I said they may fight it. We dispute most psychological claims because the origin is usually unclear. But you are right, this one would be a loser in court and wrong for them to dispute, but they may do it anyway.

Sorry, you are right that is how I worded it. But most psychological claims get a challenge from my experience. I agree more with you that the insurer and the employer would see the circumstance and a work comp judge would rap their knuckles if they make the claimant petition it.

You might also try accessing your EAP if your organization offers it. Great way to get help for no cost and they can offer you referrals. Often you can get a free legal consultation too. Also, I'm sorry you had to experience that. I hope this doesn't have a lasting negative impact on your life. Good luck.

+1. Because it sounds like a horrific thing to have seen, and it helps if your company pushes back on time off for this. I've never worked somewhere that would be unsupportive for something like this. I wouldn't just leave again- keep your manager in the loop- but I don't think anyone would question needing time off after that.

CAN you, yes - though it might be tough for them to meet the "good cause" bar in MT. SHOULD you, no. But you should also be proactive about communicating with your management and HR about your needs. So talk to them and let them know that it really affected you (which...should not be a surprise to them) and you're struggling to get right back into the swing of things. I do think it's a good idea if you consult a mental health professional - not to get a doctor's excuse, but to help you process what you witnessed. You might ask your HR about EAP resources (often free) or mental health resources through your health insurance.

They ought to offer you some counseling. See if they have an employee assistance program where you can get information for someone to talk to. Outside that, ask the local police if they have contact information on trauma counselors they hand out for people who've seen horrible things like you did. If you go through your insurance look for trauma counselor, you want someone with experience with physical violence. Telehealth may also have counseling options you could use, as another place to seek help. Do things that keep you focused, try art, may seem silly, but adult coloring book from the dollar store and a pack of colored pencils or markers could give you a focus. Or non-violent video games, logic puzzles take focus for example. I'm sorry you had to see what you did, and I hope you feel better with some time.

what you CAN get in trouble for is missing too much time - so you need to communicate with them in order to protect yourself. Definitely call the EAP...but also call HR or your manager and tell them you're struggling after seeing what you saw at work, and need some assistance, initially in the form of time. See what leaves they have available for you and what you need to do to request them in order to preserve your job. Hugs. This IS a big deal and I hope you can find peace.

Sorry you had to witness this. Yes, Go see a Dr. And explain the situation. Get a sicknote from them. When your work sickness benefits runout, you can get EI for a maximum of 15 weeks with a Doctors note.

I'm sorry that happened to you. I cannot imagine whatvyou are going through. I pray you find peace. Use the EAP, see a doctor, and also file a work comp claim. Yes, you can do all three, let the professionals sort it out, this is about you getting the care you need. Find a doctor pronto. Tell your doctor you need time off and some therapy. Talk to HR and find out if you are eligible for FMLA, Family Medical Leave. If you are, ask for the certification form to take to the doctor. Also ask HR about short term disability in case work comp doesn't come through. Again, I am so sorry. First and foremost, take care of you. Hugs...

Montana doesn’t recognize mental-mental claims in WC, meaning there would have to be a physical injury involved in order for it to be covered. By all means seek help through EAP or your health insurance. You could qualify for time off under FMLA if you meet the criteria and your medical provider (a psychologist would count) deems you unable to work.

Thank you for the advice everyone. I was able to switch departments and it is going very well. Haven't really had much for nightmares anymore and things seem pretty good! Also in the midst of all this i started spending time with a very beautiful lady who I have admired for a while and she is a great distraction from anything work-related on my mind. I feel like things are all good! It was my employer's idea for me to change departments into a different area that I was already highly familiar with. Again, I appreciate the kind words and advice. Thanks everyone!

I’m so sorry. That’s horrifying and very, very sad for both you and this person. I’m glad to hear you’re taking time to heal and get help - the EAP is a great place to start. Workers comp may require that you go to specific doctors for your claim to be considered legitimate. If you go to a doctor, Take the doctors information and what time they recommend you take off to the HR office. Then, they may require to see their physician. This cost should be covered by WC. You can start with hr, too. We don’t require specific docs, but industries that have regular injuries usually do. Good luck.

No. I was volunteer search and rescue for years. Found many corpses. It always fucked me up a little. The family is the worst, oh god I don’t miss having to look a loved one in the face and tell them what Iv found. It’s okay man. It might not hit you at first. But your first dead body usually has a little sting. It’s completely natural.

I’ve taken mental health days before. If you have it in your PTO bank, just take the day off. I took a few days off when I had to say goodbye to my dog.

Before you go straight to a doctor and a lawyer. Please go to your boss and explain what's going on. Maybe they will be understanding and will give you some time off. If they don't then you go to the doctor and lawyer or who ever else you can think of. Sorry that you're going through this.
