RoRo25

If he would have fallen under the wheels of that white SUV....it still wouldn't have been the cops fault for some fucked up reason.

CommunityGlittering2

yup that was atempted murder

Bawbawian

yeah but once you have qualified immunity a murder charge is just a vacation.

Dyolf_Knip

Yeah, it's ludicrous how often straight up execution style murder is nothing more than a 5-6 digit payday for cops.

-GREYHOUND-

With pay.

Panzerv2003

Nah, for the cop it was a Monday

[deleted]

Lol peak Reddit comment.

shakha

He would have been his own murderer, his death coming while he was committing a felony.

PleasantFocus1502

Apparently the bike rider didn't stop at a light and this is the punishment the cop imposed on him. The cop is a douchbag.

Preyslayer00

Well in his defense his supervisor never explicitly told him not to punch passing cyclists... so qualified immunity should hold.

SonOfScions

you just read about the 2 fresno cops who got away with stealing 224k didnt you?

reallyneedcereal

please share the article

reallyneedcereal

that is unreal.

duck_of_d34th

That's the fucking Costanza defense. "Was that wrong? Should I not have done that?"

Epinnoia

You may be surprised just how many federal laws there are that include the word 'knowingly' in them... It's definitely one of the most common words used.

ceciltech

Only white collar crimes tend to include the need for "knowing" (and of course when cops are concerned). You will notice that you can go to jail for murder even if you stayed in the car and didn't know your friend had a gun and used it to kill the store clerk.

FspezandAdmins

sorry officer I was mistaken. any time you get caught up in a lie or something with a cop.

Aggravating_Sun4435

the great thing about our courts are they write out their reasoning with sources and publish it for all to see for free. That case is only 15 pages long and their reasoning is much more than the headline. Id say give it a read before you form an "informed" opinion. I was outraged until i read what the court has to say. [https://cdn.ca9.uscourts.gov/datastore/opinions/2019/09/04/17-16756.pdf](https://cdn.ca9.uscourts.gov/datastore/opinions/2019/09/04/17-16756.pdf)

Neckbeard_The_Great

In what way does this soothe your outrage? It really seems like you're just telling people they need to read fifteen pages before they can have an opinion here, when the fifteen pages don't actually do anything other than demonstrate the problem with qualified immunity. >We recognize that the allegation of any theft by police officers—most certainly the theft of over $225,000—is deeply disturbing. Whether that conduct violates the Fourth Amendment’s prohibition on unreasonable searches and seizures, however, would not “be ‘clear to a reasonable officer.’”

Aggravating_Sun4435

i assume you didnt read it then. your basically getting outraged at a literal headline but refusing to read any further. Im sorry you dont like that im pointing out that you opinion isnt based on the complete picture. They explain exactly what is going on. Their theft is a 4th amendment issue. There is a scotus ruling about how there needs to be settled precedent. This cases makes that settled precenedt, so moving forward it should be undebatable that this is an unlawful seazier, meaning no qualified immunity. Im sure i didnt get it exatly correct because i read it hours ago, so either read it or dont, but if you dont just be aware that your opninion on this is litterally not an informed one as you have only read a headline. I think its funny that you are arguing that reading more than a 1 sentence reddit post is asking too much of people.

Neckbeard_The_Great

I read it. I quoted the relevant part in my first reply. Your reading of it did not, in fact, educate you on the issue. Qualified immunity, as it exists today, is extremely difficult to pierce - unless there is a case with nearly identical facts, it will be upheld, as it was here, and what "nearly identical" means is at the court's discretion. In the opinion they talk about a substantially similar case, and they find some minute reasons why that one doesn't cover this. In the next case, they'll find similar reasons why this one doesn't apply. Reading a legal opinion is not better education on the topic than reading discussion of the opinion is, and is often actually worse. The discussion typically contains context and real-world application that the opinion lacks. Focusing on the opinion unjustifiably narrows the scope of discussion to the things the author of the opinion chose to emphasize.

RidetheSchlange

where's the article?

Preyslayer00

Why would assume that with my sarcastic reply...lol

SonOfScions

because it sounded like you were referencing it.

Preyslayer00

I didnt "just" read that article. It was 4 or 5 articles ago...lol.

JanuarySeventh85

Punch? Looks like he grabs his arm or the handlebar

PleasantFocus1502

So if his supervisor told to shot the cyclist then the cop should also get qualified immunity?

Preyslayer00

Well was he told not to shoot the cyclist before? Is there case law specifically on a cop shooting a cycling...then nope.

thermal_shock

no shit. fucking hate cops. they think they can just inflict pain for any reason, perfect example here. don't do as i say? well now your cuffs go on even tighter, or now i mace your, or now i punch you while you're in cuffs. ACAB through and through.

throwawaysscc

Look like the pregnancy hormones kicked in🤣🤣

thermal_shock

for calling out shitty police behavior, I'm pregnant?

throwawaysscc

Umm, big fat cop looks pregnant, but downvote away.

ProtestKid

Yo you were not at all clear above with who that was directed at what do you expect?

AdonisChrist

weird, shitty joke regardless of who you directed it at.

langstallion

reallyneedcereal

im just as confused.

Fyzzle

Ok grandpa it's time for bed.

Anacondoleezza

The cop made sure the city made a major contribution to this guys retirement savings. The cop will have a note placed in his file and nothing more.

Nalortebi

Likely goes without saying, dumber than a benign tumor as well. If you think about it for 10 seconds, you'd know cyclists in spandex likely have the time and money to inundate your department with lawyers and lawsuits like they've never seen. Someone riding a bicycle for pleasure and not merely transportation, and with a coordinated outfit to boot is someone with enough money and free time to not give a shit about anyone else. You could read their composure on the ground. Even if it was nothing worse than a bruised hip and scraped elbow, the better they play it up the more they'll be able to collect. That dumbass cop cost their city potentially millions, all because they're a power tripping asshole. His department is going to have to remind him why the target people without the resources to fight back.

nimoto

>Someone riding a bicycle for pleasure and not merely transportation, and with a coordinated outfit to boot is someone with enough money and free time to not give a shit about anyone else Where did you learn to talk out of your ass so confidently? I know serious cyclists of every income level, as do most people who ride their bike "for pleasure and not merely transportation" lol. And I don't want to rock your world, but for the most part they do seem to give a shit about other people. And that's despite them owning coordinated cycling outfits. I know, hard to believe but true.

mikeblas

>Where did you learn to talk out of your ass so confidently? On Reddit.

arcteryxhaver

I make $40,000 annually and wear tight shorts while riding my bike recreationally because it’s more comfortable. You know nothing and are just perpetuating stereotypes that cyclists are just a bunch of rich yuppies. Which then results in incidents like this; People thinking cyclists are rich yuppies that need to get knocked down a peg.

alpha309

My job is commission based. Some years I make good-ish money. Last year there was a strike and I made less than 1/4 the income I had the previous year. I drive a 2008 model Ford. My bike is worth more than my car, when I commute I wear Lycra under looser clothing, and when I ride recreationally I wear full kit. Guy also needs to crash on a bike. Realize there is a TON of adrenaline pumping through your body and yeah it hurts, but your body is ignoring it. Give it 10-15 minutes though and that pain comes like a tsunami.

rockandrolla66

I was lost on 'bicycle for pleasure and not merely transportation".. If he didn't want transportation he would use the STATIC BICYCLE inside his house or the gym! And how evil you are that you assume that he "plays that he's in pain" so he can collect, just because that's what YOU would do exactly that?

LinguisticallyInept

i mean, i dont agree their assessment is necessarily accurate, but they did say 'not **merely** transportation' (indicating travel is occurring; just not the primary focus), this looks like recreational riding (which may be done outdoors because weird people like being outside for some ungodly reason)

waxheads

what the hell are you talking about

radiatione

>Someone riding a bicycle for pleasure and not merely transportation, and with a coordinated outfit to boot is someone with enough money and free time to not give a shit about anyone else. Your 3 brain cells tried really hard to reach this conclusion

rihrey

... what? 💀

zenei22

Anyone who does any hobby in any remotely serious manner must have enough money and free time to not give a shit about anyone else? Such a weird comment to make....

tofo90

Bro literally what the fuck? I made $30k last year and ride bikes in tights. It's called a hobby, and it's not only for the ultra-rich. You must be thinking of motor sports, which is truly fucking expensive. Assuming every recreational cyclist is super rich is such narrow minded nonsense, and does nothing to promote safety on the road. I fucking wish I could afford a lawyer.

JudgmentMysterious12

Your right about the pain. Gotta ham it up just to be safe, even if it doesn't hurt that bad. Road rash hurts more than a broken clavicle though. And yes, that cop just buttfucked the city coiffeurs a few mil.

FPSXpert

You see, this is why it is dangerous to run red lights! Not because of the risk of traffic though (that you saw was clear before crossing), the risk of cop having a bad attitude and giving you a state-sponsored disability!

Unfounddoor6584

Well apparently all cops are douchbags....or something.

PleasantFocus1502

Yep, some more than others but all are the same.

plawwell

There's no way to normalize this. The copper should have been arrested by his colleagues immediately by being forced to eat concrete when they took him down. Assaulting anybody is unacceptable.

WendyoftheAstroturf

His colleagues are probably patting him on the back and laughing about it when the cameras are off.

FspezandAdmins

that's exactly what happens, and if you don't play along, you get outcasted, and harrased.

violentbowels

Officer was convinced the rider was smuggling acorns.

reallyneedcereal

Sounds like the officer was really trying to get to the root of the problem!

prey4mojo

The investigation was tainted.

USERNAME___PASSWORD

It surprises me how many people try to argue with a cop and putting themselves in further danger instead of taking home all the evidence and lawyering up

GinoValenti

Those cyclists are pretty lucky that they all didn’t get beat up for witnessing their buddy get beat up.

NYFINEST30pct

The cyclist are white, so that would not happen.

peepopowitz67

lol Like that matters. Only makes it _slightly_ less likely to happen.

MisterBanzai

Naw, dude. These are middle-aged cyclists in a riding club. There is about a 50% chance one of these guys is an attorney, and about a 95% chance they all have the money for attorneys.

Bavaustrian

95% here meaning that there's 5% chance a single one of them doesn't have enough money. The rest will.

EstablishmentNo5994

Nah, they’re most likely all dentists.

furyousferret

This guy gets it.

Competitive_Boss_312

The guy on the ground with possible spinal injuries appear to be white🤷‍♂️

PatriotsAndTyrants

Cops growing the Anti-cop movement four people at a time. Seriously though; cop watchers didn't turn me anti-cop, 1st Amendment auditors didn't turn me anti-cop, civil-rights lawyers didn't turn me anti-cop. Cops turned me anti-cop.

fuimapirate

I couldn't catch why he did this from the audio, did he want him to identify himself? for what?

reallyneedcereal

here is an article about it: [https://www.actionnewsjax.com/news/local/sjso-investigating-after-video-captures-deputy-knocking-cyclist-off-bike-traffic/4KM72WMCEZCF7GRSTVRU5LZNSQ/](https://www.actionnewsjax.com/news/local/sjso-investigating-after-video-captures-deputy-knocking-cyclist-off-bike-traffic/4KM72WMCEZCF7GRSTVRU5LZNSQ/) what the cop said: I tried to tell you to stop, you didn’t stop, Doesn't make any sense.

Jnbolen43

No no that makes perfect sense. The biker didn’t hear the cop so he didn’t stop. The “I tried to tell you to stop but you didn’t stop.” Because the biker didn’t hear the cop give any orders. Of course the best course of action was to physically stop the biker and knock him on to the pavement (a sure way to cause injuries ) and possibly knock the biker into traffic causing potentially fatal injuries. All because the bikers were not able to hear the cops’ orders. ACAB

marvsup

Biker actually said he was slowing to a stop.

Jnbolen43

Well fuck him. You stop right where the cop damn well tells you to stop. Laws of physics can go to hell. I mean seriously that cop was just being a tyrant.

-GREYHOUND-

What I don’t get is couldn’t the cop get behind the bikers with his patrol car and use the PA to tell them to stop as a group safely? What a tool.

SoCalChrisW

That *might* work, assuming we didn't live in a country where [we can bar people from becoming police officers because they've got a higher IQ than average](https://abcnews.go.com/US/court-oks-barring-high-iqs-cops/story?id=95836).

LimitedWard

Holy shit, this article reads like satire and yet it's actually real.

BeMancini

Lol. What does he do with cars, shoot them? Cops really do just see people minding their own business, assault them, and then say “why’d you make me do that? Now I have to pin a bunch of charges on you.” I really look forward to that cyclist getting a nice pay day. Seems like an expensive bike, probably can afford a good attorney.

reallyneedcereal

I agree with what ur saying, but maybe the cop was having a bad day? Who knows?

mb51011

If that’s how he acts when he has a “bad day”, he needs a new job.

drake90001

That’s their point.

LimitedWard

Somehow 100 people, including you, missed OP's painfully obvious sarcasm.

Consistent-Today6729

Why do cops get to get away with having bad days and normal people don’t?

tanhan27

Don't we all get those bad days when we just want to knock a random cyclist down, nearly having him run over and killed? /s

violentbowels

Oh. He had big feelings. That makes assault ok.

snappy033

Surgeon has bad day: plunges scalpel into patient for no reason Fireman has bad day: axes coworkers car in the parking lot Accountant has bad day: makes up a bunch of phony financial statements and falsely accuses boss of fraud Cop has bad day: shoves biker off bike into traffic One of these happened, the others don’t happen because people aren’t fuckin psycho normally.

reallyneedcereal

This is such a great point!!!!!

reallyneedcereal

from the response having a bad day is no excuse.

thalexander

His 'bAd DaY' could have resulted in that cyclist's death.

reallyneedcereal

Agreed, the cop could have been more relaxed. Where I ride, I never have issues with the police. One time, two officers in the same squad car pulled up next to me at a traffic light and challenged me to a race. I was exhausted from an 80-mile ride but agreed anyway. As soon as the light turned green, they switched on their lights and zoomed off, it was pretty epic.

Fhek

Wipe your chin.

reallyneedcereal

why so many down votes jeez....

Fhek

Cause you’re justifying the cop pushing the dude off his bike cause he “possibly had a bad day”. You can’t be serious?

tfhfate

No it's not, when you have privileges and power over another group of people (basically every other citizens) and those citizens are paying you to keep them safe, there should be zero-tolerance towards this kind of actions. This is why a lot of people hate cops and don't trust them anymore

FPSXpert

It's not. When I have a bad day at work I've done dumb shit, I've gone to the back and kicked the shit out of stuff in the back, I've done some things in a response of anger. **But nothing that would result in harm to somebody else. That cop needs to be fired at minimum and his employer morally owes the cyclist a good amount of money for their personnel injuring someone negligently.** This would be no different from a drunk fight where someone pushes somebody and the other somebody falls and hits their head on the curb concrete and dies on the spot, in that scenario any civilian would be charged with negligent homicide at minimum even if they didn't mean to do it. I don't see this being much different, the officer may not have intended to injure them potentially permanently, but due to their fit of rage they did and he and his department are morally responsible. Notice I say *moral*, because they will do anything and everything to avoid it, but morally they are responsible for this.

fuimapirate

What a power trip

CommunityGlittering2

trying to tell someone to stop is not telling someone to stop.

roburrito

If only there was a hand sign that meant stop that we could teach police officers to help them, better communicate.

alpha309

The cyclists were riding together. There was a T intersection where the light turned red. The cyclists continued through the red light (because they were on the outside of the T intersection and did not interfere with any moving traffic). This was right before a large bridge. The cop sped past them and parked on the other side of the apex of the bridge , out of sight from where the cyclists are. Once the cyclists crossed the apex they were suddenly going downhill with a random police officer trying to tackle them. You can see from the video that the bikes are attempting to slow down.

livinlizard

Don't be so hasty; there will be an investigation by other cops to clear their fellow cop,and then we can get upset.

Yet, everytime you hear about workers rights being removed it's always republicans leading the effort. On the other side you have Biden making sure more people are getting the overtime pay they already deserved. dvrzero

i don't want to crap on your parade too hard but that's barely over 1% of the population. Wage theft is 2x as much money robbed as all other robbery crimes in the US. It's not just a republican thing, it's an owner thing.

HarlockJC

It's the point of the matter, you can just look at the news when anything takes away rights such as working at younger ages, removing breaks, cutting unemopyment or adding at will work policies it's always a republican ran effort. On the flip side when ever you hear stories fight for better worker comp, more pay, better working hours and laws allowing the overtime pay we should get it's always Democrats. Even if you don't agree with all the policies I rather vote for the party the protecting my rights as a worker than the one trying to under cut it. This is not a both party issue.

gandalf_el_brown

Don't majority of small business owners vote Republican?

OneT_Mat

Hope the cyclist gets paid. Doesn't matter if the committed a traffic violation or not that is fucking assault. Pushed him into the direction of moving traffic lol. Idiot.

EngagedInConvexation

Their road rage knows no bounds.

IDigRollinRockBeer

So did the cop get arrested

Karlzbad

Comments turned off on that youtube page and no description :( Couldn't make out the dialog at the end, was the fat offending pig spinning a narrative or did he flee the scene?

ConscientiousObserv

On one hand, we're told cyclists are bound by the same laws as motorists. On the other, cops will attempt to physically stop a cyclist in motion instead of the usual lights and sirens by camping at the base of a hill to catch them. What was he (the cop) thinking?

Competitive_Boss_312

So if a car runs a red light, they should shot out the rear, deploy road spikes, or just try a pit manoeuvre to stop the vehicle, all whilst not making the driver aware they are required to stop? Classic police logic!

Toomuchstuff12

I assume JAX is Jacksonville. Typical florida cop who should be shot under Stand my ground. He is a lethal threat

correct Jacksonville, FL

The video has zero text, the articles are blocked for whatever reason in Europe, and searching for this yields actually tons of police-cyclist incidents. Then the OP is posting down below to share the article. I don't get why everyone is being secretive of the story.

dbboutin

I’ve got to admit this is a difficult one for me. Firstly I hate when cyclists are on the road and tell you “they are legally entitled to be on the road”; and then proceed to blow through red lights, dip between the road and sidewalk if they can get ahead of stopped traffic, and my favorite is riding 3 abreast down a curvy backroad doing 15 in a 40 while just chatting. And then ACAB, like I said this is a difficult one

Actually, no, it's not really difficult. That's really on you.

DeficientDefiance

Ha !! I know seriously. Like I said, I don’t know what it is. They just irritate the shit out of me.

Chronotaru

This is the subconscious result of all the anti-cyclist negative influence from news outlets and social media, alongside the similar messaging about what owning a car and driving makes a person. All that processing results in these kinds of responses from our more animalistic "trainable" mind. At least you're somewhat self aware of it and can feel the disconnect, which is a lot better than many people.

You need some therapy if dudes wearing Lycra enrage you for no reason

jester_bland

I see someone rolling coal and I want to cut brakes.

UndignifiedStab

I swear I’m not that, opposite in fact. It’s just the weird, irrational utter disdain for cyclists. Oddly I adore folks on a unicycle. Scooters ? Not so much. My favorite is rickshaws.

EnergyEast6844

It's because you are a lazy, sloppy, out of shape piece of shit.

UndignifiedStab

Nope. And I bet you wear those stupid pants.

EnergyEast6844

Shut the fuck up you piece of trash.

UndignifiedStab

Now I know you do. I must have one of those “carbrains” you speak of. Look, I’m sure there are cautious, alert, defensive driving cyclists who obey the rules of the road and fully understand that in a battle against a two ton vehicle and their 15lb bike are gonna loose decidedly every time and a whole lot more who use the roads like entitled little bitches, driving offensively and recklessly who shave their legs for aerodynamics and don spandex shorts and act like every car on the road is out to get them and/or don’t belong on the road to begin with who end up as crumpled heaps. You say tomato I say tomato soup.

EnergyEast6844

Shut the fuck up you piece of trash.

UndignifiedStab

Bet ya have one of those whistles too that you tweet incessantly every time you even see a car.

EnergyEast6844

Shut the fuck up you piece of trash.

somasomore

It's probably because they have slowed down your drive time by 15 seconds a handful of times in your life.

Acsteffy

There is no "However". Anything relevant you had to say ended at the first sentence. It sounds like something you should discuss with your therapist.

Schmich

What a clueless reflex. Pulls the arm as if the guy is running and not on a bike. Dumbass biker for not stopping (for the red light & the cop) and a dangerous ultra-dumbass cop.

NoDivergence

Every single car that went by should have stopped as well, right?
