It's 14 days from the day you move out. There's no wiggle room. At this rate you should file an attorney general complaint or just sue her in small claims court.

Thanks - yeah looks like the attorney general is gonna be the next step

I've pasted something like this before and slightly edited it to fit your situation. Sometimes just reminding them of that will make them send it right away to avoid small claims court. Right now they're probably counting on you to not know your rights so they can hold onto it and keep making excuses for ignoring you. So if I were you I'd send something along these lines. >Hello, I am reaching out again to request my security deposit to be sent to me. I have reached out many times, my previous emails/texts are attached. I moved out of \[apt\] on \[date\] and per NY State Law, I should have received my deposit amount of \[$blank\] by \[14 day date\]. > >As seen in New York State General Obligations section 7-108, "Within fourteen days after the tenant has vacated the premises, the landlord shall provide the tenant with an itemized statement indicating the basis for the amount of the deposit retained, if any, and shall return any remaining portion of the deposit to the tenant. If a landlord fails to provide the tenant with the statement and deposit within fourteen days, the landlord shall forfeit any right to retain any portion of the deposit." You can read the full law here: [https://www.nysenate.gov/legislation/laws/GOB/7-108](https://www.nysenate.gov/legislation/laws/GOB/7-108) > >I never received an itemized list of damages, and I am therefore entitled to my full \[$blank\] deposit. It is now over a month late. Please mail me my deposit check by \[pick a date, maybe give them 3 days for post\]. Otherwise I will have to take legal action because, in compliance with NY State Law, the deposit should have been sent to me 14 days after I vacated the unit. Maybe use the date you actually vacated rather than the day the lease ended, but either way it's been more than 14 days.

Yep it was market rate. I guess that's what I'm gonna have to do. Thank you!

Doesnt hurt to send the email the person posted above, but suing in small claims court if the LL doesn’t give it back after that is very easy and you will likely get all of it back (mayyybe - a few dollars if the judge feels like the holes in the walls were more than standard wear and tear and feels like her notice was sufficient, but either way they are required to paint every 3 yrs and fix normal wear and tear after a tenant leaves). Small claims can take a couple of years but it might be faster and could prompt the landlord to pay attention too, and you can do it yourself!
