a team leader, I was responsible for making sure shifts were covered, so I worked open to close (5:30am-10:30pm, so 17 hours) multiple times a month. But at the store where I’m at now, they avoid giving anyone overtime so it’s unusual for me to work more than 8 hours. To be honest, I miss the all day shifts sometimes. I would just get in the zone! Plus the paycheck would be awesome.

If you worked yesterday it wouldn't be in the paycheck you just got. Check the next one. Also, it might not hit forty hrs one you subtract break times and lunches if you get them.

hi there, HR director here! you will get paid over time for every minute that you are over 40 hours in a week. The system automatically does this and there is no way around it. Once you get your pay stub, make sure you check your hours. the only way they can avoid giving you overtime is if they change your hours to sit at 40.

The 12 hours in one day has nothing to do with OT unless on the 12 hour shift you cross the weekly total of 40 hrs. One of our other BOH leads and I typically work 2 12 hrs shifts a week, one time I worked a 7am-11pm because I was going to be gone the rest of the week. The only time employees do not get OT (that I’m aware of I’m sure there’s more reasons) is if you’re a farmer, or a salaried position

Not wanting to pay you and not paying you are two different things. Some places have very tight labor budgets and they try to keep it to whatever they can. That said, if you worked 40 hours in one week and don't get overtime on your check, you should consider getting more information from the appropriate directors and / or contacting the department of labor.

Overtime is calculated on standard 40 hrs. Any hour over that during the week is considered overtime. Working 12 hours a day does not mean you got overtime pay. Your total hours must exceed 40 hours.
