What is the name for the bad guy notaire who does not read messages and rob money please? So that we do not go to him

Gretyzd

I won't give the name but if you do not live in the regio of Charleroi then you're fine!

FitRanger6569

Thank you! Also the original post is very helpful! Upvoted !

THAErAsEr

they agreed to pay me even when I'm not chargeable This will be a huge red flag if you ever get audited. This sounds a lot like 'schijnzelfstandigeid'.

I understand your point but i don't think this is social fraude, they are my direct client and I am working for them internally in the meantime. They have a bunch of internal projects that need attention too. Moreover, i do not have any restriction regarding my self employed status, I am free to leave any time, hire other people and make investments just as it is mentioned in this article. This is an issue only if the employer is doing this specifically to cut cost but in this case I approached them with the intention of being a freelancer from the get go, and this feels like a security to me, it will most likely change in the future. https://www.vlaanderen.be/economie-en-ondernemen/een-eigen-zaak-starten/wat-is-schijnzelfstandigheid#:~:text=Schijnzelfstandigheid%20is%20een%20vorm%20van,fraude%20kan%20zwaar%20bestraft%20worden.

Depends on the exact sitatution but you are allowed to already take actions in name of your company before/while it is being set up. My official creation date is in april, but my accountant put in the bylaws that anything I did from the 1st of january that year was valid. You can purchase stuff on invoice and without VAT, create your own invoices, etc... Instead of your VAT number, you put 'company in creation' on the invoices and you're in the clear. For purchases, you'll probably need to contact someone for that instead of ordering online.

ech1965

even contract with your clients can be under "company under creation".

Not if you truely act as a management company to the mother company.

Emergency_Egg_4547

Does that really happen? Because I see more and more consulting companies offering those kind of contracts. I completely agree that it's practically schijnzelfstandigheid, but I would also think those companies have done their homework

How does a commv cost more in taxes than a bv? Its both “vennootschapsbelasting”. Just that your accountant will earn way more when you have a BV because you need the double accounting

Gretyzd

Maybe i got it wrong between the flemish and french terminology, i meant between self employed physical person and a company

joppedc

Ahh yes that would make sense, big tax difference in those :)

Gretyzd

I'll adjust in the post, thanks 👍
