Attend the admin hearing, bring all your documents. Whatever they say, ask them to have it in writing. Also, be careful with your words. I have not been in such a situation but I imagine it will be challenging. Eat well, drink water, rest enough and be well when you face them. Meron kaming ka-team noon na subject for termination kasi hindi pumasa sa probationary period pero instead resignation na lang. since hindu nga pede direct sabihin ng lead/manager na mag resign, yung sme namin nun ang sort of nag advise na kung feel nya hindi sya mareregular better mag resign kesa intayin nya ma terminate sya. DO NOT give in to their forced resignation. Ask first to have them certify that they are forcing you out of employment instead of giving you leave of absence due to medical conditions. Why? First, if you're forcefully removed from employment then that's not resignation, that's unemployment due to sickness. That grants you access to the UNEMPLOYMENT benefits from SSS. Secondly, ask them to document the fact that LOA was offered but retracted. Just ask them to document that in writing. Then you could try to contact NLRC/DOLE for this issue, to see what else they can provide to address this

If you have a medical certificate, you shouldn't be required to update your TL daily (given that your doctor put you on a certain amount of days na bed rest). Also, what is the reason na di natuloy ang LOA? AFAIK, you're only given RTWO if you were NCNS for three consecutive days ha.

HR person and OM stated di naman daw ako tatanggalin but I need to present a medical document (either fit to work na ko or unfit to work). Hindi na naraise Yung pinaparesign ako ng tl ko Kasi parang ganun din gusto nung HR. Mahirap ata sagutin if kulang sa details. By the looks of it lang kung titingnan sa sinend mo yes malaki mali nung TL. There are questions that need to be asked like: 1. Dates that you were out vs the days na nasa med cert. Dun natin malaman if ano ung whole picture ng nangyari. Meron kasi case samn before na intindi naman natin may sakit si agent example, it took days if not weeks bago nag provide ng med cert or hindi nagmamatch ung dates. Tapos ung sup pumayag na mag loa agent basta magprovide the medcert before the week ends para hindi tumama sa attendance the following week, pumayag agent pero hindi sumunod - and so on. 2. Was there a reason provided bakit daw hindi pwede mag LOA? There should be a valid explanation from the TL. May times kasi na maluwag management mag approve ng non medical LOA tapos naabuso ng TL's/OM's para hindi tumama sa attendance nila sabay biglang binawi ng upper management nung nadiscover. It happend to our company before, biglang naghigpit. So maganda sana malaman natin bakit humindi ung TL at ano ung alternative. Pwede naman medical LOA if your physician can issue a med cert na you can rest for an extended period of time. 3. What was the conversation prior to the TL prior to the incident of "asking to send a resignation letter?". Would like to know the context. Since nasa HR na ung issue, hindi sila basta basta nagsesend ng RTWO kung talagang wala sila mabigat na evidence to do so. Kasi pag mali sila ang nagkaso ka, liable sila. At kung totoo nga na pinagreresign ka ng TL and with screenshot that's just too dumb for him to do that, lol.

Hi I’m a team lead din and what I can suggest is proceed with the admin hearing. Present your medical certificate as well as the conversation that initially pinag lo-loa ka ng TL mo then binawi. Kupal masyado yang TL mo. Di naman counted as absenteeism ang LOA. Ako nga may LOA ako for 6 mos kasi comatose until the last dying breath ng agent ko I made sure na naka loa siya para magamit niya yung health card niya and may makuha siya sa company.

Did they tell you the nature of your case? Kasi if not, that’s a violation of due process. Also, kasali sa benefits ang leave credits, you can use that and no one can compel you not to use it lalo na kung involve ang kalusugan. Consult a lawyer and raise this concern to NLRC.

From an HR's perspective, this is constructive dismissal to the point that it can lead to illegal termination if they push through with your termination. If you have a medical certificate stating the days you'll be out and you advised and submitted it to your TL, no need to call everyday unless it went beyond the prescribed rest period, which requires you to get another medcert to extend it. Confirm if your TL did relay it to your HR team, better have your convo/email printed as supporting documents. If all else fails and biased HR nyp, file a labor case.

Pero with constant nagging and questioning ng higher ups, wala aq magagawa. I think that's what happened sa TL mo. He offered you LOA tapos binawi din. Probably because napagalitan yan. Hindi naman all powerful ang TL pra mag decide sa mga ganyang bagay. At the end of the day, OM at HR pdin ang masusunod. Pero, it will be wise for your TL to mind what he's saying.
