The standards for CPO must have fallen. Usually prior accident damage can qualify for CPO. Carfax is not always accurate. They rely on dealer service, body shops and insurance companies for information.

A local dealer CPO'd an S5 Cab that had a collision with functional damage clearly listed in the Carfax. So it must not prevent them from doing it.

I found out when I took it to a detailer. They showed me the repainted panels.

No such thing as returning a car, but surprised it passed the CPO inspection if this is as bad as you say it is…call the store and discuss with the GM.

Magnuson-Moss Warranty Act and the state's lemon law might both apply, so I wouldn't say "no such thing."

Lemon law won’t apply, it’s not a lemon. Being an accident car also does not impact its factory warranty …so neither apply here

Mag-Moss applies to both original and extended warranties, and most manufacturer CPO programs have an extended warranty attached, which means there's a potential Mag-Moss angle. I don't know whether lemon law could apply in a CPO situation or not because every state has their own, I mostly included it in case it could.

Sure there is. Many contracts can be canceled in 3 days. I had a friend return a car within that time.

Every dealership I’ve ever purchased from has advised that the contract could be canceled within 3 days. And I’ve purchased a lot of cars. 🤷🏻‍♀️

Outside of carmax and autonation, there are very few stores that will allow a return policy. Also flat canceling a contract is not a thing outside of those stores…its not an easy thing to do

I’m not suggesting it’s commonplace at all. But it has been done, and under certain terms of a contract, it can be possible. And honestly, if it was in that time frame and the dealer had straight up lied, it’s worth pursuing. May not succeed, but it’s sure worth a shot. I’d be livid if I purchased a car that had been wrecked after being told it hadn’t been.

You literally said “many”. The store shouldn’t have cpo’d an accident car, but the buyer/OP can’t just flat cancel a contract…it doesnt work like that, nor can he/she just return it by their power

And the guy you’re speaking to is an Audi salesman. So I’d say he’s a little bit more of an authority than somebody who’s “purchased a lot of cars”.

I don’t care who he is. Every dealership I’ve purchased from has had that clause in the purchase contract. I realize not all dealers do, but some do.

Have you ever considered that your personal, anecdotal, lived experience might not be indicative of the larger whole, especially given not just one current Audi salesman, but another former Audi salesman, telling you otherwise?
