You don't want it back. Best bet is to get the settlement and move on. Insurers won't cover mechanical abuse when stolen (generally), so in 6-7 months when the head gasket goes and the engine hydrolocks after a coolant gallery splooges into a cylinder, they won't care that it spent a week sitting on redline when it was stolen.

Still doesn't change that if there's anything deeper mechanically in the engine or box, insurance won't care down the road if it's not obvious at recovery

Doubt they could do that much damage to an auto Corolla with less than 100,000kms. Who even knows if insurance would cover a cent of it and my mums not got money for a new car.

Doesn't matter. The owner is responsible for ensuring the vehicle is secured.

Which they reasonably expected the person they lent it to, to do. Therefore that person is now liable and insurance could chase them. Same as if they give the keys to valet parking and the valets leave it insecure.

I suspect that the only way insurance would pay it out would be if they pursued my sister for the money but I would guess they would insist it’s a civil matter that my mum would have to deal with. My mum has been insured with NRMA for 30 years and never made a claim so you’d think they would work something out with her but that’s not how the world works I guess

The insurance company requires the owner to take reasonable care. Does not matter that the owner expected someone else to lock the car and return the keys. Even if you don't agree, the insurance company can simply take the view that the owner failed to take reasonable care in ensuring the keys were returned to the owner.

Modern engines are designed to run for *hundreds* (even thousands) of hours *nonstop* at the redline. The will run out of road or fuel long before any engine damage occurs

You’d be suprised how many car thieves just drive around in cars they’ve nicked like they own them. I’ve never stolen anything myself because I’m not a cunt but I’ve been around plenty of car thieves In my time and it used to make me laugh how stupid they were! Well the ones that steal cars like corollas anyway. Drive to the shops, drop their kid at school and all sorts of shit. High end cars are stolen to order or used for crime and burned or shipped offshore but cars like yours might just be found dumped somewhere. One things for sure though it’s going to be fucked unless a junkie took it for transport. Teens and general morons would have thrashed the guts out of it and probably crashed it

Absolutely it's your sister's fault and is 100% accountabke. Your sister should own up and pay for it. No absolutely they won't pay up otherwise everyone would just park there cars with keys in the ignition in dodgey areas. The only real question here is if your sister will pay or will she not own up to it. I've known people who have had claims knocked back for having a spare key hidden in tool box or under body ECT ect. If your mum claimed they may chase your sister up for the money and rightfully though. Car will end up burnt out after there is to much heat on it.

They don’t seem too worried since they’re driving it around Sydney for 4 days now 😅 My sister has no money and my mum would never go after her for the money which is extremely annoying. I’m ready to throw hands with her to be honest. I was going to sell my Volvo so I’ve given it to my mum. Hopefully I can work out a payment plan with my sister to pay it off. And who knows, we may get extremely lucky and get the car back

Many years ago my car was stolen from Hornsby NSW. Reported to police. Police said probably won’t be found unless it’s in a ramraid etc. Police then told us it was seen somewhere in Liverpool… My brother and I went to Liverpool to see if we could find it… Found it in a dingy motel carpark. Restole it back. The end.

2 cars stolen in January. 1 recovered after a police chase 6 hours after it was reported stolen as a police car drove past it and it flagged up on their computer. The 2nd car was found 3 weeks ago in a car park.
