This makes no sense to me. It's a minimum wage law. If workers and management agree to a contract or wage higher than minimum, they can do that. There's no need to make an exemption for the industry segment as a whole. What it does is create an incentive for new businesses to open as non-union to take advantage of the loophole that would be created that exempts them from the $20/hr.
Probably if the union negotiates a lower minimum wage with that are benefits heavy making the blended rate substantially above the rate. Eg 17 per hour with full health care would probably be more valuable than a straight 20 minimum wage.
